Parcel #42115-32-00100 Dear Mr. Tozier: The Department of Community Development has reviewed the Environmental Checklist and site plan which you submitted as part of an application to place a landfill berm under your residence and the building permit application to place a new foundation under the home. It appears on the recently submitted site plan that the residence will be raised on pilings. At this time, our Department recommends that the residence be placed on piling and the fill be eliminated from the proposal. As you may be aware since the installation of Kim and Evan' s fill, we have received some concerns regarding the bringing of fill into the area of the valley for flood protection of the residence. The controversy arises during the transition period between the current Flood Damage Prevention , Ordinance Interim Regulations for the Skokomish Flood Risk Zone and the new Comprehensive Flood Hazard Management Plan. We respectfully request at this time that you submit a proposal for placement of your residence on piling and/or foundation which meets current Flood Damage Prevention Ordinance requirements including all openings and anchoring. OF C ITY DEVELOPMENT CC: Grace Miller, Planner Kelly Mayo, Bldg Dept . kecycled G , f ORDINANCE N0.40-97 IN THE MATTER OF: Enacting an interim measure which will establish an amendment to Ordinance No. 59-91, the Flood Damage Prevention Ordinance the Ordinance No.40-97 shall be in effect .for six months, from date of approval, or until the update of the Flood Damage Prevention Ordinance isocompleted om letediand revised by the action of the Mason County Board s; and WHEREAS, on May 23, 1991 the Mason County Board of Commissioners adopted the Flood Damage Prevention Ordinance Number 59-91; and WHEREAS, Mason County was reinstated into the National Flood Insurance Program upon adoption of Ordinance No. 59-91; and WHEREAS, the ordinance is to promote the public health, safety, by and general welfare, n�ndntfloodlhazarduareasaof MasontCountyesand regulating developme WHEREAS, specific areas in the County of Mason are subject to periodic flooding from streams and rivers resulting in serious damages to properties within these areas; and lude as WHEREAS, in Ordinance No. 5g-91 tsections Emergencywere ManagementdAgency required for approval by the Federal and Department of Ecology. These sections are: Section 5 .3 states; located within areas of special flood hazard established in Section 3 .2 are areas designated as floodways . Since the floodway is an extremely hazardous area due to the velocity of flood waters which carry debris, potential projectiles, and erosion potential, provisions were included that apply except to that zone of special flood risk, Skokomish River Valley as defined in Section 2 . 0 . The first provision(three provisions were included) in Section roachments are prohibited 5 . 3 , points out that enc including fill , new construction, substantial improvements, and other development unless certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result .oflthe any baseincrease flood discha�gelevels during the occurrence Page 2 : Section 5 .4 ; this section applies to that area of the Skokomish River Valley identified by the Federal Emergency Management Agency and sets forth Interim Regulations that shall apply to this area. These interim regulations shall be replaced using a comprehensive planning process which recognizes that role of diking in flood control management efforts . Interim shall be defined as that period of time between the adoption of this ordinance and the adoption of a Skokomish River Watershed Flood Control Comprehensive Plan and subsequent amendments to these regulations . Nine provisions were included in this section. However, no requirement was included which provided for a certification by a registered professional engineer or architect wherein they would certify that encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge. WHEREAS, Mason County has completed and adopted a Skokomish River Comprehensive Flood Hazard Management Plan (Plan) and is currently developing an ordinance which will implement the contents of said Plan; and WHEREAS, in the proposed ordinance, any development in the density floodway will have to comply with all floodproofing and elevation requirements set forth for all development in the floodplain. Fill, when used for elevation will need to comply with the following standards; (1,) the fill shall not exceed 3 percent of the land area of that portion of the lot located in the density floodplain; (2) the maximum width (sum of widths) of all fill shall not exceed 17 percent of the length of the line drawn perpendicular to the known flood water flow direction at the point where the fill is located; and WHEREAS, the proposed ordinance is not expected to be approved for approximately six months and therefore is not implementable at this time; and WHEREAS, Mason County is currently receiving requests for the placement of fill material for the elevation of structures; and WHEREAS, Mason County has no current means of determining if the placement of the fill will cause more than a 0 . 5 foot rise in the base flood elevation as set forth in the Plan; NOW THEREFORE BE IT RESOLVED THAT: The Mason County Board of Commissioners herein amend Ordinance 59-91, Sections 5 . 3 and 5 . 4 to include the following (the remainder of Ordinance 59-91 remains in full effect) . 1 Page 3 : * SECTION 5 . 3 is amended to read: (1) -Encroachments are prohibited including fill, new construction, substantial improvements, and other development unless certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result in any appreciable increase in flood levels during the occurrence of the base flood discharge. * SECTION 5 .4 is amended to add: (10) -Fill for the elevation of structures shall be prohibited unless certification by a registered professional engineer or architect is provided demonstrating that the fill shall not result in any appreciable increase in flood levels during the occurrence of Z� 1 the base flood discharge. Dear Mr. Tozier: This letter is meant to clarify the requirements for the construction of a foundation for your residence and the installation of landfill to elevate the structure for floodproofing. FOUNDATION• 1) The plans that you submitted with your building permit application were engineered by MC Squared (dated 9/9/96) for a column design foundation. The engineering was required for the foundation by the . Building Department and was accepted by the Building and Planning Departments. The Building Department did require structural calculations that were to accompany the drawings. The calculations have not been submitted to date. 2) If you are now proposing a standard prescriptive foundation (footing & stem wall) , Structural Plans need to be submitted. The Plans have to be drawn to scale and all structural details will need to be shown on them. The Plans will need to show compliance with the Flood Damage Prevention Ordinance for anchoring and the Building Code requirements showing that the walls will be resistant to water pressure. 3) If a new and different foundation is proposed and it is not a prescriptive path foundation, the entire foundation must be engineered as required by the Building Department. For example, if you were to propose a new foundation other than the plans we have on file (that were engineered) , the entire foundation must be engineered. LANDFILL AND ROCK WALLS : 1) The Building Department will not allow a structure on landfill unless the fill is: gineered - The Engineered drawings for the fill and rock taining walls have to be designed by a Certified Washington State Engineer. AND b) Certified for Compaction - The fill will have to be Certified by a Washington State Testing Lab for Compaction. 2) The Mason County Flood Damage Prevention Ordinance Provision #10 of Section 5 .4 (as amended) states that "Fill for the elevation of structures shall be prohibited UNLESS certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge. " Therefore, in order to install the fill to elevate the structure, Certification by a registered professional engineer or architect must be provided demonstrating that the fill shall not result in any increase in flood levels during the occurrence of the base flood discharge. 3) In the Fall of 1996 you indicated to the Building and Planning j Departments that you wanted to install fill to elevate the structure. At that time, both Departments explained that a Land i Modification Permit with engineered drawings would be required. 4) There is no appeal process to the Building Code requirements . There is an Appeal Process Section 4 .4-1 to the Flood Damage Prevention Ordinance. PROPOSED FOUNDATION AND FILL: 1) In addition, for the residence to be placed on a foundation, a completed Flood Elevation Certificate must be submitted to our Department to be kept with the property file. section 5 .4 (1) of the Flood Damage Prevention Ordinance requires that the lowest floor of the residence shall be elevated one foot or more above the base flood elevation and shall be constructed according to the standards provided in subsections 5 . 1, 1-5 and 5 .2 , 1-4 . 2) Section 5 .4 (5) of the Flood Damage Ordinance states that the fill shall be confined to the actual building site. " It goes on to state that "Other means of elevating structures shall be encouraged such as posts piles and stem walls .
