An Environmental Impact Statement (EIS) is not required under RCW 43 . 21C. 030 (2) (c) . This decision was made after review of a completed Environmental Checklist and other information on file with the Lead Agency. This information is available to the public upon request . This DNS is issued under 197-11-340 (2) , the Lead Agency will not act on this proposal for 15 days from the date below. Comments must be submitted by 05/24/96 . PLANNING DEPI Mr. Gary Yando Mason County PO Box 528 Shelton WA 98584 Dear Mr. Yando: Thank you for the opportunity to comment on the determination of nonsignificance to construct a deck and install beams under a pier(Case No. SEP96-0110), located at East 7550 State Route 106 as proposed by St. Andrews House. We reviewed the environmental checklist and have the following comments: Any work in or adjacent to waterways that will adversely affect water quality must receive specific prior authorization from the Department of Ecology pursuant to WAC 173-201A-110. A short-term water quality standards modification may be issued if the proponent agrees to a number of specific construction practices and techniques designed to minimize water quality impacts. The construction schedule will be tied to the schedule on the Hydraulic Project Approval (HPA). The applicant should consider alternatives to creosote treated wood or other chemically treated wood for in- water construction of wooden structures. Over time,treated wood may contaminate nearby sediment and cause toxicity for aquatic organisms. Enclosed is a fact sheet with more information. Proper disposal of construction debris must be on land in such a manner that debris cannot enter the water body or cause water quality degradation of state waters. We offer the following comments at this time . Other comments may be offered as the project progresses . It appears from the general description of the project, that a Hydraulic Project Approval (HPA; RCW 75 . 20 . 100, WAC 220-110) to be issued by WDFW, will be required for the project . There is, however, insufficient project detail to determine specific conditions to be placed on the project at this stage of the project development . We encourage you to seek involvement from WDFW on resource needs and typical project requirements to insure proper protection of fish life as you proceed with project design and development . Early involvement with WDFW will facilitate later processing the HPA. Once final design plans are available, please submit a completed Joint Aquatic Resource Permits Application (DARPA) for an HPA, including complete plans and specifications for the proper protection of fish life, to WDFW for review. A JARPA form has been enclosed for your convenience . You should allow 45 days from the receipt of a complete application and completion of the SEPA process for processing of the HPA. The plans and specifications should be developed relative to Mean Higher High Water (MHHW) , (Datum, Mean Lower Low Water [MLLW] = 0 . 0 feet) . The drawings should accurately depict existing conditions and should include plan and cross-sectional views of the proposed project, a vicinity map of the project area, and accurate directions to the project site . The location of all prominent natural features and manmade improvements on the bank and beach in the immediate vicinity of the project area should be accurately represented. In addition, to aid us in locating the project site, a photograph should be supplied.
