16-ft. deep by 68-ft. wide floating dock now secured by 4 pilings.

This worksheet was designed to help project proponents, and goverhment agencies, identify when a projKf
needs further analysis regarding adverse effects on ESA (Endangered Species Act) listed salmonids. Salmonids
are salmon,trout and chars,e.g. bull trout. For our purposes, "ESA Listed Salmonids"is defined as fish species
listed as endangered,threatened or being considered for listing.
If ESA listed species are present or ever were present in the water shed where your project will be located, your
project has the potential for affecting them, and you need to comply with the ESA. The questions in this section
will help determine if the ESA listings will impact your project.
The Fish Program Manager at the appropriate Department of Fish and Wildlife(DFW) regional office can provide information for the

Dear Mr. Borden:
Thank you for providing the Washington State Department of Natural Resources (DNR) with an
opportunity to comment on the permit application for the proposed dock and ramp replacement
at 370 E Treasure Island Drive on the west shore of Treasure Island, Case Inlet. State-Owned
Aquatic Lands (SOAL) includes the unsold beds and shores of all navigable waters in the state
up to and including the line of ordinary high water(RCW 79.105.060). As proprietary manager
of SOAL, DNR is charged with four main tasks relating to those lands - encouraging public use
and access; fostering water-dependent uses; ensuring environmental protection; and utilizing
renewable resources (RCW 79.105.030).
The DNR's interest in the project pertains to areas where SOAL is impacted and includes the
following comments:
Treasure Island community dock is authorized under aquatic lands lease 20-B 10161 until 2019.
Due to the proposed dock and ramp replacement the lease shall be amended to incorporate the
change in leasehold footprint and improvements. A DNR land manager and habitat steward
conducted a site visit on April 15, 2010 to work with proponent to incorporate the following
habitat stewardship measures into the project design.
• Dock material must be made of untreated wood, concrete or steel. ACZA treated lumber
is allowed in dock frame only. Skirting of floats is not allowed. Floatation material must
be fully encased and floats may not ground out at any time.
• Pier, ramps and floats should incorporate unobstructed grating over at least 50%of the
surface area of these structures. The grating itself needs to allow for at least 60% light
penetration.

• To prevent prop scour, boat mooring areas of docks must be located where the water will
be deeper than 7 feet at the lowest low water.
Review of the proponents JARPA received April 28, 2010 indicates that all of the above
measures have been addressed with the following exceptions:
• Plans include using treated wood(ACZA) for the deck surface.
• Moorage of vessels must be in water at least 7 feet deep at lowest low water.

Any discharge of sediment-laden runoff or other pollutants to waters of the state is in
violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water Quality
Standards for Surface Waters of the State of Washington, and is subject to enforcement
action.
Erosion control measures must be in place prior to any clearing,grading, or construction.
These control measures must be effective to prevent stormwater runoff from carrying soil
and other pollutants into surface water or storm drains that lead to waters of the state.
Sand, silt, clay particles, and soil will damage aquatic habitat and are considered to be
pollutants.

Proper disposal of construction debris must be on land in such a manner that debris cannot
enter the waters of the state; e.g., Fair Harbor in Case Inlet or cause water quality
degradation of state waters.
During construction, all releases of oils, hydraulic fluids, fuels, other petroleum products,
paints, solvents, and other deleterious materials must be contained and removed in a
manner that will prevent their discharge to waters and soils of the state. The cleanup of
spills should take precedence over other work on the site.
All stormwater discharges must be constructed in a manner that will not cause scouring on
the beach.
The applicant should consider alternatives to treated wood or other chemically treated
wood for in-water construction of wooden structures. Over time, treated wood may
contaminate nearby sediment and cause toxicity for aquatic organisms.
All trenches, depressions or holes created in the intertidal area shall be backfilled before the
next inundation with tidal waters.
Ecology's comments are based upon information provided by the lead agency. As such, they
may not constitute an exhaustive list of the various authorizations that must be obtained or
legal requirements that must be fulfilled in order to carry out the proposed action.
