Pledge of Allegiance— led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim Sheldon; Commissioner District 3 —Terri Jeffreys. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 The Bureau of Indian Affairs sent a letter regarding Title 25 and "in-trust" property. 4.1.2 Leanna Krotzer applied for the Parks and Trails Advisory Board. 4.1.3 Ken VanBuskirk sent a letter regarding the speed limit on Old Belfair Hwy. 4.1.4 Dinah Lee Griffey sent a letter regarding the Metropolitan Parks District. 5. Open Forum for Citizen Input— 5.1 Mary Jean Hrbachek spoke about her concerns about the Sheriff's salary. Cmmr. Neatherlin said the Sheriff's wage is 12% higher than a commissioner so not all elected officials are paid the same. 6. Adoption of Agenda - Cmmr. Neatherlin/Sheldon moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye; J-aye. 7. Approval of Minutes—June 27 briefing and July 5 and 12 regular meeting minutes. Cmmr. Sheldon/Neatherlin moved and seconded to approve the June 27 briefing minutes and July 5 & 12 regular meeting minutes. Motion carried unanimously. N-aye; S-aye;J- aye. 8. Approval of Action Agenda: 8.1 Approval to set a public hearing on August 9, 2016 at 9:30 a.m. to consider adopting the 2015 State Building Code updates. 8.2 Approval of the resolution revising Mason County Code 2.49 clarifying organization, authority and responsibilities of the Parks and Trails Advisory Board. 8.3 Approval to distribute Request for Proposals (RFP) for contracted services to conduct outreach and education and provide participant technical assistance for the grant funded "Building Connections-Strengthening Businesses in Mason County" project. 8.4 Approval of the joint resolutions and Memorandum of Understanding (MOU) between Mason County and Hood Canal School District Number 404 for Recreation and Conservation Funding (RCO) grant applications. 8.5 Approval of the agreement with Public Safety Testing to provide promotional testing for Corrections Corporal/Sergeant and Sheriff Corporal/Sergeant. The professional services to be performed are one Corrections Sergeant written exam; and assessment center exams for all four positions. 8.6 Approval to set a public hearing on August 16, 2016 at 9:30 a.m. to consider a Moratorium for up to six month on medical cannabis cooperatives under the authority of RCW 36.70A.390. 8.7 Approval of the agreement for Sandhill Park renovations for Recreation and Conservation Funding (RCO) grant award. The 50% required match of$225,000.00 has been budgeted and will be funded under REET 2. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS JULY 19, 2016 - PAGE 2 8.8 Approval of the Supplemental Agreement No. 1 for On-call Geotechnical consultant Services for 2016 with Landau Associates adding an additional maximum payable amount of$125,000 to the agreement. 8.9 Approval to appoint Jon Decker to the Solid Waste Advisory Committee representing District 3. 8.10 Approval for the Board to authorize Public Works to execute Change Order number 1, in the amount of$15,635.28 for Rustlewood Sewer System lift stations 2 and 3 electrical panel replacement/upgrade project. 8.11 Approval to set a public hearing on August 9, 2016 at 9:30 a.m. to consider an ordinance allowing wheeled all-terrain vehicles use on County roads per state law, with the additional requirement that headlights are used at all times. 8.12 Approval of the letter to Crossroads Housing regarding a request for change in funds disbursement. 8.13 Approval of the Veterans Assistance Fund applications for: Necessity Items $300.00 and Utilities $895.19 for a total of$1,195.19 as recommended by the Veterans Service Office. 8.14 Approval for the Board to execute the Design Agreement between the Department of the Army and Mason County and the Skokomish Tribe for the Skokomish River Restoration. Conley Watson spoke about Item 8.1. He said that additional information is available at the library. Cmmr. Sheldon said Item 8.14 has been worked on for a long time. He wanted to recognize Loretta Swanson and all the staff who worked hard on this. Cmmr. Neatherlin/Sheldon moved and seconded to approve action items 8.1 through 8.14. Motion carried unanimously. N-aye; S-aye;J-aye. 9. 9:30 a.m. Public Hearings and Items Set for a Certain Time— 9.1 Public Hearing to consider adopting a resolution placing a ballot proposition on the November 8, 2016 general election ballot to create a Mason County Metropolitan Park District (MPD). Frank Pinter explained this item and answered questions. Cmmr. Sheldon confirmed that this proposal is for 20 cents although the maximum would be 75 cents. He also asked questions about this proposed MPD. Tim Whitehead commented on this item. Cmmr. Neatherlin said at this time, this is to determine if this should be on the November ballot and the voters will determine the outcome. Frank Pinter confirmed this is to consider a resolution to place this on the November ballot. Cmmr. Sheldon said he feels the public needs to know more information and feels this has a lot of policy issues that the public should be aware of. Citizen Input: Monty Ritter spoke at the proposed MPD. There will be meetings to get this information to the public. Cheryl Williams made a comment. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS JULY 19, 2016 - PAGE 3 Commissioner Neatherlin reiterated that this hearing today is just to get it on the ballot and the citizens can choose. Commissioner Deliberations: Cmmr. Neatherlin is in favor of this. Cmmr. Sheldon said he will not support this. He thinks this has a lot of difficulties. Cmmr. Jeffreys said she does support this. Cmmr. Neatherlin/Jeffreys moved and seconded to approve adopting a resolution placing a ballot proposition on the November 8, 2016 general election ballot to create a Mason County Metropolitan Park District(MPD). Motion carried. N-aye; S-NAY;J-aye. Resolution 44-16 (Exhibit A) 9.2 Public Hearing to consider the 2012, 2013 and 2015 Current Use Open Space and Timber Land applications. Phil Franklin explained this item and explained the 2012, 2013 and 2015 current use open space and timber land applications. There was no public testimony. Cmmr. Sheldon/Neatherlin moved and seconded to approve the 2012, 2013 and 2015 Current Use Open Space and Timber Land applications as recommended by the Mason County Assessor's office. Motion Carried Unanimously. N-aye; S-aye;J-aye 9.3 Public Hearing to take public comment on the proposed resolution to change the speed limit on sections of Pickering Road. Staff: Jerry Hauth/Loretta Swanson/Dave Smith. Dave Smith explained this item. He hopes the Board will approve the speed limit changes and the Ordinance. The Board asked Mr. Smith questions regarding this proposed ordinance. Loretta Swanson said the speed limit on the North side of Harstine Island is 35 mph and the South side is 40 mph. Public Testimony: Conley Watson commented on this item. Commissioner Deliberations: The Board discussed this proposed ordinance to change the speed limits on sections of Pickering Road. Cmmr. Neatherlin said he will not support this item. Cmmr. Neatherlin moved to approve the change back the speed limit as it was prior. Motion failed due to lack of a second. Boards Reports and Calendars -The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 11. Other Business (Department Heads and Elected Officials) 11.1 Dave Windom, Director of Community Services, spoke about the Comprehensive Plan update. 12. WHEREAS, Mason County currently operates, acquires, and maintains its parks lands and recreation facilities using general fund and Real Estate Excise Tax(REET) dollars; and WHEREAS, Chapter 35.61 RCW authorizes a county to create a metropolitan park district wholly within its boundaries; and, WHEREAS,the boundaries of the proposed metropolitan park district will be solely within the unincorporated area of Mason County; and, WHEREAS, a metropolitan park district has additional and independent authority to tax property to raise funds restricted to park and recreation purposes provided for in Chapter 35.61 RCW; and, WHEREAS, stable funding is essential to provide Mason County citizens the best possible parks, trails, boat landings and open spaces, provide proper operation and maintenance, and to allow for future opportunities to acquire and develop new parks, regional trails and open spaces; and, WHEREAS, Mason County parks,trails and recreational opportunities are an essential element to the public health,welfare and quality of life for Mason County residents. WHEREAS, the Friends of the Parks have recommended that Mason County submit a ballot proposition to the residents of unincorporated Mason County to form a Metropolitan Park District and that it be governed by 5 elected metropolitan park district at-large commissioners ; WHEREAS,The Trust for Public Land conducted a countywide voter survey in April 2016 and the conclusion was the proposed Mason County Metropolitan Park District Formation received majority support; WHEREAS, it is recommended to fund the MPD by a general property tax of$0.20(20 cents) per$1,000 of assessed value; WHEREAS, RCW 35.61.020 provides counties the authority to pass a resolution submitting a ballot proposition to the voters of the area proposed to be included in the district; and NOW,THEREFORE,THE BOARD OF COMMISSIONERS FOR MASON COUNTY WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Election. Pursuant to RCW 35.61.020 the Board of Mason County Commissioners hereby calls for submission of a proposition on the November 8, 2016 general election ballot to the qualified electors of Mason County asking whether the Mason County Metropolitan Park District shall be created. Section 2. Ballot Proposition.The proposition to be submitted to the electorate of Mason County shall read substantially as follows: Resolution No. 42_1 � MASON COUNTY PROPOSITION NO. 1 METROPOLITAN PARK DISTRICT Mason County Commissioners passed Resolution No. in in order to allow voters to decide whether a Mason County Metropolitan Park District be formed in the unincorporated area of Mason County as now and hereafter established and to be governed by an elected board of five commissioners to support parks, trails and recreation, provide additional access to rivers, beaches and shorelines, funded by a general property tax of$0.20 (20 cents) per$1,000 of assessed value, subject to published, annual independent audits, and citizen oversight. Shall the Mason County Metropolitan Parks District be so created and governed? [] For the formation of a metropolitan park district to be governed by an independent elected board of five commissioners. [] Against the formation of a metropolitan park district. Section 3. Commissioner Districts. Each Metropolitan Park District Commissioner position will be at- large. Section 4. Boundaries of the Mason County Metropolitan Park District. The boundaries of the Mason County Metropolitan Parks District shall encompass the unincorporated areas of Mason County excluding the incorporated area of the City of Shelton. AN ORDINANCE AMENDING 55-87 AND REPLACING RESOLUTIONS 26-12 - CHANGING THE SPEED LRY11T ON PICKERING ROAD IN MASON COUNTY WHEREAS,the Revised Code of Washington RCW 46.61,415 permits local authorities to establish or alter maximum legal speed limits pursuant to RCW 46.61A00 on County road within their jurisdiction based on engineering and traffic investigation,and WHEREAS,in accordance with Chapter 10.04 of the Mason County Code the board of county commissioners,by ordinance,may raise or lower a speed limit on any county road,except raising above fifty miles per hour. WHEREAS,Mason County previously established alternate speed limits for the Pickering Road on July 21,1987 under Resolution 55-87 and again on April 3,2012 under Resolution 26-12. WHEREAS,the Mason County Public Works Department has conducted an engineering and traffic investigation on Pickering Road;and WHEREAS,County Commissioners held a public hearing and received public testimony regarding the speed limit on Pickering Road. THEREFORE,BE IT RESOLVED that County Commissioner,after due deliberation and in the best interest of the public hereby adopts the speed limit posting for the entirety of Pickering Road as follows: ROAD NO, ROAD NAME SPEED M.P.-M.P. 28850 Pickering Road 40 0.00-0.90 35 0.90—1.50 40 1.50—1.85 40 1.85—3.24 40 3.24—6.29 THEREFORE,BE IT RESOLVED AND ORDERED,that this ordinance amends the portion of Ordinance 55-87 pertaining to Pickering Road and replaces Resolutions 26-12.Speed - limit is effective immediately as shown and the County Engineer is directed to erect the necessary signs in conformity herewith.
