available to the public upon request.

2) A JARPA form partially filled out;
3) A letter to the Washington Dept of Fish and Wildlife asking for the HPA;
4) A survey of the dock facility showing the location of the piling replacement
project; and
5) A check payable to the Mason County Treasurer in the amount of$300.00
I have asked for an Emergency HPA and submitted same to the Dept of Fish and Wildlife
since the piling that holds the southeast comer of the floating dock(see map)has broken
off near its bottom and floated away. The Fish Biologist(Josh Benton)visited the site on
October 13,2016(last Thursday)at low tide and agreed that the permit process could be
expedited. On Friday October 14, 2016,the piling in question broke off and floated
away.

Please find enclosed the following for the above project:
1) a check payable to the Washington Department of Fish and Wildlife
2) a sketch of the dock, pier and float, and the area of the floating dock that needs
repair and replacement of a piling.
3) I have submitted a SEPA checklist with the Community Development Department
for Mason County.
I have previous filled on line a standard HPA permit application.
I would appreciate that I also am given a Emergency Permit for the HPA since the piling
in question has now broken off(below the surface of the water) and is no longer a
functional piling. As a result, a portion of the floating dock is very unstable.

Thank you for the opportunity to comment on the determination of nonsignificance for the
Bayley Piling Replacement Project(SEP2016-00107& SHX2016-00073) located at 7627 East
SR 106 in Union as proposed by David Bayley. The Department of Ecology(Ecology)reviewed
the environmental checklist and has the following comment(s):
WATER QUALITY: Chris Montague-Breakwell(360)407-6364
The following construction activities require coverage under the Construction Stormwater
General Permit:
1. Clearing, grading and/or excavation that results in the disturbance of one or more
acres and discharges stormwater to surface waters of the State; and
2. Clearing, grading and/or excavation on sites smaller than one acre that are part of a
larger common plan of development or sale, if the common plan of development or
sale will ultimately disturb one acre or more and discharge stormwater to surface
waters of the State.
a) This includes forest practices(including, but not limited to, class W conversions)
that are part of a construction activity that will result in the disturbance of one or
more acres, and discharge to surface waters of the State;and
3. Any size construction activity discharging stormwater to waters of the State that

a) Determines to be a significant contributor of pollutants to waters of the State of
Washington.
b) Reasonably expects to cause a violation of any water quality standard.

Purpose of checklist: 615 W. Alder Street
Governmental agencies use this checklist to help determine whether the environmental impacts of your
proposal are significant. This information is also helpful to determine if available avoidance, minimization
or compensatory mitigation measures will address the probable significant impacts or if an environmental

There is an existing pier, ramp and float attached to the south shore of
Hoods Canal;
The location of the pier, ramp and float (hereinafter referred to as the dock) is: 7627 E State
Route 106, Union, WA 98582, approximately '/z mile east of Alderbrook Resort on S.R. 106.
This is a replacement of a down piling (rotten and broken at its bottom (that held up the
southeast corner of the dock.

(collectively known as the dock) is located at the site. No affect to land use to nearby or

a float with five (5) pilings that hold the float in place, and one of the pilings that holds up the
southeast corner of the float has broken off at its bottom.

bottom will be removed..

e. What is the current zoning classification of the site? Do not know(this is in the waters of
Hoods Canal on the south shore '/ mile east of Alderbrook Resort; there are currently 2
homes that use the dock, the dock is attached to the upland tract of land (Bayley) and
traverses the tidelands that lie in from of said Bayley upland tract. I would state that the
upland is residential, but the tidelands are (?).
f. What is the current comprehensive plan designation of the site? Not known by applicant,
presumed to be residential on the upland, and recreational use of the water(waters of
Hood Canal).
g. If applicable, what is the current shoreline master program designation of the site? Not
known by applicant, presumed to be residential.

RE: Bayley Replacement of Piling Project
Dear Sirs:
Please find enclosed the following for the above project:
1) a check payable to the Washington Department of Fish and Wildlife
2) a sketch of the dock, pier and float, and the area of the floating dock that needs
repair and replacement of a piling.
3) I have submitted a SEPA checklist with the Community Development Department
for Mason County.
I have previous filled on line a standard HPA permit application.
I would appreciate that I also am given a Emergency Permit for the HPA since the piling
in question has now broken off(below the surface of the water) and is no longer a
functional piling. As a result, a portion of the floating dock is very unstable.
