PO Box 73399, Puyallup, WA 98373 Phone: (800)444-2371 Fax: (253) 848-2545 INTRODUCTION This manual will familiarize NIBBLER system owners with the basic system operation and to help them recognize potential problems at their onset. It will not replace the services of an approved management company. Rather it demonstrates the need for routine monitoring and maintenance by a profession trained in NIBBLER systems. Specific information such as wiring diagrams and calibration sheets attached to this manual should be set aside for future reference. As a condition of approval as an.alternative sewage treatment device,the owner of each facility with a NIBBLER system must enter into a monitoring and maintenance agreement with a management entity acceptable to both manufacturer and the permit issuing agency. The management entity will perform regular inspections of the NIBBLER system including laboratory analysis of effluent samples and physical inspections of the unit and the facility as required. They will perform or oversee all maintenance of the NIBBLER system and will be responsible for keeping the manufacturer,the facility owner and the health agency fully informed as to the performance and maintenance of the system. The NIBBLER process is a secondary sewage treatment system designed specifically for use where high waste strength is a problem. Laboratory tests have proven it capable of reducing waste strength to typical household septic tank effluent levels before it is discharged. The system consists of a either a septic tank(for the black water) and a grease trap(for ® the grey water)or a grease trap for the combined waste flows from the facility, followed by a surge tank, one or more NIBBLER treatment units, and finally a clarifier. Each of the components will be described in general terms,with the focus of intent and maintenance needs. Septic Tank: When flows are separated within the facility,this tank receives the black water waste, � usually identified as the toilet and urinal flows. It functions as in a residen tial situation to quiet flows and provide primary settling and limited microbial action. As in a residential situation,the tank will need pumping when the scum (floating matter) and sludge(settled out matter) accumulations become too great. The performance of this tank maybe monitored by the maintenance professional during their inspections if included in the contract. When needed,they will notify you to have the tank pumped by a licensed pumper. Grease Trap: More aptly called a tank,this unit receives the gray water waste (sink, shower, laundry, all non-black water wastes). In cases were the waste flow from the food prepsinks, ) facility is not separated into black and grey,but combined, a grease trap is installed. It functions much like a septic tank,but is configured differently to allow for more accumulation of fats, oils, and greases. It too will accumulate sludge and scum, but at a much faster rate. The tank's performance and accumulations will be monitored by the maintenance professional who will assist you in making arrangements for pumping when necessary.. Depending on the a of accumulations and local conditions,the waste may � P g type be pumped by a render or a septic pumper. I� Page 2 ',I Q Surge Tank: This is the first unit containing a mechanical device, a pump. Flows from the grease trap and possibly the septic tank(called effluent) enter this tank. No treatment occurs. The surge tank is essentially a holding vessel. It takes the peak high volume flows and retains them sending out a constant lower volume flow to the rest of the system. The pump accomplishes this by operating on a timed basis. The control panel for the pump is usually located outside near the NIBBLER system or in the blower house. The panel is described later but includes a timer set to a predetermined number of minutes of off or idle time followed by a number of minutes of pump on time. With sufficient volume in the surge tank,the pump will continue this cycle (typically running for a brief period every half hour)of sending regular doses through the system unit the liquid in the tank is gone. During the maintenance professional's visits,they examine the tank and operate the pump. NIBBLER Tank: The majority of the treatment takes place at this point. The tank, essentially a one compartment septic tank, contains a series of pods, square baskets with plastic balls inside. Waste from the surge tank is pumped in to each NIBBLER tank and sprayed into the tank though two orifices located on the inlet pipe above the liquid level in the tank. Each pod has tubing which allows air to bubble bellow the liquid level, around the balls. This creates a frothing,mixing action around the media with highly oxygenated waste. The micro-organisms grow principally around and on these balls digesting the waste matter in the liquid. When the pump comes on and sprays in a known amount,the liquid level rises in the tank, and the same amount flows out of the discharge pipe to the clarifier. Liquid is constantly moving with the tank environment. Gases are generated, collect in the venting system and are discharged as discussed later. Regular monitoring of the NIBBLER tank by the professional includes: • Visual inspection of the tank and components for problems • Visual inspection of the liquid for clarity • Visual inspection of the interior action for foaming,plugged orifices,plugged discharge lines, • Testing of effluent and liquid within the tank for various parameters. • Determine flow volumes treated(GPD). Maintenance of the NIBBLER tank includes: • pumping of sludge accumulations as needed • cleaning of pods as needed. Inspection of monitoring of the operation of this tank is one of the principal tasks of the maintenance professional. If this part of the systems is not operating as designed treatment suffers. Clarifier Tank: Discharge from the NIBBLER units enters this tank. This is the only other component in the NIBBLER system to include a pump. The tank is similar to a two compartment septic tank,but with the small compartment first, and the access between the two compartments near the bottom of the tank. Essentially the tank assists in changing the Q oxygen content of the liquid allowing for a die off of higher life-forms. It also allows for the settling of solids discharged from the NIBBLER units through settling. The pump, operated either by a timer or on a manual basis, pumps this collected solid material to back to the grease trap. Inspection of this unit is performed by the maintenance professional and includes testing the pump, checking for sludge accumulation, and tank Page 3 integrity. Effluent from the clarifier is discharged to the next unit, usually a pump tank, drainfield, or sewer line. SAFETY/PUBLIC HEALTH CONSIDERATIONS Before monitoring,maintaining, or working around the NIBBLER system you need to must be aware of the potential health hazards. Appropriate sanitary precautions, including the use of disposable gloves,must be practiced at all times when handling any type of wastewater. Disposal of wastes from the sewage system must be handled by a licensed pumper. Finally,while there are a limited amount of electrical components within the NIBBLER system, they are powered by high voltage and represent a shock hazard. The normal electrical precautions for electrical devices must be observed. Electrical System: The only units requiring power are the pumps in the surge tank and clarifier tank, and the blower units for the ventilation system. The main electrical connections should be inside the building in the main power panel. Electrical panel circuit breakers should be clearly labeled, especially the circuit breakers for the regenerative blowers (fans) and each pump. Power from the building or for the sewage system enters a panel for the pumps and blowers. The pump panel may be outside or in the blower building. It includes at least one alarm light(red)that activates when the surge tank is 90%full. It may also include a 50%full warning light(amber). The 90%alarm is connected to a audible alarm. While these alarms are usually on the exterior of the power box,there may also be remote lights and ® alarms in the facility. The amber light is a warning of a possible impending problem. The red light is a true indication of a problem. The horn may be silenced usually by pushing the light on the pane. The light will remain lit. When the lights go on: When either light goes on flows are entering the tank faster than they are leaving. The situation may be temporary and self-correctable or indication of a problem needing immediate attention. Consider the following: Temporary, self correctable problems • Has there been a recent increase in sewage flows, either a swift increase in business, and increase in facility use, or a temporary high use of water within the facility? This is temporary in nature,not a permanent change. • Are there leaking fixtures in the facility? Check all toilets, and sinks. • Have water using devices been serviced recently? Refrigeration equipment and air conditioners may discharge into the sewer system. • Has there been a temporary loss of power? Power has now been restored. • Only the amber light has come on. Permanent problem needing attention • This is not the first time the alarms have gone off. Either the amber light has come on and gone off in the past with no apparent reason noted above, or the amber and red lights have come on and gone off. • The amber light came on, there was no attributable reason(high water use power failure) and now the red light and alarm came on. The situation continues. • This seems to be a reoccurring situation. The amber light comes on then the red light, Q then they go off later in the week and then return. • The alarms lights come on after or during a heavy rainfall. Page 4 Q In either of the two instances,reflect on what has been happening in the recent past. If the alarm is sounding, find the panel and silence the alarm by pushing the red button. If the incident falls in the temporary category, continue to watch the situation, if it appears to be permanent, contact the management entity. In either case the management entity needs to be told of what happened,when, under what circumstances, and if this is a repeating problem. Contact them now or tell them during the next inspection depending on where the problem is temporary or not. The maintenance professional may advise checking the circuit breakers or manually operating the pump. There may be two sets of breakers. The primary ones are associated with the facility and located in the common breaker panel. Open this panel and look for evidence of tripped breakers. Breakers may be reset but watch for a reoccurrence of the problem. The next breaker is located in the pump panel. If tripped, it too can be reset and watched for a problem. The pump should not be manually operated without the approval of the maintenance entity. To operate the pumps manually, again locate the control panel. Inside is a switch marked "Auto Off Manual" The switch should be currently in the auto (up)position, if it isn't contact the maintenance entity immediately. Record the two meter readings(one records the number of hours,the other cycles). Switch the toggle switch to the manual (down)position. Notify the management entity. The pump cannot be left in this position indefinitely. When returned to the auto (up)position again record the meter readings and forward the information to the management entity. What's causing the problem? ® The simple answer is that more flow has entered the system than pump out. Possible reasons include: • Pump failure(the pump is not coming on). • High flows (may be a temporary situation or and indication of the need for more capacity). • Orifices in the NIBBLER tanks are plugged(as the orifices plug,the flow decreases. Maintenance is needed). • Power failure and return(situation corrects it self) o Electrical problems. • Float problems (floats, inside the surge tank,tell the timer when to begin operation). • Timer problems (timer is located within the electrical panel). Most of these problems must be resolved by the maintenance professional Ventilation System: Air is a vital component to the NIBBLER system. Blowers, housed in a waterproof enclosure feed air to the pods in the NIBBLER tank. In response exhaust gases are p P t generated which must be vented from the system. If the blowers stop, or the air intakes become restricted, air is cut off or reduced to the pods,which causes organisms to die off ti in the tanks, and treatment ability plummets. If exhaust gases are not properly vented, odors will accumulate around the system raising complaints. Generally the system consists of one or more blowers feeding the NIBBLER tanks through a common air lines. These blowers run constantly. Exhaust gases are collected from each of these tanks combined and sent up a ventilation stack. Odors from out of the vent stack of a properly operating system will be mild and inoffensive. Some of the Omore common problems with there sources include: Page 5 Q • Foaming from the vent stack. Minor amounts of white foam may come out of the vent stack occasionally. This is more prevalent during the first month of operation and considered normal. If foam presence is more common, or is discolored, contact the maintenance entity. Y a system. Yellow foam usually indicates stem overload. White �I foam may mean the system is starving for food. High sudsing cleaners or detergents are not recommended. Such additives may be the source of the foam. • Foam around the tank access lids. While limited amounts of white foam are normal, it should never be found come out of the access lids. Contact the maintenance entity. Again foam can be the result of using high sudsing detergents or a loss of food to the II' t um failure). NIBBLER units (usually due o pump ) • Bubbling around the tank lids. If bubbles are escaping,then the lids are no longer gas-tight. Odors, and system inefficiency can result. Have the maintenance professional check during the next inspection. • Occasional odors. The area with the vent stack may experience air inversions where gases leaving the vent stack are forced down to ground level. Discuss the situation with the maintenance professional during their next visit. It may be necessary to raise,relocate, or modify the configuration of the stack. • Offensive odors. If the system is being overloaded, or excessive cleaners and disinfectants are being use,the odors may become objectionable. Contact your maintenance entity. A thorough inspection of the system may be necessary. Other Items to Look For: Under normal conditions,there should be no objectionable odors, no surfacing of sewage, or alarm conditions. Between inspections by the monitoring entity the following should be checked: Q • Check for uneven vegetative growth or evidence of surfacing effluent on or around the tanks and drainfleld area. It is necessary to keep the height of the vegetation low for easy access to the lids on the system. Lush vegetation in the area should be pointed out to the maintenance professional during their next visit. It is not necessarily a cause for concern. Surfacing effluent from any of the components is a cause for immediate concern. Contact the maintenance entity immediately. • Check for signs of vandalism,tampering, or rodent problems with the system. Both for system efficiency and due to the safety, only knowledgeable individuals should be accessing the system components. Damage must be repaired. • Check to see that the blower or blowers are still working. Walking near them,you should hear the blower and notice the air intake. If the sound has changed,the intake may be plugging and in need of cleaning. If there is no sound,the blower is broken. Call the maintenance entity immediately. Check to see that the air is being sucked into the air intake. When a blower is stopped and then restarted, as when power is resumed after an outage, it may run in reverse, drawing gases from the NIBBLER units and discharging through the intake. In such instances, contact the maintenance entity for instructions. Page 6 Each NIBBLER system is as individual as the facility which it serves. The products you and your staff use, and certain practices within your business will affect the performance of the organisms working in your NIBBLER system. The following additives and practices will impact the system. o Cleaning products (Vent cleaner, disinfectant, floor cleaner, dishwashing products, drain cleaners) -The disposal of excessive amounts of cleaning products will kill the micro-organisms working in your system. o Garbage grinders -everything put down the drain collects or is digested in your system. The less put down,the longer it will last. o Running water-Your system is designed to treat and dispose of a specific number of gallons per day. Keeping the flow through the system below the design flow will increase the life of your system. Leaking plumbing fixtures, faucets left on, excessive use of water(thawing out a frozen product under running water) all add to the demand on the system. For example in one case a leaking toilet discharged 5000 gallons to a system in 48 hours. Excessive peaks in the flow may damage the system. To minimize noise and vibrations, the unit should be mounted on a solid surface that will not resonate sound. The use of shock mounts or other vibration isolation materials is recommended. Units should not be installed where ambient temperature exceeds 40' C without consulting your Gast representative. Proper filtration of par- ticulates and moisture is required. These filters are available through your Gast distributor. When installing pipe fittings be sure to use a small amount of pipe thread lubricant, so as not to damage pipe threads in the aluminum pump housing. The threaded blower pipe ports are designed as connection ports only and are not designed to support lengthy pieces of pipe. Be sure to use the same size pipe in your plumbing from the blower to prevent overheating. Hazard Prevention To prevent an explosive hazard, do not pump combustible liquids, vapors or gases with the regenerative blower. These catalog units are to be used for pumping air only. To prevent injury, do not operate these blowers in excess of 3600 RPM. Direction of Rotation The regenerative blower should rotate clockwise as viewed from the electric motor side and is marked with an arrow, showing the correct rotation. By checking the air flow at the in and out ports, proper rotation can be confirmed. The three phase unit's rotation can be reversed by changing the connections of the two power lines. The single phase unit if wired properly can only rotate in one direction. Electrical Connections Check to see that the supply system voltage and frequency are the same as that required of the regenerative blower motor. Double check wiring to the wiring diagram before connecting power. Continuous Use Models R1, R2, R3 and R4 can be run continuously with zero flow through the unit. Some temporary loss of maximum duty may be lost when unit is opened back up. Refer to catalog curves for air flow required at maximum pressure/vacuum on models R5 - R8. Operating blowers R5 and larger with insufficient air flow will result in damage to blower as a result of excessive heat. If it is desired to reduce the air flow below this value during continuous operation, a by- pass hole should be provided in the middle of the pipe as in the illustration. Use of a pressure relief valve (AG258) or vacuum relief valve (AG258A) will make the full flow of the blower available to the system when the relief valve is closed. When it is adjusted it will relieve the system of excessive pressure. For best operation of relief valve it is important to have adjusting screw and nut pointing down. VACUUM PRESSURE .J .=--41-o General Maintenance Lubrication of the bearings is not necessary as all bearings are sealed or shielded and greased for long life. Dirt and dust should be kept off the unit, to prevent abnormal temperature rise and loss of performance. Always keep filter cartridges clean for the least amount of inlet air restriction. Build up of particulates in the filter can be monitored by placing a Gast vacuum gauge (AJ497) between the filter and the blower. When an increase of 10" H2O is realized the filter will need to be cleaned or the element replaced. Should your blower require anything more than inspection and simple cleaning, it is suggested you send the entire unit to an authorized Gast Service Center. Setting critical internal clearances requires special tooling and experience and under normal cir- cumstances should not be attempted in the field. It is also highly recommended a pressure or vacuum gauge be used to monitor the blower's performance. Responsible personnel should be familiarized with NEMA MG2: Safety Standards for Construction and Guide for Selection, Installation and Use of Electric Motors and Generators; National Electric Code and all local safety requirements. When servicing, all power sources to the motor and'to the accessory devices should be de- energized and disconnected and all rotating parts should be at a standstill. Stuth Company, Inc. is the developer and owner/lessor of the Nibblers patented process as defined in the Lease/License Agreement. C. Health Dept. is defined as Mason County Beal th nenr_ D. The Nibblers" system is defined in this agreement as being and/or including: the patented Nibblers defined in the Lease/License Agreement as well as the concrete vault(s) containing the patented process, the fan housing,vent stack, surge tank,clarifier and control panel. As defined herein the other components of the treatment/disposal system such as grease traps, septic tanks and drainfields (ex: mounds, sand filters,pressure distribution etc.) are not part of the Nibbler system. E. As conditions for approving this System, the Developer and/or Health Department may require (among other things),that the Owner(1) file a covenant running with the land regarding the use and maintenance of the System, and (2) provide a management agreement which is acceptable to the Health Dept. This document is that management agreement. F. This Agreement details the responsibilities of the Manager, which include: (1) periodically monitoring the System once it is in use; (2) notifying the Developer(Stuth Company, Inc.), the Owner and the Health Dept. of any excessive sewage flowrates or waste strength levels; (3) making recommendations to the Owner, subject to Health Dept. modification, for correcting any excessive sewage flowrates or waste strength levels and for maintaining and repairing the System when indicated; (4) confirming that corrections,maintenance and repairs are satisfactorily accomplished by the Owner, and(5) maintaining permanent files of supporting records and preparing periodic reports to the Owner,the Health Dept. and the Developer. The Manager is to have on its staff a Health Dept.certified sewage disposal system designer. G. The Nibbler was sized for this site based upon projected flows estimated at * i hnn gallons per day (GPD -US gallons) and BOD5 not over* 487 mg/L or 6.5 lbs. per day. DEFINITIONS Commonly used indicators of wastewater strength are: BOD5: Biochemical Oxygen Demand-5 day test, a procedure that measures the rate at which microorganisms use the oxygen in wastewater while stabilizing decomposable organic matter under aerobic conditions. TSS: Total Suspended Solids, a measurement of solids that either float on the surface of, or are in suspension in, wastewater and which are measurable by laboratory filtering. O&G: Oils &Grease, a measurement of the grease and oil levels in wastewater. pH: A measurement to determine acidity or alkalinity. PPD: Pounds Per Day, the average biological loading over a 24 hour period and is measured by the following calculation: Flow x BOD x 0.00000834=Total PPD of BOD SECTION ONE MANAGEMENT OF THE NIBBLERTM SYSTEM 1.1 FREQUENCY OF MONITORING. 1.1.1. Upon the first use of the System, the Manager shall monitor the System at the following intervals: FIRST YEAR: First Six Months Monthly site inspections with effluent waste strength evaluations. (6 trips including lab tests) Seventh- Twelfth Months Quarterly site inspections with waste strength evaluations. (2 trips including lab tests) SECOND YEAR AND SUBSEQUENT YEARS: Quarterly site inspections with effluent waste strength evaluations. (4 trips including lab tests) Agreement for Management Services-Nibbler'" Page 2 of 10 Rev 10/95 1.1.2. If, at any time, waste strength and/or flowrate exceed acceptable levels (designed rates), the frequency of site inspections and waste strength analyses may revert back to the previous,more frequent monitoring schedule and may remain at that frequency until desired waste strength and flowrates are restored. 1.1.3. The reduction of monitoring frequency as provided for in the above schedule will be followed only so long as waste strength and flowrates do not exceed their designed rates. No reduction in monitoring frequency will take place should waste strength and/or flowrate levels exceed the designed rate. 1.2 TIMELINESS OF NOTIFICATION. 1.2.1. The Manager will specify whether a problem requires "routine" or"emergency" remedial action. The timeliness of the Manager's notification is determined by this classification. Managers request to give "Notice" or"Notify" as used herein in reference to notice given by Manager shall mean notice both orally and/or in writing to the Owner, the Health Dept. and the Developer. 1.2.2. Upon inspection of the System, if the Manager discovers excessive flowrates or waste strength and/or any other deficiency in the System's functioning as described in the following sections which require routine remedial action,then the Manager will (1) promptly give notice of such finding, and(2) conduct and complete an investigation as to the apparent cause of excess or deficiency and shall report to the notified persons the apparent cause of the excess or deficiency along with recommendations for alleviating the problem. 1.2.3. Upon inspection of the System, if the Manager discovers any condition which requires emergency remedial action, then the Manager will immediately give notice of such finding, and shall describe in detail the scope of emergency repairs needed and/or performed. 1.2.4. Upon notification from the Owner that emergency repairs or maintenance have been completed,the Manager shall confirm that such repairs are made and give notice as required immediately upon confirmation. 1.3 TIMELINESS OF OWNER'S RESPONSE. 1.3.1. The Owner agrees to take effective steps to alleviate any excess average daily flowrates and/or excessive waste strength and/or any other"routine" repairs or maintenance promptly upon the Managers written or oral recommendations whichever is first received and will notify Manager as soon as such remedial action has been completed. The Owner agrees to take effective steps to cause any "emergency"repairs or maintenance to be made immediately upon receipt of notification from the Manager of determination that emergency maintenance or repairs to the System are needed and will notify Manager as soon as such remedial action has been completed. 1.4 FLOWRATE MONITORING AND CONTROL. 1.4.1. During each scheduled inspection, the Manager will (1) take data readings from the cycle counter which is installed between the surge tank and the Nibbler(2) from such readings,calculate the average daily flowrate of sewage entering the Nibbler since the date of the last previous inspection. 1.4.2. Should the average daily flowrate exceed the Nibbler gallon per day design rate (* 1600 GPD -U S gallons), the Manager will give notice of the apparent cause of the excessive flowrates along with recommendations for alleviating the excess. Depending upon the degree of excessive flowrate,the Manager may also recommend more frequent monitoring until such time as flows return to the designed rate. *Refer to Attachment A. 1.4.3. The Owner agrees to take effective steps to alleviate any excess average daily flowrates in a timely manner as defined in Section 1.3. 1.4.4. Upon subsequent inspections, if flowrate continues to exceed the designed rate, the Manager will again (1) give notice of such finding, and(2) further investigate the cause of such excess and report in writing as needed, the apparent cause along with recommendations for alleviating such excess. The Owner shall take effective steps to alleviate such excess flowrate and remonitoring shall then proceed at the appropriate frequency. 1.5 WASTE STRENGTH MONITORING AND CONTROL. 1.5.1. During each scheduled inspection, the Manager will(1) collect a sample of the wastewater exiting the Nibbler and(2) check the effluent sample for temperature,Dissolved Oxygen and pH levels and, when indicated, (3) conduct (or cause to be conducted) laboratory analyses of such samples to determine the samples' levels of Biochemical Oxygen Demand (BOD5),Total Suspended Solids (TSS), and Oil &Grease (O&G). 1.5.2. Should the waste strength of the sampled effluent(exiting the Nibbler) exceed Allowable Waste Strength(Allowable Waste Strength is defined as having BOD5 = 200 mg/L,TSS = 125 mg/L,O&G = 25 mg/L), then the Manager shall (1) give notice of such finding, and (2) conduct and complete an investigation in a timely manner as defined in Section 1.2 as to the apparent cause of the excess waste strength and shall give notice of the apparent cause of the excess along with recommendations for alleviating the excess. The Owner agrees to take effective steps to alleviate any excess waste strength in a timely manner as defined in Section 1.3 and upon completion of such remedial actions will notify the Manager. 1.5.4. Upon subsequent inspections, if any of the waste strength parameters continue to exceed the designed rate, the Manager will again (1) give notice of such finding, and (2) further investigate the cause of such excess and report in writing as needed of the apparent cause along with recommendations for alleviating such excess. The Owner shall take effective steps to alleviate such excess waste strength and remonitoring shall then proceed at the appropriate frequency. 1.6 INSPECTION, MAINTENANCE AND REPAIR OF THE NIBBLERTM SYSTEM. 1.6.1. During each scheduled inspection, the Manager shall inspect the Nibbler system which will include: (1) checking the air intake filter to determine whether it needs to be cleaned, (2) checking the exhaust vent for foaming, (3) checking the air pumps and noting their velocity, (4) checking the extent and color of foam in tank, (5) checking the sludge levels in the Nibbler tank and related tanks, and(6) checking the outlet filter for clogging. 1.6.2. If routine repairs are indicated, the Manager shall give notice of such determination in a timely manner as defined in Section 1.2. The Owner agrees to take effective steps to cause such repairs to be made in a timely manner as defined in Section 1.3. The Manager shall confirm that such repairs are made and give notice as required immediately upon confirmation. 1.6.3. If emergency repairs are indicated,the Manager shall immediately give notice of such determination in a timely manner as defined in Section 1.2. The Owner agrees to take effective steps to cause such repairs to be made in a timely manner as defined in Section 1.3 and to notify the Manager immediately upon completion of such remedial actions. The Manager shall confirm that such repairs are made and give notice as required immediately upon confirmation. If Manager is unable to notify Owner of an immediate emergency, Manager is authorized to take all steps necessary to effect repairs at Owner's expense. 1.7 COST OF MONITORING. 1.7.1 The cost of basic scheduled monitoring (as detailed in paragraph 1.1.1.) will be billed at the hourly and service rates in effect at the time service is rendered. The estimated cost of basic scheduled monitoring (as detailed in ara aph 1.1.1.) will be approximately $ 415000 for the first year of service,$ for the second and subsequent years of service. Estimated costs are based upon the accessibility of the monitoring stations. Owner is responsible for maintaining access to all monitoring stations. Agreement for Management Services-Nibblef1m Page 5 of 10 Rev 10/95 Additional time to access monitoring stations, if required, will be billed at hourly rates in effect at time of service. Current rate sheets will be provided and all materials will be billed at the standard resale price. 1.7.2 Additional and/or emergency monitoring and/or maintenance will be billed at rates in effect at time of service. Current rate sheets will be provided. 1.8 TERMS OF PAYMENT. 1.8.1 The Owner shall pay Manager in full upon receipt of each billing, however, such payment shall be made no later than thirty (30) days after billing date. Overdue balances shall be charged an additional 1.5% per month, compounded monthly. SECTION TWO PUMPING OF NIBBLERTM TANK 2.1 OBSERVATION AND CONTROL OF NIBBLERTM PUMP-OUT OPERATIONS. 2.1.1. During each scheduled inspection, the Manager shall check for indications that the Nibbler and/or related tanks require pumping. If pumping is indicated, the Manager will notify the Owner as to the urgency of said requirement in accordance with Section 1.2. 2.1.2. Upon notification from the Manager that pumping of the Nibbler tank is required, the Owner agrees to cause such pumping to be conducted in a timely manner as defined in Section 1.3 and to notify the Manager as soon as such pumping has been completed. SECTION THREE GENERAL PROVISIONS 3.1 MANAGER'S OBLIGATION TO SAFEGUARD THE PUBLIC HEALTH ; RECORD KEEPING AND ANNUAL REPORTS; HEALTH DEPARTYIENTS RIGHT TO REVIEW MANAGER'S RECORDS. 3.1.1. In addition to the Manager's duties to the Owner, the Manager has an obligation to safeguard the public health in the performance of its duties hereunder and is to perform its duties thereunder in a comprehensive manner so as to assure that the Nibbler system is properly operated,maintained and repaired so as to protect the public health. 3.1.2. The Manager shall keep a permanent log of all field notes relating to sewage flowrate monitoring, waste strength monitoring,inspection of the Nibbler system, Agreement for Management Services-Nibbleflm Page 6 of 10 Rev 10/95 investigations as to the causes of any excess sewage flowrates or waste strength levels, Nibbler system observations, and confirmation of correction of deficiencies and completion of repairs. The Manager shall also keep a permanent file of originals or copies of all calculations,laboratory test results, notices,letters, memoranda and other communications, both to and from the Manager,relating to its duties under this Agreement. 3.1.3. Upon 10 days notice from the Health Dept. to the Owner and Manager, the Health Dept. shall be entitled to review, at the Manager's office, all of the records contemplated by Paragraph 3.1.2. 3.2 HEALTH DEPARTMENTS RIGHT TO MODIFY MANAGER'S RECOMMENDATIONS; OWNER'S DUTY TO NOTIFY HEALTH DEPARTMENT OF MANAGER VACANCY AND TO EMPLOY A QUALIFIED SUBSTITUTE MANAGER; OWNER'S RIGHT TO APPEAL HEALTH DEPARTMENT DIRECTIVES. 3.2.1. Any of the Manager s recommendations to the Owner contemplated herein are subject to modification by the Health Dept. 3.2.2. The Owner shall immediately notify the Health Dept. of and when the Manager is terminated or resigns. The Owner shall then immediately seek a qualified substitute manager as soon as is reasonably possible to keep the break in management services to a reasonable minimum. An entity selected to perform the monitoring and maintenance of the Nibbler system must be trained in the monitoring and maintenance of Nibbler systems and approved by the state and/or local environmental health regulating agencies as to its competency to perform in that capacity. 3.2.3. The Owner may appeal Health Department decisions or final orders regarding the System through appropriate methods as provided for by the Health Department. 3.3 DISPUTE RESOLUTION. A. Resolution by the Parties. It is the objective of the parties to establish procedures to facilitate the informal and inexpensive resolution of any disputes arising under this contract by mutual cooperation and without resort to litigation. To accomplish this objective, the parties agree to follow the procedures set forth below if and when a dispute arises under this contract. The complaining party shall write a description of the alleged breach of contract and send it to the other party by certified mail. This letter shall explain the nature of the complaint and refer to the relevant sections of the contract upon which the complaint is based. The Agreement for Management Services-NibblerTM Page 7 of 10 Rev 10/95 complaining party shall also set forth a proposed solution to the problem including a specific time frame within which the parties must act. The party receiving the letter must respond in writing within ten (10) days with an explanation,including references to the relevant parts of the contract and response to the proposed resolution. Within ten(10) days of receipt of this response, the parties must meet and discuss options for resolving the dispute. The complaining party must initiate the scheduling of this resolution meeting. B. Mediation. A settlement conference must be held within thirty (30) days of an unsuccessful resolution meeting. The settlement conference will be held at the local office of Judicial Arbitration &Mediation Services, Inc. (JAMS). The complaining party must contact JAMS to schedule the conference. The parties may agree on a retired judge from the JAMS panel. If they are unable to agree,JAMS will provide a list of three available judges and each parry may strike one. The remaining judge will serve as the mediator at the settlement conference. C. Arbitration. If the dispute is not settled by other prescribed resolution formats, the parties agree to submit the dispute to JAMS for binding arbitration. The parties may agree on a retired judge from the JAMS panel. If they are unable to agree,JAMS will provide a list of three available judges and each party may strike one. The remaining judge will serve as the arbitrator at the settlement conference. If and when a demand for arbitration is made by either party, the parties agree to execute a Submission Agreement,provided by JAMS, setting forth the rights of the parties if the case is arbitrated and the rules and procedures to be followed at the arbitration hearing. The complaining party shall be liable for one-half(1/2) of the arbitration fees and the responding party or parties shall pay the remaining one-half(1/2). D. Expert Witnesses Limited. The parties specifically agree that on-site systems such as the one covered by the agreement-are unique and not understood by many engineers and others who would normally qualify as "expert witnesses." Accordingly, the parties specifically agree that resolution of any disputes involving this project shall be done by the arbitrator selecting one or more of the following people as expert witnesses whose testimony shall be deemed controlling. NOTE: Nibbler systems are ideally sized to receive no more than 6.5 PPD BOD and 1100 GPD per unit. Incorrect sizing can result in objectionable odors and/or added maintenance requirements. This chart demonstrates some acceptable ranges of biological & hydraulic loading compatibility. The variations are shown only to demonstrate the relationship between PPD & GPD in determining Pounds Per Day (PPD) of BOO loading.
