It is a proposal to fill approximately 10,000 cy in an area of approximately 175'by 195' on Borgault Road in the Skokomish Valley. The fill is for elevation of an existing residence. Within this area would be l6cated the existing house. A barn and what appears to be a pump house are also shown on the plan; the latter structures may not currently exist on site. The filled area would be raised a minimum of 8 feet above the surrounding grade per the site plan. A one-page letter stamped by an engineer was included which recommends some fill specifications. The engineer makes no reference to certifying that this fill will or will not affect the BFE. The site is within an area identified in the CFHMP as having 100-year flood depths of greater than 4 feet. Assessor's records indicate there is a residential structure on the site, built.in 1965. There does not appear to be any reference to a change in structure or a time period when there was no structure, except that a deck on the back is no longer there, and there was water damage by flood. A structure is also shown at this location on the KCM map produced as part of the CFHMP for the Skokomish River. Applicability of flood related ordinances: Mason County Flood Damage Prevention Ordinance no. 59-91 Section 5.4(5) states: "Any fill that is allowed in the special flood risk zone shall be confined to the actual building site. Other means of elevating structures shall be encouraged such as posts,piles, and stem walls." On June 17, 1997 Mason County BCC adopted an amendment to the Flood Ordinance which contained the following requirement: "Fill for the elevation of structures shall be prohibited unless certification by a registered professional engineer or architect is provided demonstrating that the fill shall not result in any increase in flood levels during the occurrence of the base flood discharge" (conclusion#3). On September 26, 1997 Mason County BCC adopted a resolution placing a moratorium on "construction of any new structure, as defined in the FDPO #59-91 shall not be allowed in the Skokomish River Valley within the 100 year flood plain... "the resolution further states: "the area of the footprint of the structure following reconstruction shall be no greater that the areas of the footprints prior to reconstruction. A footprint is defined as the total area of the first floor of a structure, regardless of how the structure is supported. " Structure is defined in the referenced ordinance as "a walled or roofed building including a gas or liquid storage tank that is principally above the ground " (3/3/98 extended to June 23, 1998). ANALYSIS Even though there is currently a construction moratorium in the Skokomish River Floodplain, Mr. Tozier may elevate his existing structure, as long as he stays within the "no new footprint requirement," based on the Skokomish moratorium. Elevation using the existing building footprint as a limit would be permitted even during the moratorium. The difficulty in this particular case arises because the applicant wants to use fill and extend beyond his footprint. Recommended Choice Given that the existing footprint is defined as the total area of first floor of a structure (see above), the approach most consistent with current regulations would be to require the applicant to elevate using a concrete foundation stem wall, rather than fill. Alternate Choice The applicant has expressed a desire to use fill instead of an elevated foundation wall because of cost, and the recently submitted.grading application is for this purpose. Fill beyond the existing footprint would not be consistent with the current moratorium "footprint" requirement, however fill for elevation is not necessarily ruled out within the Frequently Flooded Areas chapter. Given this, if fill for elevation were a possibility, it would be prudent to limit the fill scale to the minimum necessary to achieve the appropriate flood elevation. The building code requirements for fill side slope, and the appropriate engineer recommendations would guide. However, in this location the fill choice is complicated by the high elevations of flood waters -- greater than 4 feet for 100-year floods. Higher fill means a correspondingly greater increase in fill "footprint." The proposed site plan shows 8-foot minimum as the fill height. The fill must also meet the the requirements of the Findings and Conclusions adopted by the BCC on 17th June 1997: "Fill for the elevation of structures shall be prohibited unless certification by a registered professional engineer to architect is provided demonstrating that the fill shall not result in any increase in flood levels during the occurrence of the base flood discharge." Because the structure is within the 100-year floodplain, elevation certification would be required. Any future proposal to increase the fill area beyond the minimum necessary to elevate their structure (i.e. if the current moratorium was lifted), then the fill would need to meet the scale and length requirements within the Frequently Flooded Areas Ordinance. These are the same requirements ultimately proposed in the revisions to the FDPO. There is not enough detail on the site plan to tell if even minimum footprint fill would exceed the FDPO requirements. i D R A F T 19 9 8 ' J Art Tozier 110 Mill Street Shelton, WA 98584 RE: Permit no. : GRD98-0001, proposal to elevate existing residence using fill . We recently met with you and your engineer Tom Richl, P.E.) on May 26, 1998., to discuss revisions to your proposal (as requested by letter dated May 21, 1998) . Your building setbacks are approximately 480-. and 39%. Under normal circumstances the 39% setback would not be permitted and the proposed site plan would need to be revised. In this case, because an existing structure is being raised, and the total fill setbacks average out to greater than 41 . 5% (average of 43 .5%) , an ,administrative determination has been made that the proposal generally meets the setback requirement. Please note that if this were a new structure, approximating the setback percentages would not be possible, and strict adherence to the setback requirement would be necessary. 2 . FUTURE DEVELOPMENT: (Parcel is 3 .25 acres per Mason County Assessor) . Please note that while the current project meets the requirements of the Frequently Flooded Areas Chapter, the 316 limit of development area is taken up with this project. It is important ,r,�, isles youP'understand that under the current regulations, your maximum area of development for this site has been utilized by this project . At our recent meeting, you had expressed interest in purchasing adjacent property and performing a Boundary Line Adjustment to increase your acreage. Doing so would increase the ar feet of allowable development, because the amount of square Z eet in o of the larger acreage would increase accordingly. Another option might be to reconsider the possibility of elevating your house on a concrete foundation, to use less of your 3%. 3 . OTHER INFORMATION NEEDED TO COMPLETE THIS APPLICATION: a. Dear Mr. Tozier: Mason County Department of Community Development staff are currently reviewing your land modification permit application to fill for the purposes of elevating a residential structure located at 401 West Borgault Road. Last year you submitted a building permit application for the structure elevation, and met with Mason County Planning Department to discuss requirements for additional information needed to process the permit . I understand from Gary Yando that you were also holding off on providing the additional material because you were waiting for grant funding for elevation. The information below is also intended to provide a brief overview of flood regulation updates and FEMA map revision status as each relates to the Skokomish Valley. FLOODPLAIN REGULATIONS AND FEMA MAP REVISIONS As you are aware, flooding in the Skokomish Valley has undergone extensive study - - the most recent study document addressing the issues is the Mason County Skokomish River Comprehensive Flood Hazard Management Plan (CFHMP) , dated February 1997. On September 23 , 1997 Mason County adopted revisions to its Frequently Flooded Areas (FFA) Chapter 17.01.090 of the Mason County Interim Resource Ordinance. The revisions (attached) included flood regulations for development in the Skokomish Valley which reflect certain recommendations of the CFHMP. A Density Flood Fringe has been implemented in the Skokomish River floodplain detailed study area, and very specific regulations guide in the review of development within this area. In September of 1997, FEMA provided our community with a preliminary revised Flood Insurance Study report and preliminary revised Flood Insurance Rate Map (s) for the Skokomish River. FEMA' s 90-day comment period for the map revisions began immediately after February 26, 1998 . FEMA has informed us that they received no valid requests for changes in the Base Flood Elevations, which therefore become effective on December 8, 1998 . From that date the county has six months to revise its existing Flood Damage Prevention Ordinance. In the meantime we have asked Chuck Steele of FEMA in Seattle whether it is appropriate to begin using the revised maps, since they reflect a more restrictive BFE than the earlier ones, and we have FFA Chapter regulations in effect which specifically address development in the Skokomish Valley. FEMA has informed us that it is quite appropriate to use the more recent maps, since the revised BFE is in essence a more restrictive level of regulation within the floodplain. As you are probably aware, Mason County currently has a moratorium on new residential development in the FEMA detailed study area of the Skokomish Valley, however existing structures may be elevated. SEP98-0084 - - CONSISTENCY WITH FLOOD REGULATIONS Mr. Tozier's proposal to elevate an existing residence on fill was required to meet regulations for elevation of structures located within the Density Flood Fringe of the Skokomish River valley, as set forth in Mason County's FFA Chapter 17.01.090 of the Interim Resource Ordinance (attached) . This included requirements for setback, percentage of lot coverage for development, setbacks relative to the water flow, and engineering analysis of the impact of this development on flooding. In fact, the applicant 's proposal underwent a series of revisions until the project was consistent with the applicable regulations . I would also like to clarify that Mason County did ask the applicant to consider other means of elevation, however he chose to elevate with fill in a way which meets our regulations. Neither FEMA elevation requirements nor Mason County's FFA Chapter prohibit fill for the elevation of existing structures, as long as regulatory requirements are met. We have already contacted Dan Sokol of DOE to respond to his questions in relation to this proposal, i.e. clarifying that this proposal does meet the applicable regulations . C. Setback Percentage: Chapter 17 . 01 . 090D4a (4) provides that structures on adjacent parcels of 5 acres or less shall meet a building setback of 41 . 5% as drawn perpendicular to the flow. Your building setbacks are approximately 48% and 39%. Under normal circumstances the 39% setback would not be permitted and the proposed site plan would need to be revised. In this case, because an existing structure is being raised, and the total fill setbacks average out to greater than 41.5% (average of 43 .5%) , an f administrative determination has been made that the proposal generally meets the setback requirement. Please note that if this were a new structure being placed on fill, approximating the development setback percentages would not be possible, and strict adherence to the setback requirement would be necessary. 2 . FUTURE DEVELOPMENT: (Parcel is 3 .25 acres per Mason County Assessor) . Please note that while the current project meets the requirements of the Frequently Flooded Areas Chapter, the 3% limit of development area is taken up with this project. It is important for you to understand that under the current regulations, your maximum area of development for this site has been utilized by this project. At our recent meeting, you had expressed interest in purchasing adjacent property and performing a Boundary Line Adjustment to increase your acreage. Doing so would increase the square footage of allowable development, because the amount of square footage in 3% of the larger acreage would increase accordingly. And while I was aware of the FEMA map study,the information you provided about comment periods and specifically how the revised maps are applicable now was all news to me. Dan Sokol suggested that,for those property owners who pursue fill as an elevation method,an evaluation of the potential for scour or erosion of the fill pad be included in engineering studies conducted for the applicants. The County might also consider requiring such evaluations as a matter of course,to identify areas of potential velocity flows and the concomitant hazards. I believe Ecology's shorelands concerns about this project,as expressed in my comments under SEPA,have been cleared up by the information you provided.
