January 5, 2016
1. Call to Order—The Chairperson called the regular meeting to order at 10:04 a.m.
2., Pledge of Allegiance— Chief Haugen led the flag salute.
3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim
Sheldon; Commissioner District 3 —Terri Jeffreys.
4. Correspondence and Organizational Business
4.1 Correspondence
4.1.1 Beards Cove residents sent a letter regarding neighborhood dumping.
4.1.2 Fire District 13 sent notification of new representatives.
4.1.3 Karl &Bev Black sent a letter of concern regarding flooding in the Skokomish Valley.
4.1.4 Ken Rasmussen sent correspondence regarding a code enforcement officer.
4.1.5 Liquor Control Board sent a special privilege application for Lake Limerick Country Club.
4.2 Selection of 2016 Chair and Vice-Chair
Cmmr. Neatherl in/Sheldon moved and seconded to approve Cmmr. Terri Jeffreys as
2016 Chair. Motion carried unanimously. N-aye; S-aye;J-aye.
Cmmr. Jeffreys/Neatherli n moved and seconded to approve Cmmr.Tim Sheldon as
2016 Vice Chair. Motion carried unanimously. N-aye; S-aye; J-aye.
5. Open Forum for Citizen Input—
5.1 Steve Bloomfield spoke about Graduation Matters and changing education patterns in Mason
County. He introduced Brenden Bensik and said he is the future of Mason County.
5.2 Brendan Bensik introduced himself and said he is the ASB President at Choice High School. He
invited everyone to the kick off the"Graduation Matters"event at the Civic Center.
Cmmr. Sheldon said he is proud of Mr. Bensik.
5.3 Charles Orthmann spoke about Father Joe.
6. Adoption of Agenda - Cmmr.Sheldon/Neatherlin moved and seconded to adopt the agenda
as published. Motion carried unanimously. N-aye; S-aye; J-aye.
7. Approval of Minutes— December 1 &8, 2015 regular meeting minutes
Cmmr. Neatherl in/Sheldon moved and seconded to approve the December 1 &8, 2015
regular meeting minutes. Motion carried unanimously. N-aye; S-aye;J-aye.
8. Approval of Action Agenda:
8.1 Approval of the resolution for the Teamsters Probation Services Collective Bargaining agreement
to participate in the Washington State Insurance plans through the Public Employees Benefits
Board (PEBB). Resolution 01-16 (Exhibit A)
8.2 Approval to appoint Frank Benavente to the Mason County Housing Authority Board of
Commissioners filling a vacated term that ends July 1, 2016

8.4 Approval for the Board to sign the Interlocal Levy Agreement between Mason County and the
Shelton Metropolitan Park District(MPD). The MPD has been declared by Resolution that a
regular property tax is authorized for collection in 2016.
8.5 Approval of the Veterans Assistance Fund applications for: Utilities $443.95 as recommended by
the Veterans Service Office.
8.6 Approval of the Professional Services Agreement with Robert D. Sauerlender as Court
Commissioner for a term beginning Jan 1, 2016 and ending December 31, 2016,
8.7 Approval of the Interlocal Agreement between Mason County and Lewis County allowing Mason
County Jail to utilize Lewis County Jail to hold Mason County offenders due to the lack of space
at the Mason County Jail and per RCW 39.34.080.
Cmmr. Neatherlin/Sheldon moved and seconded to approve action agenda item
except for item 8.2,8.4, and 8.6 which will be removed for s separate vote. Motion
carried unanimously. N-aye; S-aye; 3-aye
Questions:
Cmmr. Sheldon asked about Item 8.4 and sought clarification regarding the levy shift. He
asked if it may be better to take the money from ending fund balance since 9% is expensive.
Frank Pinter clarified the levy shift.
Item 8.2 Approval to appoint Frank Benavente to the Mason County Housing Authority
Board of Commissioners filling a vacated term that ends July 1, 2016
Cmmr. Sheldon said he is not in favor of Mr. Benavente due some past financial issues
including an investigation by the State Auditor. He said he has already shared his opinion
during the briefings. He feels Mr. Benavente has not demonstrated his ability to be a good
manager. He strongly objects to appointing Mr. Benavente and thinks we can find someone
better suited for the position. Cmmr. Sheldon stated he is not trying to slander but they are
the facts. He stated that District 2 could be better served by a different choice.
Cmmr. Neatherlin said everything he has ever seen of Mr. Benavente has been fine and he
would have appreciated it if Cmmr. Sheldon would have shared this information earlier.
Cmmr. Sheldon suggested perhaps tabling this item would give them a chance to check with
the Port Commission and read the State Auditor findings.
Cmmr. Neatherlin/Sheldon moved and seconded to table this item to January 19,
2016 BOCC meeting. Motion carried unanimously. N-aye; S-aye;]-aye.

Item 8.4 Approval for the Board to sign the Interlocal Levy Agreement between Mason
County and the Shelton Metropolitan Park District (MPD). The MPD has been declared by
Resolution that a regular property tax is authorized for collection in 2016.
Cmmr. Sheldon said this is not necessary and it sets a bad precedence. He reiterated that
this cannot be explained to the public very well and it's difficult to understand. He said this
doesn't seem like a good financial transaction and he will again oppose this.
Cmmr. Jeffreys said she is comfortable with this and it has happened in other counties as
well.
Cmmr. N eatherl in/Jeffreys moved and seconded to approve the Board to sign the

Item 8.6 Approval of the Professional Services Agreement with Robert D. Sauerlender as
Court Commissioner for a term beginning Jan 1, 2016 and ending December 31, 2016.
Judge Toni Sheldon spoke about this item. The Court is asking that this contract be
renewed.
Testimony:
Tom Davis asked that this item be tabled for one week to look at how this came to be. He
feels a resolution is appropriate. He said this was just briefed yesterday so he feels this is
rushed. He said it brings up concerns about transparency when items are briefed and then
placed on the agenda within 24 hours.
Cmmr. Sheldon told Mr. Davis it appears that he is trying to take this to a different level to
cover a lot of other items. He reminded Mr. Davis that item 8.6 is about a Professional
Services Agreement.
Tom Davis said he would like this item tabled.
Cmmr. Discussion:
Cmmr. Sheldon said they have no control over the Salary Commission. He said he would feel
uncomfortable about Mr. Sauerlender working without a contract.
Judge Sheldon said she feels she would like to see a contract approved today.
It was agreed to approve the contract until June 30, 2016 instead of December 31, 2016.
Cmmr. Sheldon/Neatherlin moved and seconded to approve the Professional
Services Agreement with Robert D. Sauerlender as Court Commissioner for a term
beginning Jan 1, 2016 and ending June 30, 2016. Motion carried unanimously.

Motion carried unanimously. N-aye; S-aye; 3-aye.
9. 10:30 a.m. Public Hearings and Items Set for a Certain Time—There were no public hearings.
10. Other Business (Department Heads and Elected Officials) —
10.1 Justin Smith spoke about Master Gardeners and 4-H. Mason Gardners will be doing
workshops at Memorial Hall soon. There are also opportunities for the community to find out more
about 4-H.
10.2 Undersheriff Barrett said some information regarding the levy shift information seems to be
stating that it was done to correct over diverting pertaining to traffic policing funds and he would
like clarification. He said clarification needs to be made for the public because it appears they
didn't do their diversion properly when in fact their efforts go above and beyond. Furthermore, he
encourages the Board to allow a Salary Commission set the salary for the Mason County Elected
Officials.
Cmmr. Neatherlin clarified what is meant by over diversion and told Undersheriff Barrett that they
did their diversion properly.
Cmmr. Jeffreys said she is hesitant to use a Salary Commission because there needs to be the
ability to pay. The salary survey on Elected Official has been done and is available and they are
very aware of the salary comps. She said she would like to pay the Sheriff more although there is
no money.
11. Board's Reports and Calendar-The Commissioners reported on meetings attended the past week
and announced their upcoming weekly meetings.
12. Adjournment—The meeting adjourned at 11:15 a.m.

RESOLUTION NO.
MASON COUNTY'S TEAMSTERS PROBATION SERVICES COLLECTIVE
BARGAINING UNIT ARE REQUESTING REVIEW BY
THE HEALTH CARE AUTHORITY TO
PARTICIPATE IN THE WASHINGTON STATE INSURANCE PLANS
WHEREAS,the Health Care Authority administers the medical; dental,life, and long
term disability insurance coverage for the employees of the state of Washington, as set
forth in chapter 41.05 RCW; and,
WHEREAS, Mason County representing the Teamsters Probation Services Collective
Bargaining Unit has reviewed the state insurance plans, chapter 41.05 RCW, RCW
41.04.205,chapter 182-08 WAC; and chapter 182-12 WAC; and,
WHEREAS,we deem the state insurance plans as providing desirable insurance coverage
for the employees of Mason County employees; and,
WHEREAS, we certify that all employees enrolled are eligible to participate in the state
insurance plans;
BE IT RESOLVED, that the Board of County Commissioners does hereby request
approval by the Health Care Authority to allow participation in the state insurance plans
for the employees of the Teamsters Probation Services Collective Bargaining Unit,
subject to the requirement of RCW 41.04.205 and the rules adopted thereunder.
