It is not clear whether you were submitting these plans as a new permit application or as a revision to BLD2009-00217,which was submitted March 26,2009 as a result of enforcement action and violation notices mailed to you for converting the existing garage to living space, adding a 12-ft x 15-ft storage/mechanical room and two 14-ft x 10-ft covered decks. As you mayrecall,the 2009 application was placed on `hold' (and eventually expired)for the following reasons: 1. The construction plans were deemed incomplete, and on April 2,2009 a letter was prepared that included a list of items needed in order to complete the Building Department review. A new Building Permit Application shall be required to address the non-permitted remodel and additions included in the building permit BLD2009-00217 and the proposed 2-story garage addition. 2. Expansion of the square foot area of an existing structure is prohibited in the Skokomish River floodway. The approved FEMA Letter of Map Amendment required to retain the proposed(and already constructed) covered decks and mechanical/storage room was requested in a letter dated April 8,2009 but has not been submitted to the County. 3. Reconstruction of residential structures is prohibited within designated floodways, except for repairs,_reconstruction,or improvements which do not increase the ground floor area; and repairs,reconstruction, or improvements,the cost of which does not exceed 50 percent of the fair market value of the structure either,(a)before the repair, reconstruction, or repair is started, or(b)if the structure has been damaged, and is being t restored, before the damage occurred. In the letter dated April 8,2009,the Planning Department requested a written estimate of market value(prior to remodel)and a written cost estimate for the construction that meets FEMA standards,but did not receive this document. Since BLD2009-00217 had long since expired,we would process the recent submittal as a new Building Permit Application. However,before we collect the initial fees, as a courtesy we would like to make it clear that the permit for the home remodel and/or the two-story garage addition is incomplete for the following reasons. 1. The proposed addition is supported by fill for which a permit(GRD2006-00018)has not been`fmaled' and has expired. 2. The original scope of the fill footprint/volume reviewed per the 1998 SEPA Determination of Non-Significance has been significantly exceeded and requires a SEPA revision for proper environmental review. A SEPA review is required that revises the 1998 checklist to include the fill applied for in the original 1998 application and all fill added since. 3. The proposed addition is supported by a retaining wall for which a permit(BLD2009- 00212)has not been issued and has expired. 4. The proposed addition is within the floodplain and floodway of the Skokomish River where residential development is prohibited per MCC 8.52.130. Prior to any development of substantial improvement, a Letter of Map Amendment approved by FEMA shall be submitted showing that the filled area is no longer located within the mapped floodplain. 5. The proposed addition is within Skokomish River's regulated shorelands (per the.Mason County Shoreline Master Program all floodways are shorelands). Development activities within shorelands require a Substantial Development Permit,, s e q p mu ,unless exempt per WAC 173-27-040. Although commonly single-family residential construction is shoreline `exempt,' this development does not meet"all requirements of the state agency or local government having jurisdiction thereof' as outlined in this letter. The Planning Department will need to consult with the Washington Department of Ecology to determine if a Shoreline Variance will also be required. 6. Two things were observed on the proposed plans that will need to be corrected or addressed. The upper floor shall require a fire separation in accordance with the 2009 International Residential Code,which may include a wall and/or a 20-minute rated door. The occupants cannot exit through the garage from the upper floor. In addition compliance to the 2009 Washington State Energy Code(WSEC)shall be required for the non-permitted remodel and addition and the heated spaces of the proposed 2-story garage. There may be additional corrections when the building department performs their review. Please submit a completed WSEC form. If you would like to proceed with the application submitted on May 31s',2012,please submit any outstanding fees associated with prior cases,the initial permit fees for the new building permit review,a Letter of Map Amendment approved by FEMA,a complete SEPA Checklist for the grading performed on the site,and a Land Modification Permit(grading permit)Application for the fill added in excess of that approved in the 1998 permit, a"No Rise"report that meets FEMA requirements,and a Shoreline Substantial Development Permit Application. Upon receiving these items,the County will proceed with the development review. If you choose to not submit complete permit applications for the development that has already taken place without approvals, a public hearing may then be held in accordance with Title 15 and civil penalties or fines may be imposed. It is apparent that the Department cannot sign this form until we receive and conditionally approve of the required Grading, Building Permit (for retaining wall) , SEPA, and Shoreline Substantial Development and Conditional Use Permit required and outlined in the letter dated June 20th, 2012. Upon said permits being issued, they would be conditioned so that occupancy will not be granted until the LOMR-F is approved by FEMA, and also conditioned so that if the LOMR-F is denied, that the permits are canceled. And according to the Acknowledgment Form, prior to signing it, we would also need a Habitat Management Plan (assessing and mitigating for any impacts to endangered species) prepared by a qualified biologist, a No Rise Certification that meets FEMA's requirements, a stamped/signed statement from the engineer who prepares the No Rise Cert that the property is reasonable safe from flooding as defined in 44 CFR 65.2 (c) , and the required documents listed on the MT-1 Property Information Form.
