HomeMy WebLinkAbout2016/03/22 - Regular BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS MARCH 22, 2016 1. Call to Order—The Chairperson called the regular meeting to order at 6:05 p.m. 2. Pledge of Allegiance—Allan Borden led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim Sheldon (via telephone); Commissioner District 3—Terri Jeffreys. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 The Liquor and Cannabis Control Board sent a liquor license application for Alderbrook Country Store; special occasion applications for Belfair Elementary PTA, Summit Pacific Medical Foundation and North Mason Rotary Club; marijuana license applications for Mountain Medicine Clinic and Danish Gardens and a list of businesses with liquor and marijuana licenses due to expire within 90 days. 4.1.2 Dominic Ebacher sent a letter regarding nuisance properties. 4.1.3 ICMA (International City/County Management Association) sent a letter pertaining to the tragedy in Belfair last month. 4.1.4 Jeff Thompson resigned from the Veterans Advisory Board. 4.2 Michael MacSems presented the news release for National Historic Preservation Month which is May 2016. 4.3 Chair Jeffreys read the news release for the Board of Equalization membership. Applications are being accepted from Mason County residents. 4.4 Melissa McFadden read the news release for the County Adopt-a-Road program. 4.5 Recognition of Allan Borden who has worked in the Planning Department since 1991 and is retiring. 4.6 Jo Sanchez, Community Health Educator, presented the news release regarding Mason County's Health Rankings which have improved to #29 out of 37 counties in 2016. Additional information can be found at www.countyhealthrankings.org. 4.7 Mr. Sanchez then presented the Board of Health's Proclamation declaring the week of April 4- 8, 2016 as National Public Health Week 2016. 5. Open Forum for Citizen Input—there was no public comment. 6. Adoption of Agenda - Cmmr. Sheldon/Neatherlin moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye; 3-aye. 7. Approval of Minutes— February 8 &29, 2016 briefing minutes and March 15, 2016 regular meeting minutes Cmmr. Neatherlin/Sheldon moved and seconded to approve February 8 &29, 2016 briefing minutes and March 15, 2016 regular meeting minutes. Motion carried unanimously. N-aye; S-aye;3-aye. 8. Approval of Action Agenda: 8.1 Approval to appoint Dave Smith, Public Works, as Mason County's 2"d alternate representative on the Peninsula Regional Transportation Planning Organization Board. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS March 22, 2016 - PAGE 2 8.2 Approval of the amendment to WA E911 contract Fiscal Year 2015-2016 to reflect the following changes: 1. Overall contract amount from $131,728.00 to $127,188.00 2. Change of the Fiscal year 16 CPD funding from $36,525.00 to $40,555.00 and 3. Change of fiscal year 2016 basic service operating funding from $95,203.00 to $86,633.00. 8.3 Approval of the interagency contract with the Department of Corrections (DOC) for jail services for DOC offenders (Swift and Certain) at a per diem rate of$84.47 per day. 8.4 Approval of Warrants: Claims Clearing Fund Warrant #s 8037684-8037914 $ 464,737.36 FOR A TOTAL OF: $464,737.36 Claims Clearing YTD Total $3,093,140.66 Direct Deposit YTD Total $2,476,735.66 Salary Clearing YTD Total $1,820,769.80 8.5 Approval of the Veterans Assistance Fund applications for: Necessity Items $450.00; Utilities: $1,637.76 and Housing $1,750.00 for a total of$3837.76 as recommend by the Veteran's Service Office. 8.6 Approval of amendment #5 to the Professional Services contract with Rosa Boda for Interpreter Services. The contractor is paid $20.00 per hour for a maximum consideration not to exceed $12,000.00. Interpreter contract services have been averaging $1,000.00 per year. 8.7 Approval of the Public Works Annual Certification for calendar year 2015 and for the Chair to sign the 2015 Certification, Certification for expenditures for traffic law enforcement 2015 and certification of expenditures for fish passage barrier removal 2015. 8.8 Approval of Consolidated Contract C17118 Amendment 7 to amend statements of work for: 1. Natural Estuaries Program Livestock Management; 2. Drinking Water Group A; 3. Recreation Shellfish Activities; and 4. Tuberculosis Program. 8.9 Approval of the extension of the contract with Pacific Security Systems to provide weapon screening/campus security in the Mason County Courthouse. The current contract will expire on March 31, 2016. The terms and details are the same as the prior contract except the client is Mason County instead of Mason County Sheriff's Office/Corrections Division. 8.10 Approval of the agreement with Thomas Hughes to serve as the on-site park host at Oakland Bay County Park located at 1596 E. Agate Road, Shelton. The term of the agreement is from April 1, 2016 to December 31, 2017. Cmmr. Sheldon requested Item 8.9 be removed for a separate vote. Cmmr. Neatherlin/Sheldon moved and seconded to approve action items 8.1 through 8.8, removing item 8.9 and approving item 8.10. Motion carried unanimously. N-aye; S-aye; ]-aye. Cmmr. Sheldon supports continuing the courthouse security and would prefer the Sheriff continue managing the contract. He asked what the County's liability risk is if not managed by the Sheriff. Who will be on the contact list if there is a problem. Chair Jeffreys pointed out there is no legal staff in attendance to ask these questions. She noted the contract expires March 31 and so it won't expire, this action needs to happen tonight. There are on- going talks with departments to work out the details. Frank Pinter stated he is meeting with Undersheriff Barrett on Thursday and can hopefully resolve some of these questions. Cmmr. N-aye; S-aye;]-aye. 9. 6:30 p.m. Public Hearings and Items Set for a Certain Time— 9.1 Public Hearing to inform the citizens of the availability of funds and eligible uses of State Community Development Block Grant(CDBG) and receive comments of proposed activities specifically funding the Community Action Council (CAC) of Lewis, Mason and Thurston counties and for the Board to sign the resolution with certifications of compliance for CDBG. Frank Pinter provided information on the services this CDBG would support. Currently Lewis County is the lead entity for this grant. Up to $102,503 is available for the CAC. John Walsh, CAC Director, provided information on the CAC. They provide a broad range of services to the community and the CDBG is key to the service delivery for referral resources providing referrals to services administered by the Community Action Council and to other services in the community and Children's Justice and Advocacy services to include resource referral, advocacy, support case coordination, child forensic interviews and technical assistance to victims of child abuse as well as services including consultation and case support to victims of crimes. Tom Davis stated maybe working with the CAC is an opportunity to serve the veteran population. He has been working with Homes First and not sure if that relationship will work. Mr. Davis and Mr. Walsh will meet to discuss services available. Cmmr. Jeffreys disclosed she is on the CAC Executive Board and doesn't consider there to be a conflict of interest for voting on this item, there is no direct benefit to her. Cmmr. Neatherlin/Sheldon moved and seconded to approve to submit an application to the WA State Department of Commerce and sign the Resolution with Certifications of Compliance and any other applicable paperwork for up to $102,503 Community Development Block Grant(CDBG) for the Community Action Council (CAC) of Lewis, Mason &Thurston Counties. Motion carried unanimously. N-aye; S-aye; ]-aye. Resolution No. 20-16 (Exhibit A) 10. Other Business (Department Heads and Elected Officials) — 10.1 Bill Kenny stated the Public Health and Community Development Departments have been merged into one department and the Commissioners chose to use a recruitment process to fill the Community Services Director position. Mr. Kenny explained the recruitment/interview process. Applicant information is confidential so the applicant names are not being used. Mr. Kenny asked if there are any candidates the Commissioners wish to have Human Resources conduct reference checks. All three Commissioners agreed to request reference checks and background checks on applicants 1 and 3. Cmmr. Sheldon left the meeting at 7:00 p.m. 11. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 12. Adjournment—The meeting adjourned at 7:12 p.m. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS March 22, 2016 - PAGE 4 BOARD OF COUNTY COMMISSIONERS MASON COUNTY, WASHINGTON Terri Jeffrey, air ATTEST: Tim Sheldon, Commissioner Clerk of the Board Randy Neatherlin, Commissioner RESOLUTION NO. 20- (k) RESOLUTION WITH CERTIFICATIONS OF COMPLIANCE FOR COMMUNITY DEVELOPMENT BLOCK GRANT(CDBG) WHEREAS, Mason County is applying to the state Department of Commerce for a Community Development Block Grant(CDBG); WHEREAS, it is necessary that certain conditions be met as part of the CDBG application requirements; WHEREAS, Frank Pinter, Budget Manager is authorized to submit this application to the State of Washington on behalf of Mason County; NOW,THEREFORE, be it resolved that the Mason County Commission authorizes submission of this CDBG application to the state Department of Commerce to request$102,503 for the Community Action Council of Lewis, Mason and Thurston Counties, and certifies that, if funded, it: Will comply with applicable provisions of Title I of the Housing and Community Development Act of 1974, as amended, and other applicable state and federal laws; Has provided and will provide opportunities for citizen participation that satisfy the CDBG requirements of 24 CFR 570.486; Has provided technical assistance to citizens and groups representative of low-and moderate-income persons that request assistance in developing proposals; Will provide opportunities for citizens to review and comment on proposed changes in the funded project and program performance; Will not use assessments against properties owned and occupied by low-and moderate-income persons or charge user fees to recover the capital costs of CDBG-funded public improvements from low-and moderate-income owner-occupants; Will establish a plan to minimize displacement as a result of activities assisted with CDBG funds; and assist persons actually displaced as a result of such activities, as provided in the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended; Will conduct and administer its program in conformance with Title VI of the Civil Rights Act of 1964 and the Fair Housing Act;will affirmatively further fair housing (Title VIII of the Civil Rights Act of 1968); has adopted (or will adopt) and enforce a policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in nonviolent civil rights demonstrations; and has adopted (or will adopt)and implement a policy of enforcing applicable state and local laws against physically barring entrance to or exit from a facility or location that is the subject of such nonviolent civil rights demonstration within its jurisdiction, in accordance with Section 104(1) of the Title I of the Housing and Community Development Act or 1974,as amended; and j NOW,THEREFORE, BE IT RESOLVED that the Mason County Board of Commissioners designates Frank Pinter as the authorized Chief Administrative Official and the authorized representative to act in all official i matters in connection with this application and Mason County's participation in the State of Washington CDBG Program.
