This decision was made pursuant to Mason County Ordinance No. 5-98. A SEPA Mitigated Determination of Nonsignificance was issued regarding the project on 7/17/03. Per the Mason County Hearing Examiner,Rules of Practice and Procedures,Section 3.13,a motion for reconsideration by the Hearing Examiner may be granted. Motions for reconsideration must be filed within 10 days of the date of this letter.The fee for a motion of reconsideration would include Hearing Examiner cost of$200.00.Please follow the procedures outlined in Section 3.13 to apply for a Motion of Reconsideration.Application for a Motion for Reconsideration should be sent to Mason County Community Development Department and payment should be made out to the Mason County Treasurer's Office. A Special Use Permit is required for the tower because it exceeds the height limit for 9 communication towers imposed by Section 4(b)(1)of Ordinance 5-98. Applicant. The applicant submitted its application on June 5, 2003. South Sound Broadcasting Special Use Permit P. 1 Findings, Conclusions and Decision {PA0551071.DOC;1/13009.900000/f 2. Hearing. The Hearing Examiner conducted a hearing on the application 1 on August 12, 2003, at 1:00 p.m., in the Mason County Board of Commissioners 2 Meeting Chambers. 3 Substantive: 4 3. Site Description. The proposed radio broadcast tower will be on private 5 commercial forest lands owned by Simpson Timber Company. This site is located on top of North Mountain and at an elevation nearing 3,000 feet. The tower will be sited 6 in a leveled and cleared area in the vicinity of several other communication towers. Little native vegetation exists on or near the development site, as it had been 7 previously cleared to allow for previous tower installation and access. The development site is surrounded by variously aged evergreen forest and is actively 8 managed as long-term commercial forest lands. There are no residential structures 9 within several miles of the site. The site is served by SimpsonTimber Company forest service roads. 10 4. Characteristics of the Area. The general area is mountainous, and heavily 11 forested timberland managed by Simpson Timber Company. Due to the topography and mature forest, it is difficult to determine what properties will be able to view the 12 proposed tower, however, since there are no residences in the area, view impacts are 13 minimal. 14 5. Adverse Impacts of Proposed Use. Since the tower will probably not be visible from any of the residences, and the area is heavily forested and designated as 15 rural or long-term commercial forest, no adverse impacts are discernible. 16 CONCLUSIONS OF LAW 17 Procedural: 18 19 1. Authority of Hearing Examiner. MCC 15.03.050(J)provides the Examiner with the authority to review and act upon variance applications. 20 Substantive: 21 2. Zoning Designation. The comprehensive`plan designation of the site is 22 long-term commercial forest land. 23 3. Review Criteria and Application. Section 4(b)(1) of Mason County 24 Ordinance 5-98 limits the height of communication towers to 150' for three users. However, Section 6(a)(1) provides that these height limitations can be waived if the 25 criteria for a special use permit are satisfied. MCC 1.05.044 governs the criteria for special use permits. Sections 6(c) and (d) of Ordinance No. 5-98 add additional South Sound Broadcasting Special Use Permit p. 2 Findings, Conclusions and Decision {PA0551071.DOC;1/13009.900000/} criteria for special permit review for radio towers. All referenced criteria are laid out I below with applicable Conclusions of Law. 2 MCC 1.05.044(A): That the proposed use will not be detrimental to public health, 3 safety and welfare. 4 4. Since the proposed tower is in an undeveloped area that, due to its zoning designation, will most likely remain undeveloped, and it is shielded from adjoining 5 uses by extensive foliage, is setback from adjoining property lines as required by 6 Ordinance No. 5-98, and is probably not visible from adjoining residential uses, the tower has no discernible detrimental impact to public health, safety and welfare. 7 Further, the recommended conditions of approval by staff at page 5of the staff report help assure that construction activities for the tower will have no significant adverse 8 impacts, that cumulative impacts will be reduced by a co-location requirement and 9 that long-term impacts are reduced by the requirement of removal upon abandonment. 10 MCC 1.05.044(B): That the proposed use is consistent and compatible with the intent of the comprehensive plan. 11 5. As testified by staff in their staff report, the proposed tower is consistent 12 with the Mason County Comprehensive Plan. It is located in an area designated as 13 rural or long-term commercial forest. 14 MCC 1.05.044(C): That the proposed used will not introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent 15 properties in the community at large. 16 6. Staff testified that they knew of no hazards created by the proposed tower. There is no evidence that the tower would create any such hazard and the above 17 criterion is therefore satisfied. 18 MCC 1.05.044(D): That the proposed use is served by adequate public facilities 19 which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan. 20 21 7. Staff testified that the facility will be unmanned and hence not need any public facilities. The staff report also indicates that there is sufficient road access to 22 the facility. It is unclear whether the site needs power, but given staff recommendation for approval and a finding of consistency, it is presumed that such 23 power exists. 24 MCC 1.05.044(E): That the proposed use will not have a significant impact upon 25 existing uses on adjacent lands. The primary adverse impact created by the proposal would be aesthetic. 1 Since surrounding lands are undeveloped and the zoning designations will maintain 2 that undeveloped state, there is no discernible significant aesthetic adverse impact.. 3 MCC 1.05.044(F): If located outside the urban growth area, that the proposed use will not result in the need to extend the urban services. 4 9. As noted in Paragraph 7, it does not appear that any urban services need to 5 be extended to the site since it is an unmanned facility and there is existing road 6 access to the lot as well as power, if needed. 7 Ordinance No. 5-98, Section 6(1): Height ofproposed tower. 8 10. The tower will be 230' tall. This is significantly taller than the 150' limit for towers used by three users, however, the site is remote enough and the parcel 9 large enough to shield the aesthetic impacts of this height from adjoining uses. 10 Ordinance No.5-98, Section 6(2): Proximity to residences or residential districts. 11 11. There are no residential structures or districts near the site. 12 13 Ordinance No. 5-98, Section 6(3): Nature of uses on adjacent nearby properties. 14 12. The use on nearby properties is similar to the subject property. They are used for long-term commercial forestry and commercial communication towers. 15 Ordinance No. 5-98, Section 6(4): Surrounding tree coverage. 16 13. The area is surrounded by dense evergreen forest that will serve to shield 17 any adjoining developed uses. 18 Ordinance No. 5-98, Section 6(5): Surrounding topography. 19 14. The surrounding area is steep and mountainous. Other than providing 20 further aesthetic shielding of the property, the surrounding topography has little 21 bearing on whether the tower should be approved. 22 Ordinance No. 5-98, Section 6(6): Design of tower. 23 15. The tower is a metal lattice design, with relatively minor width, which therefore reduces aesthetic impacts. 24 25 Ordinance No. 5-98, Section 6(7): Proposed ingress-egress. 16. There is existing access via Simpson Timber Company forest roads. Introduction. This report evaluates Special Use Permit application no. DDR2003-00052 for a proposed FM broadcast antenna and tower on Simpson Timber Company owned property. The site is located on North Mountain, approximately five miles north of Lake Nahwatzel in a remote mountain top location where several other communication towers currently exist. The purpose of this permit is to review potential impacts of constructing a 230-foot tall antenna support tower for three potential users. The standard administratively approved three-user tower height limit is 150-feet. References to County Regulations are to Ordinances as approved. 2. Applicant. South Sound Broadcasting. 1803 State Ave. NE, Olympia WA 98506. Representative: Greg Smith. 3. Property Location. SW '/4 of Section 8, Township 21 N, Range 5 W. Parcel No. 52108-30-00000 4. Date of application. June 5, 2003 5. Date of Public Notice. July 24, 2003 6. Project Description. The proposal is to construct an FM broadcast antenna and support tower, consisting of a new 230-foot tall, support tower with attached antenna system. A base station will also be constructed within a,lease area measuring 30 ft. by 65 ft. located relatively centrally on a 168 acre parcel of timberland owned by Simpson Timber Company. The property size is such that building setbacks are irrelevant, however it is still a standard requirement that minimum setbacks are equal to the height of the structure. The following is the reason South Sound Broadcasting has given for the proposed 230-foot tall tower. "The FM antennas need a minimum of 130' of straight tower section. The KAYO-FM analog antenna is 54' long. The KAYO- FM future digital antenna will be 10' long. The KFMY-FM analog antenna will be 34' long. The KFMY-FM digital antenna will be 5' long. In addition, there needs to be a minimum of 10' of physical vertical space between the antennas." "It is desirable to have the bottom element of the FM antenna vertically above all other antennas at the site. This minimizes any potential frequency interference with other equipment." "it is necessary to have all high power FM antenna elements far enough above the ground to minimize RF exposure at ground level." 7. Evaluation. A) Characteristics of the site. C) Comprehensive Plan Designation. The Comprehensive Plan Designation of the site is Long-Term Commercial Forest Land. 8. SEPA Compliance. A Mitigated Determination of Non-significance was issued on 7/17/03, and the final comment date was 7/29/03. 9. Other Permits. In addition to this Special Use Permit, this proposal will require a Mason County building permit. 10. Analysis. This proposal requires a Special Use Permit under Ordinance No. 5- 98 Standards for Telecommunication Antennas and Towers, (as approved) because the proposed 230-foot tall tower/antenna does not meet the dimensional requirements of Mason County Ordinance (MCO) 5-98, Standards for Telecommunications Antennas and Towers, section 4.b.1. Since the proposed tower exceeds the 150-foot height limit for three users, a Special Use Permit is required. The proposed tower does meet the foot-for-foot property line setback requirement per MCO 5-98, section 6.e.1. i/KAYOradioSUP 2 11. Compliance with Mason County Comprehensive Plan Development Regulations This proposal requires a Special Use Permit because it is possesses unique characteristics due to size, nature, intensity of use, technological processes, demands upon public services, relationship to surrounding lands, or other factors, as noted in Section 1.05.040 in the Mason County Development Regulations. This Section provides six criteria for review. 1. That the proposed use will not be detrimental to the public health, safety and welfare; 2. That the proposed use is consistent and compatible with the intent of the Comprehensive Plan; 3. That the proposed use will not introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large. 4. That the proposed use is served by adequate public facilities which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan; 5. That the proposed use will not have a significant impact upon existing uses on adjacent lands; 6. If located outside an Urban Growth Area, that the proposed use will not result in the need to extend urban services. Staff Discussion of Development Regulations section 1.05.040 review criteria: 1). Since the proposed tower has been thoroughly engineered, is setback the required distance from adjacent properties and is not near any residential development it appears unlikely that this proposal will be detrimental to the public health, safety and welfare. 2). The proposal appears to be consistent with the Mason County Comprehensive Plan because the tower will be located in an area designated as Rural or Long Term Commercial Forest. 3). The proposal does not appear to be introducing any hazards that have not been mitigated for since to proposed tower location meets required property line setbacks and will be located in a remote area. 4). No public facilities (emergency etc.)will be impacted by the proposal, as it is an unmanned radio broadcasting facility. i/KAYOradioSUP 3 earlier in section 6., the existing towers are not tall enough for the proposed use. 14. Conclusions. For the proposal to be in compliance with Ordinance No. 5-98 Standards for Telecommunication Antennas and Towers, a Special Use Permit is required because the height of the proposed tower exceeds the 150-foot height limit for three users. The proposed location does meet the foot-for-foot property line setback requirement of MCO 5-98, so the tower meets required setbacks. The proposed tower does not appear to negatively impact adjacent properties or land uses. The Department of Community Development has not received any negative comments or concerns about the project through the public notice process. The proposed location should minimize potential visual impacts from the tower on the subject property because of the adjacent forest and remote location. The proposed radio broadcasting tower appears to meet the review criteria of the Mason County Development Regulations for Special Use Permit consideration. Staff recommends approval of the Special Use Permit, subject to the following conditions: 15. Conditions: (1) All upland areas disturbed or newly created by construction activities shall be seeded, vegetated or given an equivalent type of erosion protection (silt fencing or straw matting (2) The applicant shall consider the collocation of additional communication antennas on the approved tower upon the request by other communication companies in order to reduce the need for additional tower construction in the area. (3) The applicant shall remove the tower within ninety days of the date of notice that the subject facility is abandoned (i.e. taken out of use for all facility users for any period of twelve consecutive months). No Application for Special Use Permit South Sound Broadcasting LLC is seeking a Special Use Permit to construct this FM tower on North Mountain, as the tower will be taller than 1501. Response to Section 3. General Guidelines and Requirements. a. Purpose and Goals: This proposed tower is to be constructed in the Long Term Forestry zone. The North Mountain site contains several existing short towers. The proposed tower is designed to hold two FM antennas capable of multiplexing two additional FM stations. This site was selected for its altitude above sea level and its unobstructed coverage of South Puget Sound. The site is barely visible from populated areas. Special hazard lighting systems will be employed on the tower that will minimize light exposure at ground level. 3.c. Simpson Resource Company's North Mountain Communications site. There are three existing "users" at this site. At the very top of the hill: 1. The Simpson Timber installation consists of a 60' tall four-legged lattice-metal self-supporting tower. This is a lightweight tower that holds several microwave antennas as well as some two-way communications antennas. There is a second 80' tall three- legged lattice-metal lightweight tower that holds additional two-way communications antennas. Simpson has four small buildings on the site. Three contain transmitter equipment. One is a two-story concrete block building and two are single story fiberglass portable units. The fourth is a metal shipping container that houses their standby generator. 2. The Bonneville Power installation consists of one 35' tall lattice-metal four legged self-support tower. There are several microwave antennas on this tower. There is one modular building that houses the equipment and a second building that contains their standby generator. On the lower landing(approximately 15') there is currently one user: 3. Verizon has a cellular site. There is a wooden pole that is approximately 55' tall that contains the cellular antennas and microwave antennas. There are two modular buildings at the site. One is a combination equipment shelter and generator unit. The second is a smaller shelter. Response to Section 6. Special Use Permits C. Factors Considered in Granting Special Use Permits (1) Height of the proposed tower; 230' (2) Proximity of the tower to residential structures and residential district boundaries; Approximately 5 miles (3) Nature of uses on adjacent and nearby properties; Forestry (4) Surrounding tree coverage and foliage; There is no tree coverage at the top of the mountain. On the sides and surrounding area there are fir, cedar, alder, maple trees. (5) Surrounding topography; Mountainous (6) Design of the tower, with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness; The tower will be an open lattice design with a galvanized gray color that blends into the skyline. The base of the tower will not be visible from public areas, as the mountain itself will obstruct it. The distance of the tower from public areas may make the tower difficult to see from public areas. (7) Proposed ingress and egress; Access will be by existing logging roads. (8) Availability of suitable existing towers and other structures as discussed in Section 6.d of this ordinance. None are tall enough.
