Sincerely, Scott Lonclanecker Land Use Planner Mason County Planning Department 3/19/2004 1 of 3 SP12004-00066 Site Inspection 3/19/2004 Case No.: SP12004-00066 Comments: Pre-inspection for Michael Hardin: The purpose of the site visit was to evaluate critical area issues, stream setbacks / buffers etc. related to future residential development. A previous Pre-inspection was done two years prior (March 15, 2002) [see enclosed]. The report from the previous site visit indicates similar findings as the current inspection. The report from two years ago to the same applicant indicated that it appeared a variance and habitat management plan would likely be necessary for site development/ construction. The stream buffers and setbacks currently in effect are the same as required in March 2002. The zoning designation for the site is Rural Residential 5. Standard building setbacks for this zoning are a 25-foot front yard setback, and 20-foot side and rear yard setback (lot line setbacks). The exception to this is for lots less than one acre and under 100-feet in width. In this case side yard setbacks are equal to 10% of the lot width, but no less than 5 feet. These setbacks are measured from structures above grade such as roof overhangs, and other structures /appurtenances, including heat pumps etc. Other setbacks can apply when critical areas are present such as streams, wetlands, steep slopes etc. The Mason County Shoreline Master Program designation is Conservancy. (Please note that the standard sideyard setback in the Conservancy designation is 25-feet, however this apparently has not been strictly enforced due to the urban sized lots in the Lake Limerick development per discussion with Senior Planner, Grace Miller. The minimum sideyard setback in any instance would be 5-feet under current zoning. Staff believe that the Shoreline Conservancy designation in this area may have been in error, although it has not been formally changed or corrected). Shorelines / streams: Shoreline setbacks and buffers are required per the requirements of the Mason County Resource Ordinance and Shoreline Master Program. The shoreline setback from Cranberry Creek per the Mason County Shoreline Master Program is 50-feet. However, the buffer/setback required for type 1 streams under the Mason County Resource Ordinance is 165-feet (150-foot natural buffer, plus 15-foot building setback). This setback/ buffer is measured from the nearest point along the streams ordinary high water mark or channel migration zone, whichever is closer. Slabs at grade, landscaping etc. are permitted within the 15-foot building setback area. An unpaved, 3-foot wide trails are also permitted within the shoreline setback and buffer. See Resource Ordinance section 17.01.110 for other standards. As mentioned in the previous report from March 2002, 3/19/2004 2 of 3 SP12004-00066 Site Inspection 3/19/2004 Case No.: SP12004-00066 it appears that a Mason County Resource Ordinance Variance to the standard stream buffer requirements would be necessary on the subject property based upon several measurements taken with the property owner. The precise location of the stream buffer /setback on the subject property will have to be mapped. The applicant's environmental consultant would most likely do this in conjunction with a Habitat Management Plan. Flood zones: Portions of the property are mapped as being within the Zone A flood zone of Cranberry Creek. Proposed development within the mapped flood zone will require a FEMA flood elevation certificate (see enclosed map). Wetlands: There is a wetland edge associated with Cranberry Creek in this area. It appears that any required wetland buffer/ setback would be exceeded by the required stream buffer/ setback. A wetland delineation may be necessary if encroaching within 100-feet of the wetland edge (standard category II wetland buffer/setback). Geological / landslide hazards: Slopes on lot number 136 did not exceed 15% (avg. 10%). Development on this lot as currently exists would not require geological /geotechnical review. However, if proposing development in other areas within 300-feet of slopes over 15% and with greater than 10-foot difference in elevation geological or geotechnical review would be required per the Mason County Resource Ordinance section 17.01.100. Applicability of regulations is determined at the time of receipt of a COMPLETE building permit application. Planning staff met Michael Hardin at site 3/4/02. Staff is still a little confused about which lots will be combined, the following is our understanding, please clarify if your proposal differs: Lot 136 - remain as one lot. Site has existing manufactured home. Existing workshop on same property, which was converted to accessory living quarters without permit, to be converted back to workshop by removal of bathroom facilities. Vacant Lots 137 and 138 proposed to be combined. Vacant Lot 139 and 140 proposed to be combined. Vacant Lot 141 to remain a single lot. Under present regulations as of 3/15/02, It appears you will need a Mason Environmental Permit Variance to Type I stream setbacks, plus a Habitat Management Plan evaluating the site, describing the proposed development and its impact, and recommending appropriate mitigation. The plan must meet the criteria of the Fish and Wildlife Habit Conservation Areas chapter (see enclosed highlighted area. Application materials are enclosed, as well as a fee schedule. The process involves public notice, a public comment period, a public meeting before the Planning Commission, and a public hearing before the Board of County Commissioners. Given the lot depths based on site observation, it is likely a shoreline variance to Conservancy 50ft setback will be required on several lots. It is difficult to give specific information without a proposed site plan to work from. Steep slope and steep river bank will make it necessary to require geotechnical reports by a licensed engineer for all sites. The report must meet the provisions of the Landslide Hazard Area provisions for geotechnical reports for review to occur. This letter addresses only planning issues relative to the Shoreline Master Program and Resource Ordinance. Sincerely, Allan Borden Land Use Planner Mason County Planning Department 3/8/2006 1 of 3 SP12006-00034 Site Inspection 3/8/2006 Case No.: SP12006-00034 Comments: Site inspection of Mar. 7, 2006 for James Dunn: The purpose of this inspection was to determine applicability of planning regulations to site. The subject parcel [lot 136, Div. 4 Lake Limerick] is located along Cranberry Creek, a type 1 stream in an area of several bends in the creek alignment. The properties slope slightly downward from the roadway, from a cleared area where the septic system installed in March 1996 is situated, to native tree and shrub cover largely undisturbed along the creek. At least 40 feet at the eastern end of the 230-foot lot depth is covered by the channel of Cranberry Creek. Mason County Resource Ordinance A designated Type 1 stream is a perennial water of significant volume and fish bearing capability and falls under the jurisdiction of the Fish and Wildlife Habitat Conservation Areas Chapter (17.01.110) of the Mason County Resource Ordinance. These provisions establish a 150-foot vegetation buffer and a 15 foot building setback requirements for a type 1 stream, for a total of 165 feet from the channel migration zone (CMZ). In accordance with the Resource Ordinance, buffers are to be retained in their natural condition, but portions of established use area may be maintained. New residential development is not permitted within Fish and Wildlife Habitat Conservation areas or its buffers, except for as approved through a variance or reasonable use exception review process. Staff made a measurement near the south property line of lot 136 from the estimated bank of Cranberry Creek to a distance of 85 feet west towards the street, where a stake was placed (the point at which the owner may choose to propose a residence). There is 36 feet of lot depth westward to the point where the septic tank is now located. If the full extent of the 165-foot setback standard for a type 1 stream were marked, it would occur in the middle of the existing drainfield area and about 42 feet from the Dartmoor Rd. easement. Based on this field review and the presence of the existing drainfield area, no area exists on the subject parcel that would not be unencumbered by the critical areas buffer and building setback. The review of a variance from the Fish and Wildlife Habitat Conservation Areas chapter would be necessary to pursue residential development on this property. A Habitat Management Plan (HMP), prepared by a qualified biologist, would be required as part of the variance request to support the proposed development. The HMP addresses impacts to the buffer and offers measures to preserve and protect the buffer or 3/8/2006 2 of 3 SP12006-00034 Site Inspection 3/8/2006 Case No.: SP12006-00034 to mitigate impacts of the development proposal. A copy of the Fish and Wildlife Habitat Conservation Areas chapter, including details on the contents of an HMP and the variance public review procedure, was given to the owner. Application for a variance to these standards does not guarantee approval of the development as proposed. Mason County Development Regulations: The site is zoned Rural Residential 5 (one dwelling unit per 5 acres). Development regulations for this zone set forth a front yard and Road right of way setbacks of 25 feet from the edge of easement. An administrative variance may be requested to reduce this setback as low as 10 feet, if the size, shape, or features of the property constrain development front yard and road right of way setbacks. This process requires application and review at the time of the building permit submittal. In addition, the required sideyard setback on the subject parcels is equal to 10 percent of the lot width, or approximately 6 feet. This setback may be reduced by administrative variance to as low as 5 feet. These setbacks are measured from structures or projections greater than 30 inches above grade, such as roof overhangs or gutters, balconies, stairs, decks, heat pumps, etc. General process: Future site development must include a site plan, reflecting all of these setbacks from property lines, slopes and stream, will be needed for building permit application submittal. A topographical profile will be beneficial in showing how the development is located in respect to the stream and road. No other critical areas such as steep slopes were identified on site that would have an impact on future development.
