Pledge of Allegiance— Eugene led the flag salute. 3. Roll Call— Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim Sheldon, via telephone; Commissioner District 3 —Terri Jeffreys. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 The Liquor and Cannabis Board sent special occasion applications for Colony Surf Club and Harstine Island Community Club and marijuana license applications for Mari Meds and #1 Pot Stop. 4.2 Chair Terri Jeffreys read aloud the proclamation recognizing April 13 as Volunteer Recognition Day. 5. Open Forum for Citizen Input— No public comment. 6. Adoption of Agenda - Cmmr. Neatherlin/Sheldon moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye; 3-aye. 7. Approval of Minutes— March 14, 2016 briefing minutes and April 5, 2016 regular meeting minutes. Cmmr. Sheldon/Neatherlin moved and seconded to approve the March 14, 2016 briefing minutes and April 5, 2016 regular meeting minutes. Motion carried unanimously. N-aye; S-aye;J-aye. 8. Approval of Action Agenda: 8.1 Approval to amend Rules of the Board-Meetings of the Board of County Commissioners- County Code Chapter 2.88.020. Ordinance No. 21-16 (Exhibit A) 8.2 Approval to amend Resolution 21-15 updating Mason County Emergency Evacuation Procedures (Downtown Campus) for 2016. Resolution No. 22-16 (Exhibit B) 8.3 Approval of the Veterans Assistance Fund applications for: Necessity Items $300.00 and Utilities $461.54 for a total of$761.54 as recommended by the Veterans Service Office. 8.4 Approval to reschedule a public hearing on Tuesday, April 26, 2016 at 6:30 p.m. to consider the sale of real properties located at 92 and 93 Anthony Road, Bel€air Allyn, WA; parcels 22129-75-90092 and 22129-75-00013. 8.5 Approval of the agreement with CGI Communications Inc. for the 2016 County Video Program. This program will create a series of professionally produced videos to highlight Mason County at no cost to Mason County. 8.6 Approval of the Resolution adopting the 2016 Comprehensive Economic Development Strategy (CEDS) Project list as recommended by the Mason County Economic Development Council. Resolution No. 23-16 (Exhibit C) 8.7 Approval to nominate Derek Epps to the Pacific Mountain Workforce Development Board of Directors. Approval to sign thank-you letters to Senators Murray and Cantwell and Representative Kilmer for their support of the Skokomish Valley General Investigation Study funding. 8.8 Approval to sign thank-you letters to Senators Murray and Cantwell and Representative Kilmer for their support of the Skokomish Valley General Investigation Study funding. 8.9 Approval to authorize the Chair sign a response letter to the Mason County Sheriff regarding the 2016 budget. Cmmr. Sheldon requested Item 8.9 be removed for a separate vote. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS April 12, 2016 - PAGE 2 Cmmr. Jeffreys noted that changes were made to the CGI Communications agreement to include compliance with ADA regulations. Cmmr. Neatherlin/Sheldon moved and seconded to approve action items 8.1 through 8.8, excluding Item 8.9 for a separate vote. Motion carried unanimously. N-aye; S-aye; 3-aye. Item 8.9 Cmmr. Jeffreys stated the letter to the Sheriff is in response to a news release from the Mason County Sheriff. Cmmr. Sheldon stated he does not want his name attached to the letter. He has serious reservations with the language and does not believe the Mason County budget process is solely the responsibility of the Commissioners but is shared with all departments. Commissioners Neatherlin and Jeffreys read loud the five-page letter to the Sheriff. Undersheriff Barrett stated he has problems with the front end of letter; no problem with latter part of letter. He does not believe the Commissioners'narrative squares up with the facts. The Sheriffs office started briefing for jail costs in April 2015,jail supplement was $300K at end of year. The Sheriff's Office is willing to sit down and discuss differences. Cmmr. Neatherlin stated it was the Sheriffs choice to issue a news release; he was hoping this could have been done by a conversation. It is not the way he wanted it to be. Cmmr. Neatherlin did attend the Sheriff 2016 budget presentation and that was not the information requested from the Commission. The budget numbers are the county numbers and that's what counts. MI Hrbacek stated this letters demonstrates a failure to communicate and encouraged the Commission sit down with the Sheriff and discuss this. Cmmr. Jeffreys pointed out the 2016 budget guidelines, issued in June 2015, stated the 2016 budget would be a two bottom line budget which had been done in the past. The Sheriff's office wages and benefits were overstated by $400K; ER&R was overstated by $120K. The Commissioners acknowledged jail outsourcing would cost a lot of money and the Commission added $300,000 to the Sheriff's 2016 budget and was hopeful that would be adequate. Cmmr. Sheldon reiterated the budget is a shared responsibility; feels this letter makes the problem worse; it uses the collective term "we" and he doesn't want to be included. He will not sign the letter. The common ground is serving the public. He feels Commissioners Jeffreys and Neatherlin are micromanaging the Sheriff. Cmmr. Sheldon did not vote for 2016 budget. He is willing to sit down and repair issues and would prefer this letter not be sent. He believes the Commissioners can rerack the budget in June; all budgeted positions have not been filled. Cmmr. Neatherlin stated the overstated budget lines need to be acknowledged and accountable and does not believe it is micromanaging. His job is to make sure the money is spent responsibly. He sees the letter as a way to communicate. Cmmr. Neatherlin/Jeffreys moved and seconded to approve Item 8.9, authorize the Chair to sign a response letter to the Sheriff regarding the 2016 budget. Motion carried. N - aye J- aye; S-nay. Cmmr. Sheldon moved to amend the motion to amend the signature line to include all the Commissioners so he can decline to sign. No second, amendment failed. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS April 12, 2016 - PAGE 3 9. 9:30 a.m. Public Hearings and Items Set for a Certain Time—There were no public hearings. 10. Other Business (Department Heads and Elected Officials) — 10.1 Bill Kenny explained the Commissioners have gone through an extensive recruitment and evaluation process for the Community Services Director position. Mr. Kenny asked the Commissioners if there are any candidates they would authorize Human Resources (HR) to negotiate an offer of employment. Cmmr. Neatherlin -Dave Windom Cmmr. Sheldon - Dave Windom Cmmr. Jeffreys concurred with top choice of Dave Windom and authorize HR to negotiate offer employment with Mr. Windom. There will be subsequent action of appointment if Mr. Windom accepts the offer of employment. 10.2 Bill Kenny asked if there are candidates to authorize Human Resources to negotiate an offer of employment for the Public Works Director position. Cmmr. Neatherlin -Jerry Hauth Cmmr. Sheldon -Jerry Hauth Cmmr. Jeffreys concurred with the choice of Jerry Hauth and authorize Human Resources to negotiate an offer of employment. There will be subsequent action of appointment. 10.3 Bill Kenny announced his retirement as Support Services Director effective May 31, 2016. He recommended the Board appoint Frank Pinter as interim director during the selection process. Cmmr. Jeffreys acknowledged the excellent labor negotiation work that Mr. Kenny has provided to the County and his guidance in the reorganization of departments and thanked Bill. Cmmr. Neatherlin thanked Mr. Kenny for his service. Cmmr. Sheldon also extended his appreciation to Mr. Kenny. Cmmr. Neatherlin/Sheldon moved and seconded to appoint Frank Pinter as interim director effective immediately. Motion carried unanimously. N-aye; S-aye;J-aye. 11. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 12. AN ORDINANCE AMENDING ORDINANCE 11-16 AND COUNTY CODE CHAPTER 2.88 — MEETINGS OF BOARD OF COUNTY COMMISSIONERS WHEREAS, RCW 36.32.080 was amended in the 2015 legislative session allowing alternate locations for regular Commission meetings and allowing joint meetings between County legislative authorities and the rules for Meetings of the Board of County Commissioners need to be amended to reflect these changes; WHEREAS, in the event a joint meeting is scheduled with another County legislative authority, it is Mason County's policy to strive to provide a 14 day notice; WHEREAS, these rules are designed to provide guidance to the Commission and do not amend statutory or other regulatory requirements; NOW, THEREFORE BE IT RESOLVED, the Board of Mason County Commissioners hereby establishes the following rules (Attachment A) for the conduct of Commission meetings, proceedings and business. Regular meetings of the Board of Mason County Commissioners are held at 9:00 a.m. each Tuesday, except for the fifth Tuesday (in those months that have five Tuesdays) in the Commission Chamber, 411 North 5'h Street, Shelton, Washington to transact regular business, (RCW 36.32.080) provided that: 1) If a holiday recognized and observed by the county falls on a Tuesday, such regular meeting shall be held on the next business day, per RCW 42.30.070; 2) If, due to an emergency, it is unsafe to meet in the Commission Chambers, .meetings may be held for the duration of the emergency at such place as is designated by the chairperson of the board; 3) The regular meeting of the board on the fourth Tuesday of the month shall commence at 6 p.m. in the Commission Chambers; 4) The regular working session (briefings) may be held on Mondays from 8:00 a.m. to 5:00 p.m., on Tuesdays following the regular Commission meeting until 5:00 p.m. and on Wednesdays from 8:00 a.m. to 5:00 p.m. At these meetings, the Board is briefed by staff and discussion may occur with other agencies. These are generally not decision-making meetings, however, occasionally an action is taken; 5) The Board may hold continued meetings in accordance with requirements of the law and may conduct continued meetings in the evening; 6) As an alternative option, regular meetings may be held at a location outside of the county seat but within the county if the county legislative authority determines that holding a meeting at an alternate location would be in the interest of supporting greater citizen engagement in local government. This alternative option may be exercised no more than once per calendar quarter and may be held on the fifth Tuesday. Notice must be given at least 30 days before the time of the meeting. The notice must be a) posted on the county's website; b) published in a newspaper of general circulation in the county; and c) sent via electronic transmission to any resident of the county who has chosen to receive the notice required under this section at an electronic mail (email) address. 7) Any two or more county legislative authorities may hold a joint regular or special meeting solely in the county seat of a participating county if the agenda item or items relate to actions or considerations of mutual interest or concern to the participating legislative authorities. A legislative authority participating in a joint regular meeting held in accordance with this subsection must, for purposes of the meeting, comply with notice requirements for special meetings provided in RCW 42.30.080 and Mason County's policy is to strive to provide a 14 day notice. This notice requirement does not apply to the legislative authority of the county in which the meeting will be held. It is recommended that participation in regular Board meetings via conference call or videoconference be limited to no more than four times per calendar year per Commissioner. Additional participation via conference call or videoconference is subject to approval by majority of the Board. All Board meetings shall be open to the public. However, the Board may retire to executive session by majority vote and in compliance with the law(RCW 42.23 and RCW 42.30.110). Nothing in this section shall prohibit the Board of County Commissioners from adjourning Tuesday meetings from time to time, or from calling special meetings in accordance with notice requirements of law(RCW 42.30), or from cancelling a Commission meeting. 2.88.020 Special meetings. Special meetings (RCW 42.30.080) may be called at any time by a majority of the members of the Board by providing written notice personally, by mail, by fax, or by e-mail at least 24 hours before the time of the special meeting to each member of the Board, to each local newspaper of general circulation, and to each local radio or television station that has a written request on file with the governing body to be notified of special meetings. Notice shall be posted at the entrance to the meeting room and posted on the County's web site. The notice shall specify the time and place of the special meeting and the business to be transacted. Final action shall not be taken on any other matter at such meeting. Written notice to a member of the governing body is not required when a member files at or prior to the meeting a written waiver of notice or provides a wavier by telegram, fax or e- mail or the member is present at the meeting at the time it convenes. 2.88.030 Emergency meetings. The notice required for special meetings may be waived in the event it is called to deal with an emergency involving injury or damage to persons or property or the likelihood of such injury or damage, when time requirements would make it impractical and increase the likelihood of injury or damage. An emergency meeting must be open to the public. 2.88.040 Quorum. A quorum of the Board of Mason County Commissioners shall consist of two elected or appointed County Commissioners. In order for business to be conducted at any Commission meeting, two elected or appointed County Commissioners shall be physically present at the meeting location. The Board shall not adopt nor discuss with each other any ordinance, rule, regulation, order or directive except in a meeting open to the public and attended by a quorum; except for executive sessions (RCW 42.30.110) and those proceedings exempted by RCW 42.30.140. The Board may schedule regular, continued, or special meetings at locations outside the regular meeting place, as authorized by RCW 36.32.080 and subject to provisions of the Open Public Meetings Act(Chapter 42.30 RCW). 2.88.050 Officers of the Board. The elected officers of the Board are the Chair and Vice Chair. At their first regular meeting of the calendar year, the Board of Mason County Commissioners shall select one of its members to preside at its meetings as Chair of the Board and Vice Chair. In the event of a vacancy in the office of the Chair for any reason, including succession, the position shall be filled by the Vice Chair and the election of a replacement for the Vice Chair shall be held to serve the unexpired portion of the term. The Vice Chair will serve as Chair when the Chair is unable to serve. The Chair shall sign all documents requiring the signature of the Board, and the Chair's signature shall be as legal and binding as if all members had affixed their names, provided the signature is authorized by the Board. In case the Chair is absent at any meeting of the Board, all documents requiring the signature of the Board shall be signed by the Vice Chair. 2.88.060 Clerk of the Board. The Board of Mason County Commissioners shall appoint, by resolution, a Clerk who shall attend its meetings and keep a record of its proceedings. The Board may appoint an alternate person to act as Clerk when the appointed Clerk is unable to attend meetings. 2.88.070 Motions,seconds, and voting. Any member of the Board, including the Chair and Vice Chair may make motions and/or second the motions of other members and vote on matters before the Board. Any member may disqualify themselves if they have a conflict of interest or believe participation in a Board action may raise issues of appearance of fairness. 2.88.080 Postponement of action. When only two members of the Board are present at a meeting of the Board, and a division takes place on any question, the matter under consideration shall be postponed until the next regular meeting. 2.88.090 Agendas. Agendas for regular meetings of the Board of County Commissioners shall be available to the public and online no later than twenty-four hours in advance of the published start time of the meeting . (RCW 42.30.077) Written notice for adjourned or continued meetings of the Board of County Commissioners shall be made in the same manner as provided in 2.88.020. Additions or modifications to the agenda may be made by majority vote of the Board at any time during the regular meeting. 2.88.100 Records of the Board. All records of the Board, except those which are not public records within the terms of RCW 42.56, as enacted or hereafter amended, shall be available for public inspection at the office of the Commissioners during regular working hours. 2.88.110 Applicability. Nothing in this resolution or in Chapter 42.30 RCW prohibits Board members from travelling together or from gathering for purposes other than county business nor from individually discussing county business with other than Board members. AMENDING RESOLUTION 21-15,REVISING MASON COUNTY EMERGENCY EVACUATION PROCEDURES WHEREAS, The purpose of these procedures is to provide information necessary for the emergency notification and evacuation of the Mason County downtown campus for employees and visitors during an emergency; WHEREAS, persons maybe injured and property may be damaged unless standard procedures for response to an emergency evacuation are established; WHEREAS,the Courthouse Security Committee reviewed the Emergency Evacuation Procedures and made recommendations and corrections to the Procedures; NOW,THEREFORE, BE IT RESOLVED by the Board of Mason County Commissioners to adopt the March 24, 2016 Mason County Emergency Evacuation Procedures (Downtown Campus) as outlined in Exhibit A. From time to time, it is necessary that we evacuate downtown campus county government buildings for any number of emergency reasons: fire, earthquake,hazardous material spills/leaks, terrorist threat/workplace violence(active shooter,hostage situation, and bomb threats), etc. In recent years,bomb threats have become a method by many individuals to harass or devastate both private industry and government agencies. No bomb threat should be overlooked or simply dismissed as a crank call. Each threat shall be treated as a valid threat to the safety of the people in the downtown campus. All Mason County departments are responsible for planning/training/exercising evacuation plans of their respective building/facility/work areas. The County Division of Emergency Management (DEM) can assist in developing your evacuation plan. The overall effort will be accomplished under the auspices of the County Safety Committee in order that evacuation assembly areas are coordinated among other county departments. ACTIONS TO BE TAKEN WHEN A BOMB THREAT IS RECEIVED! 1. Remain Calm 2. If possible,keep the caller talking. Use the attached"Bomb Threat" checklist (Enclosure III). Fill in as much information as possible while receiving the call. Add relevant information later as you remember it. Give the document to the responding law enforcement officer and remain available for debriefing. 3 Notify your supervisor of the threat. 4 Call or direct someone to call MACECOM(Dispatch) at 9-1-1 to notify them of the threat. MACECOM will make the initial notifications to responders and Mason County Emergency Management(DEM). See County Alert Notification System(Enclosure I). 5 Once DEM is notified they will contact Building#1 telephone receptionist who will notify the following county Offices within the building: • Commissioners Office ext 419 • Human Resources/Risk Management ext 268 DEM will follow up the telephone alert notifications by sending a county wide e-mail message reference the evacuation. See County alert notification system(Enclosure I) and County Emergency Contact List(Enclosure II) 6 Once notified of the evacuation order, each elected official/appointed department head or their designated alternate representative is responsible for the orderly evacuation of their respective work areas including selecting the assemble area location to be used. 7 The above procedures (minus paragraph 2 above)will be used during other emergency events (hostage situation, active shooter, earthquake, fire, etc.) affecting any county building/facility. EVACUATION Upon the receipt of a credible bomb threat to a specific building,the building may become a crime scene and be evacuated until Law Enforcement deems it safe for re- entry.A credible bomb threat or other emergency situation will be determined by the Incident Commander. After being instructed to evacuate a building: 1. All.employees and visitors will safely evacuate the effected building(s)to the instructed assemble area. 2. If time permits: a. Turn off power to all machines (computers,printers, etc.). b. Leave open doors to lessen damage in the event of a blast. Close doors in the event of fire. c. Take your outer garments (coats,jackets, sweaters, etc.) and personal belongings (purses,backpacks,briefcases, etc.). Plan to not re-enter the building. d. Do not touch or examine any unusual or suspicious packages,bags, or other items. Immediately report anything strange to your supervisor. e. Designated individuals in effected buildings,when safe to do so,will post signage on their respective building entrances indicating`Building Closed Due to Evacuation" (Enclosure IV). 3. All persons are to walk calmly to the nearest stair exits. Do not use the elevators. Elevators are to be used for persons in wheel chairs or others having difficulty using the stairs. 4. Employees working in the County Downtown Campus will leave their building and proceed to one of the County's designated assembly areas, as directed by their supervisor or his/her designated alternate representative. Recommended assembly areas are located at: • City of Shelton Civic Center, 525 W. Cota Street, Shelton • Memorial Hall,210 Franklin Street, Shelton • Evergreen Elementary School, 900 West Franklin Street, Shelton 5. Once at the assemble area employees will report to their supervisor or his/her designated alternate representative and wait for further instructions. Supervisors will furnish a"roll call" sheet for accountability to their department liaison,who then will go to the Mason County Sheriff's Office. 6. In accordance with the Mason County Continuity of Government plan the County Commissioners will evacuate their building immediately. 7. During an evacuation,DO NOT attempt to move your car (especially if it is parked in a county government parking lot)unless instructed to do so. The streets around the Downtown Campus will need to be kept open for first responder vehicles (fire engines, ambulances, etc.) and to assure personnel accountability. 8. The County Sheriff's Office will evacuate the County Jail if it is determined to be necessary. 9. For a bomb threat, each department from the involved building will designate one individual to assist the search team in answering questions and providing other relevant information regarding immediate work areas. That designee will go to the Mason County Sheriff's Office and remain available until relieved by the Incident Commander. 10. After the building has been cleared of the emergency situation, county employees will be advised as to when they may re-enter the building or retrieve their vehicles to depart the area. 11. In the event you were away from the Downtown Campus when your building was evacuated and upon returning there are barricades up and streets have been blocked off, do not enter the barricaded area. Employees shall report to one of the designated assembly areas for employee accountability and to receive further instructions. 12. If the building remains closed for the remainder of the work day each elected official/appointed department head or their designated alternate representative will determine if their employees are release from duty. 13. If the emergency event causes a county building/facility to be closed for an extended period of time the affected department(s) will activate their Continuity of Operations Plan (COOP). RESPONSE 1. The County Division of Emergency Management(DEM)will activate the County Alert Notification System and will prepare for the activation of the County Emergency Operations Center(EOC) if needed. The EOC is located in the Public Works building, 100 W.Public Works Drive,.Shelton. 2. Should the County EOC be activated, designated department EOC workers will be contacted and should report to the EOC to represent their respective department and to perform EOC staff positions. 3. All media inquiries will be coordinated through the designated Incident Commander and the assigned County Public Information Officer (PIO). Cindy Kasten Chief Darren Moody(Shelton PD) Kelly Frazier Ross McDowell EXHIBIT C RESOLUTION NO. 23 RESOLUTION ESTABLISHING THE COMPREHENSIVE ECONOMIC DEVELOPMENT STRATEGY PROJECT LIST FOR 2016 WHEREAS, in the agreement between Mason County and the Economic Development Council (EDC), one of the tasks is to compile the Comprehensive Economic Development Strategy (CEDS) list for Mason County, Washington; and WHEREAS, the EDC has solicited suggested projects from local Mason County jurisdictions and community groups for possible infrastructure improvements to enhance economic sustainability throughout Mason County; and WHEREAS, the State Legislature has authorized Mason County to retain .09 percent of retail sales taxes annually for economic development projects; and WHEREAS, eligibility for funding must be demonstrated by a list of projects; and WHEREAS, the EDC has recommended a list of projects which updates the current infrastructure needs which the Commissioners have reviewed; WHEREAS, the Commissioners have identified the following list and priorities as listed in Exhibit A. NOW, THEREFORE BE IT HEREBY RESOLVED, that the Board of Mason County Commissioners adopts the attached list of priorities for inclusion in the 2016 CEDS publication.
