Re: Community Club Funding of Station Construction
Dear Chief Graeber:
You have requested our opinion regarding the legality of a local community club
making a substantial contribution toward the construction of an addition to one of the
District's stations. It ism un

meetings`and other functions,Based on our research and experience with other Ditricts
we provide you with the following opinion.
RCW 52.12.031.provides that fire protection district may:
Contract�with any ... private person or entity.... This 6ontracting authority includes the
fi!rrishing of,., facilities;..:to .... the district
This provision authorizes the District to negotiate a contract with the community
club to provide the community clubwith specific rights to use t'�e statior. in
t_consideration of the .community clubs•financing• of the station construction.
Under this approach, we would recompiend, at a minimum,•that the community
club agree that all improvements will be owned by the District and that the
commun ty'-clubs -rights,to use the: station.would not be permitted to interfere
with.the' o eration of the District.

We have drafted similar agreements in the past and can certainly work with the
District to prepare an appropriate agreement for this proposed relationship. If
you have any questions, or would like us to prepare any draft agreements, please
