Three construction elements: 1) Extension of two stormwater outfalls from existing shoreline near MHHW to intertidal depths below -3 ft MLLW. 2) Repair modification of existing marine float to provide an oufall extension corridor and improve aqautic habitat. 3) Beach restoration and intertidal habitat improvements. This permit,with conditions, is granted pursuant to the Mason County Resource Ordinance(Chapter 17.01 MCC.) Nothing in this permit shall excuse the applicant from compliance with any other federal, state,or local statutes, ordinances, or regulations applicable to this project. This permit may be rescinded if the permitee fails to complete the project as proposed or fails to comply with the standards of this ordinance. All recommendations made within Section 8 of the Biological Assessment/Evaluation prepared by Allison Reak of Sea-Run Consulting and dated December 2007 with Addendum dated April 2008, are to be implemented throughout the project. 2.) During construction, all releases of oils, hydraulic fluids, fuels, other petroleum products, paints, solvents and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state. The cleanup of spills should take precedence over other work on the site. 3.) Construction debris must be safely managed especially if it contains painted wood or concrete, teated wood or other possibly dangerous materials.All dock materials not suitable for re-use will be disposed of at a permitted upland waste facility. 4.) Proper disposal of construction debris must be on land in such a manner that debris cannot enter or cause water quality degredation to Hood Canal or Alderbrook Creek. 5.) Water quality is not to be degraded to the detriment of the aquatic environment as a result of the project. 6.) Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent stormwater runoff from carrying soil and other pollutants into surface water or storm drains that lead to waters of the state. Sand, silt, clay particles and soil will damage aquatic habitat and are considered to be pollutants. 7.) Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48, Water Pollution Control and WAC 173-201A. The project proposes to extend two stormwater outfalls from the current discharge elevations on Hood Canal shoreline at MHHW to depths below-3 ft MLLW and to route the eastern outfall extension between oyster beds under the existing dock. To accommodate the eastern outfall extension,the floating dock will be removed and replaced with a modified dock that will offer significant environmental benefits and recover intertidal habitat. The dock is over 40 years old and failing due to long-term wear, normal disintegration, and the elements. The dock cannot be removed and replaced without failing, so a new dock will be constructed within the same footprint. The proposed dock replacement is a normal repair activity for wood structures in the marine environment, damaged by the elements(in this case, wood rot and disintegration), per WAC 173-27-040 2(b). Without these repairs,the pier can no longer perform its established function or use in providing public boat access between Hood Canal, the shoreline, and the resort. The project proposes normal repairs to restore the dock to its original condition, including size, shape, configuration, location and external appearance, with exceptions made to accommodate environmental considerations and avoid adverse effects to shoreline resources. The exceptions are: 1) installation of 48 pile stops to eliminate all dock area that currently rests on the beach at low tide, recovering about 3,025 ft2 of substrate, 2)replacement of about 5,234 ft2(0.12 ac)of old solid decking with grated decking to improve marine habitat through increased light transmission, 3) replacement of about 10,136 ft2 of existing chemically preserved wood with a chemically inert, recycled wood-composite material (e.g., Trex®), and 4)replacement of 21 existing creosote-treated wood piles with 21 galvanized steel piles. The new piles will be installed adjacent to,but slightly outboard of, the old piles to accommodate the attachment collars. Some piles may be shifted to better support dock sections. The proposed design, materials, and construction methods are standard or above-standard for this type of structure in the marine environment.
