HomeMy WebLinkAbout2016/01/12 - Regular BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS January 12, 2016 1. Call to Order—The Chairperson called the regular meeting to order at 9:03 a.m. 2. Pledge of Allegiance— Chair Jeffreys led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim Sheldon via telephone; Commissioner District 3 —Terri Jeffreys. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Neal Winders resigned from the Parks Advisory Board. 4.1.2 Andrew Kinney applied for the Parks Advisory Board. 4.1.3 Fire District 16 sent their final budget. 4.1.4 The Mason County Treasurer sent a list of designated depositaries. 4.2 News Release: Barbara Adkins read a news release re: Planning Advisory Commission Vacancy. 4.3 News Release: Jeff Vrabel read a news release re: Parks &Trails Advisory Board Vacancies. 4.4 News Release: Chair Jeffreys read the news release re: Lewis-Mason-Thurston Area Agency on Aging. 4.5 Correspondence was received from Ken VanBuskirk on December 20, 2015 regarding Item 9.1 on the December 22, 2015 agenda. 5. Open Forum for Citizen Input—There was no citizen input. 6. Adoption of Agenda - Cmmr. Sheldon/Neatherlin moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye;J-aye. 7. Approval of Minutes— December 14, 2015 Briefing minutes and December 22, 2015 &January 5, 2016 regular meeting minutes. Cmmr. Neatherlin/Sheldon moved and seconded to approve . Motion carried unanimously. N-aye; S-aye;3-aye. 8. Approval of Action Agenda: 8.1 Approval of the Veterans Assistance Fund application for: Necessity Items $150.00 and Utilities $123.15 for a total of$273.15 as recommended by the Veterans Service Office. 8.2 Approval of Warrants : Claims Clearing fund Warrant 8034635-8035100 $2,433,129.06 Claims Clearing YTD total: $37,548,325.27 8.3 Approval for the Board to add and certify the Middle Skokomish School House to the Mason County Historic Registry. 8.4 Approval of the agreement with Perkins Coie LLP to allow Human Resources the ability to consult with a new law firm that specializes in labor and employment practices on extraordinary specialized and technical matters and to authorize the Chair to sign the agreement. 8.5 Approval for the Chair to sign an Interagency Agreement between Mason County and the Washington Department of Commerce for a Growth Management Act Update Grant in the amount of$48,000.00. The term of this agreement expire on June 30, 2016 and there are no matching funds required. 8.6 Approval for the Board to authorize the Public Works Director to sign a time extension letter agreement with Mason County Garbage for the hauling of drop box bins from the Belfair, Hoodsport and Union Drop Box Stations to the Shelton Transfer Station. In addition, this agreement would also address the annual increase of the hauling fees by 90% of the 2015 BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS January 12, 2016 - PAGE 2 CPI-U, which is equal to 1.08%. This contract will extend until a contract award is made or June 30, 2016, whichever comes first. 8.7 Approval to reappoint Andrew Kinney to the Mason County Parks &Trails Advisory Board for a 4-year term ending December 31, 2019. 8.8 Approval of the professional services agreement with Westsound Strategic Partners LLC for 2016 in the amount of$2,000.00 for legislative lobbying services. The terms of this service will commence on January 1, 2016 and shall terminate on December 31, 2016. 8.9 Approval to appoint Commissioner Terri Jeffreys to the Thurston Mason Behavioral Health Organization Governance Board for a period to begin January 2016 and end December 31, 2017. Cmmr. Sheldon asked about the document he received late regarding Item 8.8 and asked if the public has seen it. Chair Jeffreys said they didn't receive it until last evening. Mary Jean Hrbacek asked for Items 8.4 and 8.8 to be removed for additional discussion. Cmmr. Neatherlin/Sheldon moved and seconded to approve action items 8.1 through 8.9 with the removal of items 8.4 and 8.8 for separate votes. Motion carried unanimously. N-aye; S-aye; 3-aye. Cmmr. Sheldon thanked staff for providing excellent and interesting documentation regarding Item 8.3 pertaining to adding Middle Skokomish School House to the Mason County Historic Registry. Item 8.4 Approval of the agreement with Perkins Coie LLP to allow Human Resources the ability to consult with a new law firm that specializes in labor and employment practices on extraordinary specialized and technical matters and to authorize the Chair to sign the agreement. Dawn Twiddy spoke about this item. She said they have used Summit Law in the past although they would like to form a relationship with Perkins Coie LLP for consultations. Ms. Twiddy confirmed that there are no financial obligations at this time. Mary Jean Hrbacek said she wonders why Summit Law is not adequate and said she thought Mr. Kenny was hired for his HR experience. Dawn Twiddy said a conflict arose with Summit Law in 2015. Cmmr. Neatherlin responded to the comment about Bill Kenny. He said if they have a legal problem, they don't refer to the Human Resources Director. Cmmr. Deliberation: Cmmr. Neatherlin/Sheldon moved and seconded to approve action item 8.4 Approving the agreement with Perkins Cole LLP to allow Human Resources the ability to consult with a new law firm that specializes in labor and employment practices on extraordinary specialized and technical matters and to authorize the Chair to sign the agreement. Motion carried unanimously. N-aye; S-aye; 3-aye Item 8.8 Approval of the professional services agreement with Westsound Strategic Partners LLC for 2016 in the amount of $2,000.00 for legislative lobbying services. The terms of this service will commence on January 1, 2016 and shall terminate on December 31, 2016. Cmmr. Sheldon said the way this is written violates their policy. He added that this is complicated and not a budgeted item. He thinks this needs a lot more work rather than just an additional attachment. He said the public should have a chance to weigh in on this. Cmmr. Neatherlin said the wording can be changed to say "shall report to and maintain direct contact with the Chair of the Mason County Commission" instead of what it says now in order for clarification. Cmmr. Sheldon said he is against this but the other two can vote for it and spend the unbudgeted $2000.00 without public input. Mary Jean Hrbacek said there are already three people there representing Mason County. She considers this an insult to the public and a slam at Commissioner Sheldon. She is against this and there should be another way to address the legislature. She said this needs work and feels like something is not quite right. Cmmr. Deliberations: Cmmr. Sheldon said there are more effective ways to communicate with legislature. He takes issue on the way this was handled. He reiterated he will not support this. Cmmr. Neatherlin said he has found lobbyists work very well and have helped him in the past. Cmmr. Jeffreys read the scope of work in question. She said she worked has a lobbyist in the past and things are not as simple as you would think. She said she is in favor of having someone working on the County's behalf and being proactive. She said she is in favor of signing this. Cmmr. Neatherlin/Jeffreys moved and seconded to of the professional services agreement with Westsound Strategic Partners LLC for 2016 in the amount of $2,000.00 for legislative lobbying services. The terms of this service will commence on January 1, 2016 and shall terminate on December 31, 2016. Motion carried. N- aye; S-Nav; J-aye Cmmr. Sheldon said this is not serving the public. 9. 9:30 a.m. Public Hearings and Items Set for a Certain Time—There were no public hearings. 10. Other Business (Department Heads and Elected Officials) — 10.1 Treasurer Lisa Frazier read a news release announcing that Mason County Banking Services have been awarded to Columbia Bank beginning January 2016. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 12.
