Would be considered and ADU. Dear Applicant: Pursuant to your application,a site pre-inspection (SPI)was performed on your property. Below you will find comments made regarding the proposed development and its critical values. In some cases,setbacks for development from shorelines, steep slopes,streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Scott Lonaanecker Land Use Planner Mason County Planning Department 1/29/2004 1 of 3 SP12004-00006 Site Inspection 1/29/2004 Case No.: SP12004-00006 Comments: Pre-inspection for Mr. Holl and Robb's Construction: Rural Residential 5 zoning designation. Standard building setbacks for this zoning are a 25 foot front yard setback, and 20 foot side and rear yard setback. The exception to this is for lots less than one acre and under 100 feet in width. In this case side yard setbacks are equal to 10% of the lot width, but no less than 5 feet. These setbacks are measured from above grade structures such as roof overhangs, or other structures and appurtenances, including heat pumps etc. Other setbacks can apply when critical areas are present such as streams, wetlands, steep slopes etc. Shorelines: The shoreline designation for the area is Urban. There are no appropriate structures to use the common-line for determining the shoreline setback. In this situation the shoreline setback required by the Mason County Resource Ordinance would the same or more restrictive than the setback under the County Shoreline Master Program, so the default setback would be determined by the Resource Ordinance. In this case since the common-line could not be used the standard 100-foot shoreline buffer would apply. This appears to have little or no effect on future rebuilding of the small mobile home on site. Per staffs measurements the mobile home is approximately 130-feet (horizontal) from the shoreline ordinary high water mark (OHWM), which exceeds the 100-foot buffer requirement. It appears that a replacement home could potentially be moved as much as 20-feet closer to the shoreline if necessary, while maintaining an adequate margin of error, as well as room to construct footings etc. while protecting the 100-foot shoreline buffer. Since the existing mobile home appears to have been sited many years or even decades ago, and there is no record of it being permitted through a Shoreline Permit process, the replacement and expansion of this structure would require review through a Shoreline Substantial Development permit process and it must meet the standards for Accessory Living Quarters as defined in the Shoreline Master Program (enclosed). Mason County Development Regulations also contain regulations for a second residential unit on a single property (see enclosed). The Development Regulations standards are somewhat more restrictive than the Shoreline Master Program requirements and must also be met. The primary issue in this case is that the Accessory Dwelling Unit or (ADU) cannot exceed 50% of the square footage of the habitable area of the primary residence or 900 square feet, whichever is smaller. Based upon rough measurements taken on site, it appears that the proposed 880 square foot ADU would need to be sized slightly smaller to meet 1/29/2004 2 of 3 SP12004-00006 Site Inspection 1/29/2004 Case No.: SP12004-00006 this requirement. Compliance and consistency with both the policies and regulations of the Shoreline Master Program and County Development Regulations would be reviewed through the Shoreline Substantial Development permit process. This process normally takes a minimum of 2 - 3 months prior to permit issuance once the shoreline permit application is complete. Slopes: Due to slopes in excess of 15% adjacent to or within 300 feet of the project a Geological Assessment at minimum will need to be done to address slope stability and the other requirements of the enclosed landslide hazard chapter 17.01.100 section E. 4. The report must state that the hazards of the landslide area can be overcome in such a manner as to prevent harm to property and public health and safety, and must also assure the project will cause no significant environmental impact. See Mason County Code 17.01.100, E7. The Geological Assessment should also address placement or alterations of the on-site septic system in relation to slopes, and provide recommendations if necessary. Based upon the findings of a Geological Assessment a Geotechnical Report may be needed to more specifically address slope and landslide related issues. Normally a Geotechnical Report is required for development within 300-feet of slopes over 40%, such as this, however section 17.01.100 E.2. allows for the possibility of waiving this requirement based upon the findings of a Geological Assessment. Please review your Geological Assessment prior to submission to ensure that it contains the information required in section E. 4. of the enclosed ordinance. Refer to section E. 5 for Geotechnical Report requirements. Missing information will result in further delays in the review process. You may want to provide a copy of these requirements to your licensed engineer or geologist. If any grading / excavation is proposed in or near slopes a grading plan will be needed to show any proposed topographical changes, cuts, retaining walls etc. No other critical areas were identified on site.
