Box 1324 Belfair, WA 98528 RE: RV Park on Parcels 12105-51=58001; 12105-51-59001; 12105-51- 68001; and 12105-51-69001; Range 1W, Township 21N, Section 5 . Dear Mr. Scott: This is a follow up to the, meeting. with you, and the site visit conducted by DCD staff Ryan, Windish and Hugo R. Flores to your property on August 27, 1997. Our field observations indicate that a substantial cutting, grading, and filling took place along- the project site. Practically, all ground and canopy vegetation was removed, changing natural drainage patterns., exposing soils, and potentially increasing erosion and siltation effects to the Type V water and wetland present on site. The Type V water flows in a south to north direction, entering your property from the south and leaving it through its northwest corner. At the time of the field. visit, it was difficult to assess the original width of the Type V water along your property due to grading actions conducted on site. The wetland ecosystem is located along the northwestern corner of your property, and it is hydrologically connected to the Type V water drainage which flows into Pickering Passage waters at the corner of Treasure Island Road. According to the National Wetland Inventory Maps (NWI) produced by the U.S . Department of the Interior, Fish and Wildlife Service, the wetland system located within your property is classified as a Scrub/Shrub wetland (PSSC) , and the Type V water as a Riverine Intermittent (R4SBC) , see attached map. Our field observations confirm this NWI classification for the wetland. However, a wetland delineation needs to be conducted on site to verify if this classification is applicable. At the time of the site visit, we observed a significant amount of silt entering the existing wetland and Type V water. As you may recall, we talked about stabilizing the project site before the arrival of the rainy season. We recommend hydroseeding those areas where surface water runoff may achieve more velocity creating soil erosion along the excavated channels . This needs to be done immediately. You can begin this type of work due to the extreme conditions on site. However, no grading or filling may be conducted on site. Upon receiving a copy of the wetland delineation and. function report, this department will set the required building and septic setbacks, and work with you to develop a mitigation plan to restore affected sensitive areas on site. c Enclosed find information related to the development of a RV Park. The purpose of the visit was to investigate a citizen complaint regarding"blasting noises" related to development activity. After visiting the site I found no evidence of such blasting activity, only the presence of a large excavator apparently used for clearing and grubbing. Approximately 1.5 acres of property had been cleared and grubbed. We have received an application from you for a County Road Access Permit for the purpose of improving the access to your property from Grapeview Loop Road. Improvements would include replacing the existing culvert with an 18 inch diameter, 60 foot long culvert and improving the roadway. It is my understanding, in talking with you, that these upgrades hre necessary for improving access to the planned Recreational Vehicle Park. In order to avoid piecemeal development and to allow environmental review of the project as a whole, we feel that it is inappropriate for us to issue any further development permits until an RV Park permit is granted. An environmental review per the State Environmental Policy Act (SEPA) will be conducted at the time of application for an RV Park. At that time we will assess impacts to the environment for the project including any transportation access. I appreciate the opportunity to meet with you and Craig Eldridge to further discuss your intentions for developing the property. I feel it will be beneficial to both you as a developer and the County to have a better understanding as to your development plans. As you are aware, we have received some inquiries and complaints from adjacent property owners and a clearer understanding of your intentions will allow us to better address these concerns. Block 58 and surrounding road right-of-way is the approximate location of the most substantial grading that is located near the wetland and the stream. Blocks 45 and 46 are those blocks where the most recent clearing has taken place and where the excavator is sitting. Per your request I have also enclosed a copy of the letters we have sent Mr. Scott with regard to this site. As I mentioned on the phone, he is in violation of the wetlands chapter of the Mason County Interim Resource Ordinance. We are requiring a wetland delineation and restoration of the wetland. A Mason County Environmental Permit (MEP) will be required along with a SEPA checklist. Eldridge and Scott: On November 24, 1997, my staff inspected your property east of Grapeview Loop Road, at Grapeview, Mason County, Washington, in response to a complaint. They observed that you had mechanically landcleared 0.16 of an acre of forested wetlands and land cleared, filled and graded at least 584 feet of an unnamed stream and the adjacent wetland corridor (approximately 25 to 40 feet wide.) In addition, approximately 90 feet of the stream channel has been filled in with sediment coming from your cleared land. There may be additional land clearing in wetlands downstream from the accumulation of sediment. I consider this work to be in violation of Federal law. I direct you to do no further work in wetlands at this site. Enclosed are definitions and extracts of the laws which may apply to the unauthorized work. To assist in the evaluation of this violation, we request the following information: a. As-built sketch of the work. Enclosed for your use is a copy of our sketch. You should make any necessary changes to reflect current conditions, sign, and return with your other comments. b. Who did the work? If a contractor, please furnish name, address, and telephone number. c. Date when the work started. d. Reasons why the work was started before obtaining a Department of the Army permit. e. Property ownership at the time the work began. f. Primary purpose of the work in the stream and wetlands. -2- g. Practicable alternatives available that would avoid or minimize work in the stream and wetlands. The U.S. Environmental Protection Agency (EPA) also enforces Section 404. Section 309 cites penalties for violation of Section 301 which prohibits placement of fill or dredged material unless authorized under Section 404 . The term "wetlands" means those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions . The Corps of Engineers has the responsibility for determining whether a specific- wetland area is within Section 404 jurisdiction. The term "adjacent" means bordering, contiguous, or neighboring. Wetlands separated from other waters of the United States by manmade dikes or barriers, natural river berms, beach dunes, and the like are "adjacent wetlands. " The term "discharge of dredged material" means the addition, including redeposition, of dredged material, runoff from a contained land or water disposal area, and any addition, including redeposition, of excavated material . Excavation activities can include mechanized landclearing, ditching, channelization, and other excavation activities that destroy or degrade waters of the United States, including wetlands. The term "discharge of fill material" means the addition of any material used for the primary purpose of replacing with dry land or of changing the elevation of a water of the United States, including wetlands. The placement of pilings constitutes a discharge of fill material when such placement has or would have the effect of a discharge of fill material. EXTRACTS from the Clean Water Act: 1. SECTION 404 (a) The Secretary of the Army, acting through the Chief of Engineers, may issue permits, after notice and opportunity for public hearings for the discharge of dredged or fill material into the navigable waters at specified disposal sites. (b) Subject to subsection (c) of this section, each such disposal site shall be specified for each such permit by the Secretary of the Army (1) through the application of guidelines developed by the Administrator, in conjunction with the Secretary of the Army, which guidelines shall be based upon criteria comparable to the criteria -2- applicable to the territorial seas, the contiguous zone, and the ocean under section 403 (c) , and (2) in any case where such guidelines under clause (1) alone would prohibit the specification of a site, through the application additionally of the economic impacts of the site on navigation and anchorage. (c) The Administrator is authorized to prohibit the specification (including the withdrawal of specification) of any defined area as a disposal site, and he is authorized to deny or restrict the use of any defined area for specification (including the withdrawal of specification) as a disposal site, whenever he determines, after notice and opportunity for public hearings, that the discharge of such materials into such area will have an unacceptable adverse effect on municipal water supplies, shellfish beds and fishery areas (including spawning and breeding areas) , wildlife, or recreational areas. Before making such determination, the Administrator shall set forth in writing and make public his findings and his reasons for making any determination under this subsection. 2 . SECTION 309 This section provides that any person who willfully or negligently violates the provisions of this Act may be punished by a fine of not less than $2, 500 or more than $25, 000 per day of violation or by imprisonment for not more than one years or by both.
