Pledge of Allegiance—Jerry Salisbury led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim Sheldon via telephone; Commissioner District 3 —Terri Jeffreys. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 The Department of Natural Resources sent County Income Report Explanation of Tables. 4.1.2 Lori Younglove applied for the Solid Waste Advisory Committee. 4.1.3 The Liquor and Cannabis Board sent a special occasion license application for Sunrise Equine Rescue. 4.1.4 The Port of Allyn sent a letter asking the County to adopt their marina rules into County Code. 4.2 Public Notice: Melissa McFadden read the notice regarding the Spring application of herbicides for vegetation control along County roads on or after March 1, 2016. For questions, please call Public Works. 5. Open Forum for Citizen Input—There was no citizen input. 6. Adoption of Agenda - Cmmr. Approval of Action Agenda: 8.1 Approval of two resolutions to: 1) form a Shellfish Protection District in McLane Cove of Pickering Passage and 2) create a Shellfish Protection District in Hood Canal #6/Big Bend. This is a two year contract from January 1, 2016 to December 31, 2018. This is budgeted in Support Services budget. Cmmr. Neatherlin/Sheldon moved and seconded to approve action items 8.1 through 8.7. Motion carried unanimously. N-aye; S-aye;3-aye. Cmmr. Sheldon left the meeting. 9. 9:30 a.m. Public Hearings and Items Set for a Certain Time— 9.1 Public Hearing to consider an ordinance to increase the speed limit on Highland Road to 45mph from milepost 3.595 to milepost 7.921. Loretta Swanson introduced Dave Smith. She thanked everyone involved with this. Loretta explained this item. They recommend a speed limit increase on the southern portion of Highland Road. She also pointed out that some minor wording needs to be corrected. Cmmr. N eatherl in/Jeffreys moved and seconded to approve the increase the speed limit on Highland Road to 45mph from milepost 3.595 to milepost 7.921 and approve the updated ordinance authorizing the change. Ordinance 09-16 (Exhibit C) 9.2 Public Hearing to consider an ordinance to approve a speed limit change on North Bay Road, extending the 35 mph speed limit out to milepost 0.35. Staff: Loretta Swanson Loretta Swanson explained this item. Public Comment: Jeff Cizek said he agrees that the speed limit needs to be lowered in that area. He said he has witnessed many accidents. He stated that he hopes the lower speed limit will also be enforced. Cmmr. Jeffreys asked Mr. Cizek if he has seen more traffic in the last few years. Mr. Cizek said yes, there is a definite increase in traffic. Cmmr. N eatherl in/Jeffreys moved and seconded to approve a speed limit change on North Bay Road, extending the 35 mph speed limit out to milepost 0.35 and approve the ordinance authorizing the change. Motion carried. N-aye; S-absent;J-aye Ordinance 10- 16 (Exhibit D) 10. Other Business (Department Heads and Elected Officials) — 10.1 Public Works Bid Award Information: 2016 Asphalt Emulsion Contract— Mclissa McFadden announced that Public Works received two bids total. One from Albina Asphalt and the other from Husky Marketing and Supply. Both bids were accepted and project material will be purchased on an as needed basis. Adjournment—The meeting adjourned at 9:49 a.m. BOARD OF COUNTY COMMISSIONERS MASON COUNTY, WASHINGTON Terri Jeffreys, air Tim Sheldon, Commissioner ATTEST: i + � A, Randy Neatherlin, Commissioner CI rc of the Board r " i Resolution No. D A Resolution Creating a Shellfish Protection District in McLane Cove of Pickering Passage WHEREAS, Washington State Department of Health,Office of Environmental Health and Safety, by Final Order issued on July 1, 2015, downgraded the commercial shellfish area classification of a portion of McLane Cove from "Approved"to"Conditionally Approved" (Attachment A); WHEREAS,Chapter 90.72 RCW requires, by law,any County with tidelands within such boundaries of those affected areas identified in such a 'Final Order'to establish a shellfish protection district and to establish a Shellfish Protection District program with elements intended to improve water quality in such shellfish tidelands by decreasing, and if possible,eliminating nonpoint pollution from stormwater runoff, malfunctioning onsite septic sewage systems, animal pollution not adhering to best management practices and other activities that jeopardize and threaten water quality, and WHEREAS, Chapter 90.72 requires this County's legislative authority, being subject to the 'Final Order' issued by the Washington State Department of Health, Office of Environmental Health and Safety,to comply with such an order to create such a shellfish protection district when a downgrade of classification occurs; and WHEREAS, this County's legislative authority intends to comply fully with the 'Final Order' issued on July 1,2015 by the State of Washington Department of Health, Office of Environmental Health and Safety; and WHEREAS,this County's legislative authority also realizes water quality degradation of the marine tidelands and fresh waters of Mason County continues to threaten the public's health and safety and other beneficial uses of these waters for agriculture,fish and wildlife protection and recreation, and WHEREAS,this County's legislative authority further recognizes maintaining the highest levels of water quality is paramount to sustaining the livelihood of Mason County,this Puget Sound region, and to the greater environment; and WHEREAS, this County's legislative authority wishes to be an active participant in helping to work towards curing the problems facing water quality in the area; WHEREAS,this County's legislative authority has established the boundary of the Shellfish Protection District based upon the best available scientific information and data identifying any and all possible related sources and areas of origin of all possible nonpoint pollution effecting the water quality of the area as identified in the 'Final Order' issued on July 1, 2015 by the State of Washington Department of Health, Office of Environmental Health and Safety; and NOW,THEREFORE, BE IT RESOLVED that a shellfish protection district shall be established encompassing the area within the boundaries shown on "Attachment B". This change in classification was prompted by the results of comprehensive review of pollution conditions and marine water quality data. We anticipate that the reclassification will be finalized by August 5, 2015. This review concludes that Marine Water Station 57 fails the National Shellfish Sanitation Program water quality standards for an Approved classification.Based on our evaluation of marine water data, we have determined that this portion of Pickering Passage(McLane Cove) meets the standards for a Conditionally Approved classification.The area will be closed to commercial shellfish harvest for five days after a 0.75-inch or greater rainfall in 24-hours as recorded at Taylor United FLUPSY gage. A letter of concern by resident Mr. Cizek was also received on October 19, 2015 requesting a speed limit reduction in the same vicinity. Both cited high speeds and an increase in the number of accidents as the reasons for their requests. This memo presents findings and conclusions to support a recommendation to extend the 35 MPH speed zone from MP 0.25 to MP 0.35. Recommendation The current speed limit on North Bay Road is 35 MPH from MP 0.00 to MP 0.25. This recommendation extends the 35 MPH speed zone from MP 0.25 to MP 0.35, an approximate additional distance of 525 feet north. This is the section of road beginning at the intersection of SR-3 and going approximately 1,800 feet north. See attached vicinity map. Public Works conducted an engineering study using the latest methodology and available data to determine the safe speed. Current traffic volumes are 2026 ADT with 85th °toile speeds of 47 MPH southbound and 56 mph northbound. Accident history shows 5 crashes from January 2010 through December 2015,within MP 0.00 and MP 0.25. All five appear to be speed or access related. Through lanes are 2-12 foot ACP with no shoulders and a roadside ditch on each side. The road segment proposed for the speed reduction is within the Allyn UGA. An increase in land use activity with the potential for more,the installation of two sub-standard commercial road approaches at 221 E. North Bay Road, several residential accesses,three crashes in 2015, and no shoulders support the extension of the speed zone.
