HomeMy WebLinkAbout2016/07/26 - Regular BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS July 26, 2016 1. Call to Order—The Chairperson called the regular meeting to order at 6:01 a.m. 2. Pledge of Allegiance—Chair Jeffreys led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim Sheldon; Commissioner District 3 —Terri Jeffreys. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Jim Reece, Jim & Milniece Kerns, Ron & Margo Otto and Jim & Peg Penny sent letters regarding boating regulations. 4.1.2 The Liquor and Cannabis Board sent a marijuana license application for Bomar Holdings, a special occasion application for Summit Pacific Medical Foundation, a liquor license application for Skipper John's Seafood and a list of businesses with liquor and cannabis licenses due to expire within 90 days. 4.1.3 The National Association of Realtors sent notification of briefing. 4.1.4 The Department of the Navy sent an impact statement. 4.1.5 The EDC sent their 2"d quarter report. 5. Open Forum for Citizen Input— 5.1 Mary Jean Hrbacek spoke about a salary survey. She said a salary survey needs to be done before the budget. She reiterated some of the comments from a news article regarding a battle between the MCSO and the Board. She also read excerpts from the Kitsap Sun. She said she doesn't think the people recognize all the Sheriff does for the community. 5.2 Josh Kival asked the Board for their support to aquire the historical railroad properties. He thinks this would be beneficial for tourism. 6. Adoption of Agenda - Cmmr. Neatherl in/Sheldon moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye; 3-aye. 7. Approval of Minutes—July 11, 2016 Briefing meeting minutes. Cmmr. Sheldon/Neatherlin moved and seconded to approve the July 11, 2016 briefing minutes. Motion carried unanimously. N-aye; S-aye; J-aye. 8. Approval of Action Agenda: 8.1 Approval of the Memorandum of Understanding (MOU) between Mason County Public Health and Human Services and United Way of Mason County as to the role and responsibilities in acceptance of a 2016 Community Impact Grant. 8.2 Approval to set a public hearing on Tuesday, August 16, 2016 at 9:30 a.m. to consider repealing Collective Gardens, MCC Section 17.09, as an allowed land use in Mason County. 8.3 Approval of the Veterans Assistance Fund applications for: Necessity Items $258.71; Utilities $1,219.16; Driver License/ID $54.00 and Housing $668.46 for a total of$2,200.33 as recommended by the Veterans Service Office. 8.4 Approval of the Resolution allowing Current Expense Departments to transfer up to $15,000 annually between salary and benefit expenditure budget lines and operating expenditure budget lines without Commissioner approval. The Sheriff's Office is allowed an annual transfer amount of up to $50,000. The transfers will not change the department's budget total. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS July 26, 2016 - PAGE 2 8.5 Approval to set a public hearing on Tuesday, August 16, 2016 at 9:30 a.m. to receive public comment on the Private Line Occupancy Permit for a waterline at 10238 W Matlock Brady Road for the Nelson Family Trust. 8.6 Approval of Amendment 9 to Consolidated Contract C17118 amending Drinking Water Group A Program by adding a requirement to record two GPS data points when performing a sanitary survey and provides $6,000 to the Recreational Shellfish program. Item 8.4 will be removed for a separate vote. Cmmr. Sheldon confirmed that item 8.2 due to state law. Cmmr. Neatherlin/Sheldon moved and seconded to approve action items 8.1 through 8.6 with the exception of item 8.4 to be removed for a separate vote. Motion carried unanimously. N-aye; S-aye; J-aye. Item 8.4 Approval of the Resolution allowing Current Expense Departments to transfer up to $15,000 annually between salaries and benefit expenditure budget lines and operating expenditure budget lines without Commissioner approval. The Sheriff's Office is allowed an annual transfer amount of up to $50,000. The transfers will not change the department's budget total. Frank Pinter explained this item and the Board asked questions. Cmmr. Neatherlin said the way it's written you still have to go through the same process. Undersheriff Jim Barrett explained what is meant by discretionary abilities authority. He said it would be fair if the Board used percentages of each elected official's budget. Cmmr. Sheldon said if this is approved it will be more Micromanagement of elected officials and will create more animosity between elected officials. Cmmr. Neatherlin said if they don't pass this then they won't have flexibility. Cmmr. Sheldon said he is not voting for this. Cmmr. Jeffreys spoke about options and how they came up with this. Cmmr. Neatherlin/Jeffreys moved and seconded to approve the Resolution allowing Current Expense Departments to transfer up to $15,000 annually between salary and benefit expenditure budget lines and operating expenditure budget lines without Commissioner approval. Resolution 46-16 (Exhibit A) 9. 6:30 p.m. Public Hearings and Items Set for a Certain Time 9.1 Continued from June 21, 2016. Public Hearing to consider amendments to the Mason County Boating Regulations, Mason County Code Chapter 9.04. Staff: Diane Zoren/Deputy Dugan Diane Zoren explained this item. Susan Freedlander said the boat problems that we are discussing are very minimal. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS July 26, 2016 - PAGE 3 Shawn Wilson said he has recreational property in Mason County. He specifically bought his cabin on the lake to be able to water ski. He also has concerns that the lake traffic would be constricted to the center of the lake. Barbara Tarabocha commented on boating enforcement issues and spoke about shoreline protection. She wants everyone to have fun but not at the expense of others. Trish said if you want to live on a lake those are the kinds of problems you will face. She said if this is changed she thinks they will lose a lot of residents. Alan Duback spoke about setbacks. He hopes the county will inform residents of new rules and possibly display signs with the rules. Gerard Shaffer spoke about safety issues with concentrating people on the lake. He said there is nothing to prove that only waves are causing damage. He said inner tubes make wakes too. He said this seems like this regulation is against wake surfers and wake boarders. He asked the Board to not make final decisions tonight until they have more time to gather more important facts. Mary Russell said it's not up to someone else to take away the boating pleasures from someone else. Rusty Kindrick said one winter storm will do more damage to her bulkhead than anything else. Jim Reese reminded the board of the documents he has sent to them. Jim Madden said boating regulations are for 1. Public safety. 2. Protection of properties. 3. Recreation (provided 1 &2 are met). He said wakes do cause damage and there have been numerous studies to prove this. The damage is not caused by a single incident but by compounding damages. Mark Tucson stated that he thinks most of these things appear to be common sense. He said wear and tear of docks and bulkheads is normal. He hopes they don't change any of the rules. He also mentioned that the officers are going to run ragged. Ken Potts said he agrees that winter storms causes a lot of damage. He votes that we keep everything at 150 feet. Dave Mortenson said he hopes the Board won't change anything. He said it doesn't make sense. Beau Brown said he moved to Mason County to enjoy the lake sports. He spoke about some of the concerns he has. Mr. Freedlander commented on Cmmr. Sheldon's proposed changes. Barb Gilsacter asked the Board to keep safety in mind. These budget transfers shall be made on an approved budget transfer form to the Budget Manager or designee utilizing a.Reallocation BARS number. The Budget Manager or designee shall process these requests within seven business days of receiving a complete budget transfer request. The budget transfer shall not change the department level budget total;. WHEREAS,budget transfer requests that exceed the above amounts shall be made on an approved budget transfer form to the Board of Commissioners for consideration and approval; WHEREAS,no additions of staff(either part or full time)or changes in salary and/or classification are permitted without approval of the Board of Commissioners; NOW THEREFORE BE IT RESOLVED THAT Elected Officials and Department Directors shall be allowed to transfer up to the following amounts annually within their departments between salary and benefit expenditure budget line items and operating expenditure budget line items without approval of the Board of Commissioners: $15,000 annual total for each Current Expense Department except for the Sheriffs Office;$50,000 annual total for the Sheriff s Office.
