1. Call to Order—The Chairperson called the regular meeting to order at 9:03 a.m.
2. Pledge of Allegiance— Marilyn Vogler led the flag salute.
3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2 —Tim
Sheldon was absent; Commissioner District 3—Terri Jeffreys.
4. Correspondence and Organizational Business
4.1 Correspondence
4.1.1 The Department of Natural Resources sent a letter and revenue tables.
4.1.2 Public Employment relations commission sent a request for a list of employees.
4.1.3 Rusty Kidrick and Barbara Tarabochia sent letters regarding boating regulations.
4.1.4 The Bureau of Indian Affairs sent Notice of Reservation Proclamation request and a letter
regarding Title 25 and"In Trust"property.
4.1.5 Cmmr. Sheldon submitted a written statement regarding Agenda Item 9.1. Public Hearing
regarding ATVs on County Roads. (Copies of Cmmr. Sheldon's written statement were
available at the podium).
5. Open Forum for Citizen Input—
5.1 Joe Reiss (and Rick West) spoke about development at Jacobi Park. (needs briefing)
5.2 Monte Ritter spoke about an RCO grant for boating facilities. Monte also commented on the
ATVs for recreation. He also mentioned Prop 1 on the ballot regarding the MPD.
5.3 Gil Costen spoke regarding the community of Beards Cove. He said it's become a haven for
drugs. He said one house has had five overdose deaths. He spoke about derelict properties,
derelict vehicles, crime, drugs and multiple families living in one house. He is asking for help to
get this cleaned up. He stated that Ordinances are being violated. He thinks there should be a
leash law as well. Mr. Costen said he thinks the $75,000 spent by the Sheriff's office for boat
recently could have been better spent. He asked that the County clean up the rampant drug
problem that has been allowed to grow.
Cmmr. Neatherlin reminded Mr. Costen that they don't have the authority to tell the Sheriff what
he should do.
5.4 Neal Winders asked the Board for a briefing regarding the MPD.
6. Adoption of Agenda - Cmmr.Neatherlin/Jeffrey moved and seconded to adopt the agenda
as published. Motion carried unanimously. N-aye; S-Absent; J-aye.
7. Approval of Minutes—August 1, 2016 briefing minutes and July 19 &August 2, 2016 regular
meeting minutes
Cmmr. Neatherlin/Jeffreys moved and seconded to approve the August 1, 2016 briefing
minutes and July 19 &August 2, 2016 regular meeting minutes. Motion carried. N-aye;
S-Absent;J-aye.
8. Approval of Action Agenda:
8.1 Approval of the McLane Cove Shellfish Protection District plan as recommended by the
Shellfish District Plan work group.
8.2 Approval of the Veterans Assistance Fund applications for: Utilities $1,142.04 as
recommended by the Veterans Service Office.

8.3 Approval for the Board to set a public hearing for Tuesday, September 6, 2016 at 9:30 a.m.
to receive public comment on the Private Line Occupancy permit for a new utility crossing
under Triton Head Drive at 120 N. Triton Head Drive (parcel 22406-50-00011) for Edward
and Susan Bye Trust.
8.4 Approval of the agreement with Thyssenkrupp for courthouse elevator 5-year full load safety
testing for the amount of$12,280.00 plus tax. The elevator testing is required by
Washington State Labor and Industries under WAC 296-96 and RCW 70.87.
8.5 Approval of the agreement with the Mason Conservation District replacing the current
agreement and amendment for the Voluntary Stewardship Program (VSP) grant funded
through the Washington Conservation Commission. There is no cost impact to the County as
this contract is grant funded and the budget includes the salaries and benefits cost of County
staff who are administering the grant.

Motion carried. N-aye; S-Absent; 3-aye.
Cmmr Neatherlin/Jeffreys thanked Mr. Bolender and commented on the VSP.
Cmmr. Jeffreys thanked everyone for their hard work on item 8.1
9. 9:30 a.m. Public Hearings and Items Set for a Certain Time—
9.1 Public Hearing to consider amendments to Title 10 regarding ATVs on County roads.
Loretta Swanson acknowledged Dave Smith for his work on this. Loretta explained some of the
key requirements and standards. State Law only allows ATV on roads that are 35 mph or less. If
this ordinance passes, they will put all information on the website.
Public Testimony:
Ken Nelson commented on this item and he thinks this will be beneficial.
Gil Costen asked the Commission to enforce the regulations if they adopt this.

Cmmr. Neatherlin commented on this item. He is in support of this.
Cmmr. Jeffreys commented on this item. She is in support of this.
Cmmr. N eatherl in/Jeffreys moved and seconded to approve ordinance allowing wheeled
all terrain on county roads with the additional requirement that headlights are used at all
times. Motion carried. N-aye; S-Absent; 3-aye. Ordinance 49-16 (Exhibit A)
9.2 Public Hearing to consider adopting the 2015 State Building Code updates.
Dave Windom explained this item.
Questions:
Conley Watson asked if they have been referring customers the library and reminded Mr.
Windom that information is available there.
Gil Costen made a comment regarding tiny houses.

Public Testimony:
Marilyn Vogler said tiny houses are legal and are useful and she encourages the Board to
advocate for tiny homes. She is speaking as a member of the public.
Gil Costen spoke about Beards Cove and said he is fine with tiny homes as long as they are
maintained. He hopes the Board will adopt specific guidelines regarding visual impact.
Conley Watson spoke about plumbers.

Discussion:
The Board discussed the 2015 building code updates.
Cmmr. Neatherlin/Jeffreys moved and seconded to authorize by ordinance; the
mandated updates to the 2015 State Building Code into the Mason County Code Title
14 Building and Construction; under the authority of RCW 19.27.031. Motion carried.

10. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week
and announced their upcoming weekly meetings.
11. Other Business (Department Heads and Elected Officials) —
11.1 Cmmr. Jeffreys asked about a possible briefing with Friends of the Park.
Cmmr. Neatherlin said he is fine with a discussion although it will be only a discussion.
The Commissioners have agreed on having a briefing with friends of the park and the Clerk will
set this up.
11.2 Dave Windom spoke about the closure of pain clinics and the effects on Public Health.

ORDINANCE NO. -'-q 16
AN ORDINANCE AMENDING MASON COUNTY CODE CHAPTER 10 TO ALLOW THE
OPERATION OF WHE E LED ALL-TERRAIN VEHICLES,AS DESCRIBED IN RCW 46.09,
ON COUNTY MAINTAINED ROADS WITH POSTED SPEED LIMITS OF
35 MILES PER HOUR OR LESS
WHEREAS,Washington State's Engrossed Substitute House Bill(ESHB) 1632,passed by the
State of Washington during the 2013 21nd Special Session,and HB 1918,passed by the.State of
Washington in 2016,amended the Revised Code of Washington(RCW)46.09 "Off-Road,Non-
Highway,and Wheeled All-Terrain Vehicles,"allowing counties to regulate the operation of non-
highway vehicles on streets,roads,or highways;and
WHERE,A,on February 10,2015,during the Board of County Commissioners(BOCC)and
Public Works study session,the BOCC requested Public Works Department staff to work with the Mason
County's Sheriff's.Office to consider whether or not to allow non-highway vehicles to operate on county
maintained roads;and p'
WHEREAS,RCW 46.09,310(19)defines"wheeled all terrain vehicles"and classifies them as
non-highway vehicles;and
WHEREAS,RCW 46.09.455(1)describes authorized and prohibited uses of wheeled all-terrain
vehicles,which includes allowing them to be operated on public roadways having a speed limit of thirty-
five miles per hour or less;and
WHEREAS,RCW 46.09.455(1)(c)(i)requires that counties,with population of fifteen thousand
or more,who desire to allow the operation of wheeled all-terrain vehicles on county roadways,not
including non-highway roads and trails,must approve an ordinance to designate county roadways for said
usage;and
WHEREAS,RCW 46.09.455(1)(c)(iii)requires Mason County to list publicly;and make
accessible from the main page of the county web site,those public roadways that wheeled all-terrain
vehicles may operate upon;and
WHEREAS,Mason County's Sheriff's Office,the Public Works Departnnent,and interested
individuals met to discuss said usage on Mason County maintained roads;and
WHEREAS,Mason County has determined that the safety requirements for wheeled all-terrain
vehicles,as described in RCW 46.09,with the additional requirement that wheeled all-terrain vehicles
have headlights that are utilized at all times,provides for a level of safety similar to other street legal
vehicles that are allowed to travel on public roads;and
WHEREAS,Mason County has determined that allowing wheeled all-terrain vehicles,as
described in RCW 46.09,provides increased opportunities for a variety:of outdoor recreation activities in
Mason County;and
WHEREAS,Mason County has determined thatthe county should allow operation of wheeled
all-terrain vehicles,as described in RCW 46.09,with the additional requirement that wheeled all-terrain
vehicles have headlights that are utilized at all times,on county maintained roads that have posted speed
limits of 35 miles per hour or less;and

WHEREAS,the Mason County Board of County Commissioners held a public hearing at
Mason County Courthouse in Shelton to hear public comment on the proposed amendments to Mason
County Code Title 10; and
NOW,THEREFORE BE IT ORDAINED,that the Mason County Board of County
Commissioners,after due deliberation and in the best interest of the public,does hereby approve the
operation of wheeled all-terrain vehicles,as described in RCW 46.09,with the additional requirement that
wheeled all-terrain vehicles have headlights that are utilized at all times,on county maintained roads with
posted speed limits of 35 miles per hour or less.
BE IT FURTHER ORDAINED,that the Mason County Code be amended,and any and all
inconsistent resolutions and ordinances are hereby replaced by this ordinance to allow the operation of
wheeled all-terrain vehicles,as described in RCW 46.09,on county maintained roads with posted speed
limits of 35 miles per hour or less.
BE IT FURTHER ORDAINED,that all users of wheeled all-terrain vehicles on public
roadways and rights of way within Mason County shall strictly comply with the provisions of Chapter
49.09 RCW and any other provisions of the local,state and federal laws,codes or regulations..
BE IT FURTHER ORDAINED,that the Board of County Commissioners,by this ordinance,
adopts a new Chapter, 10.54,to Mason County Code regarding off-road vehicles and wheeled all-terrain
vehicles,as set forth in the attached Exhibit"A".
BE IT FURTHER ORDAINED,that the list of county maintained roads that are authorized for
operation of wheeled all-terrain vehicles be made accessible to the public from the main page of the
county web site.

Appendix 1- Roadways upon which wheeled all-terrain vehicles may be operated.
10.54.005 Applicability. This chapter shall apply to operation of off-road and wheeled
all-terrain vehicles on the county roads in Mason County, Washington.
10.54.010 Operation of off-road vehicles prohibited on county roads - Exceptions.
Except as otherwise provided in RCW 46.09, a person may not operate an off-road
vehicle, "ORV", as defined in RCW 46.04.365, on any county road within Mason
County. Off-road vehicles are authorized upon those county roads and segments of
county roads that meet the statutory criteria for primitive roads, or non-highway roads
and as provided in RCW 46.09.450(1)(a).
10.54.015 Operation of wheeled all-terrain vehicles prohibited on county roads -
Exceptions. Except as otherwise provided in Chapter 46.09 RCW, a person may not
operate a wheeled all-terrain vehicle, "WATV", as defined in RCW 46.09,310(19), on
any county road in Mason County. Wheeled all-terrain vehicles are authorizes upon
those county roads and segments of county roads designated in Appendix I as
approved for operation of wheeled all-terrain vehicles.
10.54.020 Compliance with RCW 46.09 required. A person may not operate an off-road
or wheeled all-terrain vehicle on any county roadway within Mason County except in
strict compliance with the provisions and requirements of RCW 46.09.
10.54,025 Speed limit for wheeled all-terrain vehicles. A person may not operate an off-
road or a wheeled all-terrain vehicle on a Mason County roadway at a speed exceeding
the lesser of 35 miles per hour or the posted speed limit.
10.54.030 Violations -Penalties.
(1) A person who violates sections 10.54.010, 10.54.015, and 10.54,025 of the
county code commits a traffic infraction.
(2) A person who violates section 10.54.020 shall be subject to the penalty for the
violation as provided in RCW 46.09.
10.54.035 Relation to other laws.
(1) Definitions contained in RCW 46.04 and 46.09 are adopted by this reference
and shall apply to this Chapter.
(2) Except as otherwise provided in RCW 46.09, nothing in this Chapter shall
exempt any operator or owner of a non-highway vehicle from any rule of the road,
traffic law or code, parking regulation, road use restriction, or road closure.
(3) Amendment of or addition to any part of the RCW 46.04 or 46.09 by the state
legislature shall be deemed to amend or add to Chapter 10.54 of the county code
or a part thereof, and it shall not be necessary for the board of county
commissioners to take any action with respect to such amendment or addition.
10.54.040 Disposition of traffic fines and forfeitures. Persons violating this chapter may
be subject to traffic infractions, misdemeanors, gross misdemeanors, and/or civil
penalties as governed by Washington State law prescribing the applicable punishment.
10.54.045 Severability. If any provision of this Chapter or its application to any person
or circumstance is held invalid, the remainder of this Chapter, or the application of the
provision to other persons or circumstances is not affected.

BUILDING AND CONSTRUCTION
ORDINANCE amending Title 14, Building and Construction, Sections 24,04, 14•o8. 14.14,
14.17,14.20,14•25,14.4o and 14.44 of the Mason County Code.
WHEREAS, RCW 19.27.031 provides that the State Building Code shall be in effect in all
counties; and
WHEREAS,the State Building Code has been recently updated by the State to include the
2015 version of the International Codes which become effective July 1, 2o16; and
WHEREAS,the Mason County Board of Commissioners desires to maintain Title 14 of the
Mason County Code to be consistent with the current State Building Code; and
WHEREAS,the Commissioner understands the need for current building codes addressing
new and innovative methods for providing energy conservation as well as fire and life
safety;and
WHEREAS,Title 14 establishes the minimum requirements to safeguard life and property
from fire and explosion hazards arising from the storage handling and use of hazardous
substances,materials, and devices, and from conditions hazardous to life or property in the
occupancy of buildings and premises as well as provide safety to fire fighters and
emergency responders,and
WHEREAS, Title 14 establishes minimum requirements to safeguard the public health,
safety and general welfare by providing the standards for adequate light and ventilation,
energy conservation, supplied utilities and facilities and other physical aspects and
conditions essential to ensure that structures are safe, sanitary and fit for occupation and
use; and
WHEREAS, Title 14 assists the local fire district in obtaining a higher insurance rating to
lower the insurance rates of the occupancies they serve by requiring safety inspections for
new and existing occupancies; and
WHEREAS, Title 14 establishes and clarifies minimum requirements for fire flow and
hydrant placement to provide water for local fire districts to fight fire based on the limited
municipal water resources or alternative methods to mitigate those flow; and

WHEREAS,Tide 14 provides standards for fire vehicle access and structure identification to
assure that the local fire districts may serve the citizens of Mason County in a timely and
safe manner; and
WHEREAS,Title 14 allows for certain structures to be exempt from the permitting process
based on size and use of the structure; and
WHEREAS, the amendments are necessary to make consistent with and clarify the
County's current permitting procedures and business practices;and
WHEREAS, the State of Washington has ordained in Washington Administrative Code,
Chapter s1 that the 2o15 Edition of the State Building Code shall become effective in all
counties and cities of the state on JUIy 1 2o16;and
WHEREAS, Title 14 is consistent with the State Building Code as required in the Revised
Code of Washington Chapter 19.27; and
WHEREAS, the Board of County Commissioners conducted a public hearing regarding
Mason County Title 14 on. t-L-4C , 2o16;and
WHEREAS, these amendments are necessary for the preservation of the public health,
safety and general welfare of Mason County's residents.
BE IT HEREBY ORDAINED, the Mason County Board of Commissioners hereby approves
and ADOPTS revisions to Title 14 as submitted and described in ATTACHMENT A.

and Mechanical Officials (IAPMO), including Appendices A, B, and I excluding Section
102.3 (Board of Appeals) and Chapters 12 and 15. Provided further, that those
requirements of the Uniform Plumbing Code relating to venting and combustion air of
fuel fired appliances as found in Chapter 5 and those portions of the code addressing
building sewers are not adopted, and adopting the Washington State Building Code
WAC 51-56.
(f) Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, published by
the International Conference of Building Officials.
(g) The 2o15 Edition of the International Energy Conservation Code as amended in WAC
51-11R (Residential)and 51-11C(Commercial).
Chapter 14.08-BUILDING CODE AMENDMENTS .
14.o8.oso- General.
2015 International Building Code (IBC) and 2015 International Residential Code (IRC) are
hereby amended.The amended sections shall supersede that section or table as numbered
in said Building Code of Mason County. The amended sections are as follows [in this
chapter].
Chapter 14.14 - MINIMUM QUALIFICATION REQUIREMENTS FOR FIRE CODE
INSPECTION
14.14.010 - Minimum qualification requirements for International Fire Code (IFC)
inspection.
(a) Fire districts in Mason County who choose to do fire safety inspections using the
adopted fire code shall have qualified inspectors to do the inspections. Qualified
inspectors shall have a current certification in either the International Fire Service
Accrediation Congress (IFSAC) Fire Code Inspector Certification, or the International
Code Council (ICC)-Fire Inspector I Certification, and evaluation/approval by the Mason
County fire marshal.
(b) For the purpose of this chapter, a fire safety inspection is defined as any on-site visit to
a commercial occupancy for the purpose or effect of identifying compliance or
noncompliance of the fire code not directly related, or as a result, of a fire incident.
(c) Fire safety inspections done by fire districts that are forwarded to the fire marshals
office for compliance shall be done so in writing in a format provided and/or approved
by the county.
Chapter 14.17-STANDARDS FOR FIRE APPARATUS ACCESS ROADS
14.17.140- Bridges.
Where a bridge or an elevated surface is part of a fire apparatus access road, the bridge
shall be constructed and maintained in accordance with AASHTO HB-17. Bridges and
elevated surfaces shall be designed for a live load sufficient to carry the imposed load of fire
apparatus. An evaluation by a professional engineer will be required to determine the
imposed load rating for responding fire district fire apparatus and shall be approved by the
fire district and fire marshal. Weight load Limit signs shall be posted at both entrances to
bridges when required by the fire marshal in accordance with Section 503.2.6 of the 2015
International Fire Code.
Bridges or elevated surfaces legally in existence prior to this code shall suffice as access if
such bridge was built in accordance with the building standards in effect at the time the
bridge was constructed.When the fire marshal determines a bridge to be unsafe to support
fire district apparatus the structure and all supporting members shall be evaluated by a
professional engineer to verify that the bridge is able to support apparatus loads.After the
engineer evaluation weight load limit signs shall be posted at both entrances to the existing
bridge in accordance with Section 503.2.6 of the 2015 International Fire Code.

14.17.150-Additional fire protection.
When access roads cannot be installed to these standard's due to topography, waterways,,
nonnegotiable grades or other similar conditions, the fire marshal is authorized to require
additional fire protection or mitigation as specified in Section 901.4.4 of the 2015 IFC. The
fire marshal may also approve access roads which do not meet these requirements if the
road provides reasonable access underthe individual facts of the case.
Chapter 14.20-MANUFACTURED HOUSING INSTALLATIONS
14.20.070-Installation permit issuance and duration.
When all county, state, and federal laws, ordinances, codes, and regulations are satisfied,
an installation (building) permit will be issued to the owner or authorized agent for the
owner of the manufactured home. The permit will indicate the owner's name, the
contractor registration information, the location for which the installation was approved,
the installation (building) permit number, and the date the installation (building) permit
was issued. Permit validity, expiration, suspension or revocation and time limitation of
application shall be as established and adopted in the applicable sections of the 2015
IRC/IBC, Part I Administration and Section 14.o8.040 shall apply.
Chapter 14.25- MOBILE HOMES
14.25.070 Installation permit issuance and duration.
Permit validity, expiration,suspension or revocation and time limitation of application shall
be as established and adopted in the applicable sections of the 2o15 IRC/IBC, Part I
Administration and Section 14.08.040 shall apply.
Chapter 14.40 FACTORY-BUILT HOUSING, COMMERCIAL COACHES AND
COMMERCIAL STRUCTURES
14.40.o6o-Installation permit issuance and duration.
(a) When all county, state, and federal laws, ordinances, codes, and regulations are
satisfied, an installation (building) permit will be issued to the owner or authorized
agent of the factory built housing, commercial structure or commercial coach. The
permit will indicate the owners name, the location of for which the installation was
approved,the installation (building)permit number,the contractor registration number
and the date the installation (building) permit was issued.
(b) Permit validity, expiration, suspension or revocation and time limitation of application
shall be as established and adopted in the applicable sections in the 2015IRC/IBC, Part I
Administration and Section 14.08.040 shall apply.
(c) Each installation (building) permit shall be valid only for the location indicated on the
permit.
(d) The owner or authorized agent of the owner of the factory built housing, commercial
coach or commercial structure will be the only entity to whom an installation (building)
permit will be issued.

Chapter 14.44- EXCAVATION AND GRADING
14.44.140- Permit issuance.
(a) The official may approve or approve with modifications a grading permit application
submitted under this chapter. A permit issued will include applicable conditions
established during the review of the permit application.
(b) The official may require that grading operations and project designs be modified if
delays occur which incur weather-generated problems not considered at the time the
permit was issued.
(c) Permit validity, expiration, suspension or revocation and time limitation of application
shall be as established and adopted in the applicable sections of the 2015 IRC/IBC, Part I
Administration and Section 14.08.040 shall apply.
(d) Following the adoption of this chapter, Mason County departments shall not accept,
process or approve any application for subdivision or any other development permit for
property on which a documented violation of this chapter has occurred, until the
violation is resolved by restoration or erosion control and/or payment of penalties
imposed for the violation.
14-44.180- Fills.
(a) General. Unless otherwise recommended in the approved soils engineering report, fills
shall conform to the provisions of this section. In the absence of an approved soils
engineering report, these provisions may be waived for minor fills not intended to
support structures.
(b) Preparation of Ground. Fill slopes shall not be constructed on natural slopes steeper
than 2:1. The ground surface shall be prepared to receive fill by removing vegetation,
noncomplying fill, topsoil and other unsuitable materials; by scarifying to provide a
bond with the new fill, and,where slopes are steeper than 5:1 and the height is greater
than five feet, by benching into sound bedrock or other competent material as
determined by the soils engineer. The bench under the toe of a fill on a slope steeper
than 5:1 shall be at least ten feet wide.The area beyond the toe of fill shall be sloped for
sheet overflow or provided with a sub-drain. When fill is to be placed over a cut, the
bench under the toe of fill shall be at least ten feet wide, but the cut shall be made
before placing the fill and accepted by the soils engineer or engineering geologist, or
both,as a suitable foundation for fill.
(c) Fill Material. Organic material shall not be permitted in fills, except as permitted by the
official, no rock or similar irreducible material with a maximum dimension greater than
twelve inches shall be buried or placed in fills.
Exception: The official may permit placement of larger rock when the soils engineer
properly devises a method of placement and approves the fill stability. The following
conditions shall also apply:
(1) Prior to issuance of the grading permit, potential rock disposal areas shall be
delineated on the grading plan.
(2) Rock sizes greater than twelve inches in maximum dimension shall be ten feet or
more below grade, measured vertically.
(3) Rocks shall be placed so as to assure filling of all voids with well-graded soil.

(d) Compaction. All fills shall be compacted minimum density as determined by 2015 IBC
and subject to all requirements held in chapters 17 and 18.
(e) The slope of fill surfaces shall be no steeper than is safe for the intended use. Fill slopes
shall be no steeper than two horizontal to one vertical.
14.44.19O-Setbacks.
(a) General. Cut and fill slopes shall be set back from site boundaries in accordance with
this section. Setback dimensions shall be horizontal distances measured perpendicular
to the site boundary. Setback dimensions shall be as shown in Figure No. J1o8.1,
Appendix J in the 2015 International Building Code.

(b) Top of Cut Slope.The top of cut slopes shall not be made nearer to a site boundary line
than one-fifth of the vertical height of cut with a minimum of two feet and a maximum
of ten feet. The setback may need to be increased for any required interceptor drains.
The top of the cut slope shall be finished as a rounded or bald head slope.
(c) Toe of Fill Slope. The toe of fill slope shall be made not nearer to the site boundary line
than one-half the height of the slope with a minimum of two feet and a maximum of
twenty feet. Where a fill slope is to be located near the site boundary and the adjacent
off-site property is developed, special precautions shall be incorporated in the work as
the official deems necessary to protect the adjoining property from damage as a result
of such grading.These precautions may include,but are not limited to:

(1) Additional setbacks;
(z) Provision for retaining or slough walls;
(3) Mechanical or chemical treatment of the fill slope surface to minimize erosion;
(4) Provisions for the control of surface waters.
(d) Modification of Slope Location. The official may approve alternate setbacks. The
official may require an investigation and recommendation by a qualified engineer or
engineering geologist to demonstrate that the intent of this section has been satisfied.
