Dear Applicant: As part of this department's review of your permit application, a Shoreline Inspection (SPI) was performed on your property. Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject Property. Sincerely, Shandra O'Haleck Land Use Planner Mason County Planning Department 03/23/2001 1 of 2 SP12001-00039 Shoreline Inspection 03/23/2001 Case No.: SP12001-00039 Comments: Planning staff, Shandra O'Haleck, visited this site on February 13, 2001 to determine regulations that may affect building a garage/accesory living quarter on the upland side of this property. The area in question is located across Highway 106 from the shoreline residence. As this site would be within 200 feet of the shoreline, a shoreline substantial development permit would be required for accessory living quarters. A garage is exempt from shoreline permits. Although this had been an unusually dry winter, a creek was running from the back of this property toward the road. It appears the construction of the road has backed up the creek causing ponded areas on this parcel. Due to the cause of the ponding, staff did not feel that it would be considered a wetland area. I have included the DNR map typing for this area which lists type IV creeks in this area. For an accurate typing, the applicant may contact the WA State Department of Fish and Wildlife. Creeks are regulated under Mason County Resource Ordinance Fish and Wildlife Habitat Conservation Areas chapter which requires a 115 foot setback from type 4 streams. If this is a type 5 stream, a 90 foot setback would be required. In either case, new development could not meet the setback on this site. A buffer may be decreased by 25% with the submittal of a Mason Environmental Permit (MEP) and a Habitat Management Plan (HMP). Decreasing the buffer more than 25% requires the submittal of a MEP Variance and a HMP. The MEP variance requires public review and approval by the Mason County Board of Commissioners. Additionally, a steep slope exists at the back of this property. Due to the degree of slope and the amount of water coming from the hill, a geo-technical report will be required prior to building permit approval.
