Box 368 Belfair, WA 98528 September 20, 2004 Dear, Mr. Lincoln, This letter is in follow up to Eric's concerns about having to leave pileated woodpecker habitat (snag trees with evidence of woodpecker activity) on the portion of Unit 2 that is slated to be cleared for a homesite. I've gone back and checked the regulations (Fish &Wildlife Habitat chapter of the Mason County Resource Ordinance) and basically what it says is that all habitat of the species listed in the ordinance are to be protected. If someone needs to destroy some habitat (for good cause) then they must submit a Mason Environmental Permit (MEP) and a Habitat Management Plan (HMP). I understand that leaving these snags is a hindrance to the development of Unit 2. However if you can't live with those snags on the building site, you will need to go through the MEP/HMP process (which will probably end up recommending relocation of the snags). I have discussed your case with my manager and this is all the latitude that I can provide you on this issue. At this point the choice is yours as to which way to go. The geo-tech reports look to be pretty complete and I will forward them to Alan Tahja for review before the end of the day. One might be able to argue that the geo-tech reports address your stormwater requirements, I will let Alan decide if the documents are adequate in that respect. I While the geo-tech report provides building setbacks from the crest of the slope and allows you to cut trees on the slope as long as the stumps remain in place, it is my job to overlay that information with your FWHCA (streams) setbacks. You know that there is a Type 4 stream on Unit 2, but you might not be aware that the "seepage" at the bottom of Unit 1 qualifies as a Type 5 stream. Unit 1.- It appears from your maps that you plan to log most of this parcel both for a home site and for views. That is okay per your geo-tech report, but you need to leave a 75-foot (halo) buffer on the Type 5 stream that is visible at the bottom of the lot. Before I can issue a SEPA determination this buffer needs to be flagged. Before any flagging can occur I need to discover were the defined stream channel begins. Given conditions on site this won't be easy, but if Eric is able to help me with the fieldwork it could save some time. If you think I am wrong about a typed stream being on this unit, you are welcome to hire a qualified biologist to make an independent assessment of the situation. Unit 2 1 understand that you are only planning to log enough ground for a home site and that you will be concentrating on the northwest corner of the lot. I need to make sure that your cut maintains a 100-foot buffer on the stream. At this point I am resisting the temptation to ask you to hire a biologist to flag the buffer and will instead attempt to flag the buffer myself. Although flagging this buffer will be difficult without a rangefinder. I also observed Pileated Woodpecker habitat on Unit 2. 1 am hoping that the habitat snags are outside of your cut area, but either way they will need to be left standing.
