Dear Mr. Stillwell,
Thank you for your comments, dated June 9, 2003,regarding Mason County Resource Ordinance
Variance,VAR 2002-00037, Gateaway Treehouse project. Planning staff has considered these
comments, and with all due respect, does not feel that they would change our recommendation.
Staff s preliminary finding is part of the development review process per the Mason County
Resource Ordinance Chapter 17.01.120(2). In order for the County to reach a decision regarding
the project, due process must take place.The comments submitted by your office, on June 9,
2003, would be included as part of the record.
Staff also offers that due consideration be given to alternate sites for the proposed project outside
the stream buffer and other setbacks,which would not require a Resource Ordinance Variance
review and public process. If you wish to reconsider the placement of the proposed project, staff
would be happy to assist in determining alternate locations and appropriate permits.

Craig,
Thanks for your patience, your phone message is on my list to respond today - however email contact is
a great way to get questions answered quickly, as long as we're both near a computer.
Your application hasn't reached my desk yet, but I understand from the permit planner that you turned
one in - I look forward to reviewing it. Given that, below is an overview type response to your questions.
a) What is the procedure/timeline from this point forward(publication, public hearing, etc)
First we review the submitted application to determine if its complete -there's a 28 day period for that,
and we will contact you in that time if we are missing anything, then the actual review process starts.
The HMP is sent out to agencies and the area Tribe for review, comment period is 28 days. Within that
review timeframe we initiate the public process, which includes public notice in the paper, with a 30 day
comment period, then a public meeting before the Planning Commission is set (2wk notice)than a public
hearing before the Board of Mason County Commissioners (2wk notice) at which the final decision is
made. I'll be able to better discuss timelines and scheduling that will work with you and your client once I
have had an opportunity to review the application.
b) Is information submitted sufficient(excluding the HMP) or does the Country require additional
information at this time
Again, I'll need to review the info then respond more completely to this question... Generally we are
looking for both the necessary documents & materials, and content.
Re: documents etc. for the Mason Environmental Permit Variance process- Mason Environmental
Permit and Variance application, release for publication costs, adjacent property owners within 300 feet
of property boundary (if several parcels in same ownership, then within 300 ft of the boundary of the
whole ownership), site plan, vicinity map, elevation plan (profile), any additional plan/detail necessary to
understand the project, and the Habitat Management Plan. If during our review it appears additional
material is needed we'll request it at that time.
Re: content, I can give you a better answer once I have reviewed the application.

review the application and the HMP, I'll need to do a site visit.

I'm Craig Stillwell, the architect coordinating the variance application for the accessory structure at East
6791 Highway 106 in Union.
I submitted documents on Monday, June 10, for both a Building Permit and Variance.
I also submitted a letter requesting deferred submittal of the Habitat Management Plan which is currently
being developed.
(I have been told that this was an approach discussed during your meeting with Joseph Gellings)
At the time of the submittal the Planning Tech at the counter referred me to you as a source of answers
for questions that he was unable to answer. I tried to reach you that afternoon but ended up leaving a
message your voice mail.

The following questions have been asked by my client:

Thanks for the reply. I am doing a little further research on your question - could you give me a little
more detail? What kind of equipment, what quantity?
This area is under the jurisdiction of the Mason County Shoreline Master Program (development and
structure setbacks from the shoreline of Hood Canal), as well as the provisions for stream buffers and
setbacks that you are aware of from the Fish and Wildlife Habitat Conservation Area Chapter of the
Mason County Resource Ordinance (buffer setbacks and structure setbacks from Dalby Creek and the
Hood Canal).
So I'll need a little more information to research the question, and provide you with an answer.

The Owners of East 6791 Highway 106 in Union (the same location as our variance)
have asked if it is okay to put playground equipment (swings, slide, climbing bars, similar)
on the existing lawn on the north side of the existing residence (between the house &the bulkhead)
If you refer to the setback diagrams submitted with the variance application for the accessory structure
you will see that this existing lawn is in the shoreline setback and partially in the stream buffer&setback
I combed the code and was unable to find anything permitting or prohibiting this type of equipment in the
proposed location

Dear Mr. Stillwell,
Per our telephone conversation,May 2,2003,I am enclosing a copy of the Mason County Resource
Ordinance Variance criteria(17.01.150 E). At your request,the Department of Community Development
planning staff has reviewed the variance application and supplemental information for Resource Variance
2002-00037,Gateway Treehouse,prior to further action. Planning staff s preliminary determination to
recommend denial of the proposed project has not been altered. Specifically,this determination is based
principally on review standards three and five:
"The granting of the variance must be necessary for the reasonable use of the land or building and the
variance as granted by the County is the minimum variance that shall accomplish this purpose. The
findings shall fully set forth the circumstances by which this Chapter would deprive the applicant of a
reasonable use of the land. Mere loss in value shall not justify a variation."
"The granting of the variance shall not confer on the applicant any special privilege that is denied by this
Chapter to other lands or buildings in the same designation"
The purpose of a Resource Ordinance Variance is to allow the County to consider requests where the strict
application of said standards would deprive property owners of reasonable use of the property.After
considering the facts and materials of your Resource Ordinance Variance application,we cannot support
approval of the proposed structure as a necessary reasonable use of this property.
Please advise us how you would like to proceed on this Variance application. We will await your
comments before continuing review of the variance application.If you have any further questions,you may
