RESOLUTION OF INTENTION NO. 36-90
A Resolution of the Board of County Commissioners of Mason County, State of
Washington, declaring the intention of the Board of Commissioners to improve
approximately 1'12 miles of the existing private roads in Johns Creek Development
kO0NO as Johns Creek Drive, Pr6irieNUUd Road and Little Bear Lane; all located
in the North One Half of Section 5, Township 20 North, R8nqg 3 West, W. M'.
and by doing all work necessary in connection therewith, setting forth the nature
and territorial extent of the improvement, designating the number of the Road
Improvement District and describing the boundaries thereof, stating the estimated
cost and expense of the improvement and the proportionate amount thereof which
will be borne by the property within the proposed district, notifying the owners
of the property therein to appear at ameeting of the Board at the time specified
herein and directing the County Road Engineer to submit to the Board at Or prior
to the time specified herein a diagram showing thereon the lots, tracts and
parcels Of land and other property which will be specially benefited thereby and
the estimated amount of the cost and expense of such improvement to be borne by
each lot, tract or parcel of land Or other property, and also designating thereon
all property which is being purchased under contract with the county'
WHEREAS, an informal petition has been filled requesting the improvement Of a
portion Of the following described tract of land;

and, WHEREAS, the improvements described in the petition appear beneficial to
the property; therefore,
BE IT RESOLVED by the Board of County Commissioners Of Mason County, State of
Washington, as follows:
SECTION I: . . . That it is the intention Of the Board of [O001sSioDerS of Mason
County, Washington to adopt as COuDtv roads and also to Order the improvement
of Johns Creek Drive, Prairiew00d Road and Little Bear Lane

when the formation of Road I0prOY808Ot District No. 4 i3 approved by a
majority of V0t8S Cast and also UpOO conveyance by donation to Mason County, all
rights -of -way necessary for the intended i0prOVe08Ot' The road C0DStrUCtiOD
improvement shall satisfy all present COUOtv Plat Road Standards as adopted by
the Mason County Board of Commissioners.

SECTION II , . ' The estimated C0St and expense Of Said improvement is hereby
declared to be approximately $ 193,740'00 and it is the intention of the
Board Of Commissioners that all engineering CDSt and expense of the above -
described improvements, shall be borne by the Property Owners; and, that the
remaining construction COSt Of said i0Dr0V80ent3 Shall be borne by and assessed
against the property included in the assessment district herein proposed to be
established.
SECTION III ' , . It is the intention of the Board of Commissioners to establish
a Road Improvement District of the county to be known and designated as "Mason
C0UOtv Road I0prOY808Dt District No. 4 " which said district Shall include all
the property between the termini of said improvements, abutting upon or adjacent
to the street proposed.
SECTION IV . . . All owners of property within the aforesaid assessment district
and all persons who may desire to object to the construction of the aforesaid
i0pr0V908Ot Of the formation Of the aforesaid aSS8SS08nt district are hereby
notified to appear and present such 0hieCti0O8 at a meeting of the Board of
Commissioners to be held in the Mason County Courthouse in Shelton, Washington,
at 7:30 P.M. on the 23rd day of Avril , 19 90 , which time and
place is hereby fixed for hearing of matters relating to said proposed
improvements and all Ohi8CtionS thereto, and for determining the method of
payment of Said improvement.
SECTION V . . ' The County Road Engineer is hereby directed to submit to the
Board at Or prior to the date fixed for such hearing a diagram Or print showing
thereon the lots, tracts and parcels of land and other property which will be
specially b8DSfitted thereby and the estimated amount of cost and expense of such
10prOVe08Ot to be borne by each lot, tract or parcel of land or Other property
and also designating thereon all property which is being purchased under contract
from the county.
SECTION VI . . . The Clerk of the Board is hereby directed as follows:
6.1 The rSSOlUti0D of intention Shall be published in at least two
COnS8CUtiV8 i33USS Of a newspaper f general circulation in such
county, the date of the first publication to be at least fifteen days
prior to the date fixed by such resolution for hearing before the
Board Of County Commissioners.
6,2 Notice of the adoption of the resolution of intention Shall be given
each owner or reputed owner of any lot, tract or parcel of land or
other property within the proposed improvement district by mailing
Said O0tiC8 to the U#D8r or reputed owner of the property as shown
OD the tax rolls Ufthe County Treasurer at the address Shown thereon
at least fifteen days before the date fixed for the public hearing.
The notice shall refer to the resolution of intention and designate
the proposed improvement district by number' Said notice shall also
set forth the nature of the proposed improvement, the total estimated
cost, the proportion of total coot to be borne by assessments, the
estimated a00UDt of the cost and expense of Such improvement to be
borne by the particular lot, tract Or parcel, the date and place of
the hearing before the Board Of COUDtv CO00i33i0n8r3, and Shall
contain the directions hereinafter provided for voting UpOD the
formation of the Dr0D088d improvement distriCt.

6.3 The [lerk Of the Board Shall prepare and 0ail, together with the
notice above referred to, a ballot for each owner or reputed owner
Of any lot, tract or parcel Of land within the proposed improvement
district. This ballot shall contain the following proposition:
"Shall Mason County Road Improvement District No. 4 be formed?"
YES
NO
and, in addition, shall contain appropriate spacas for the signatures
of the property owners, and a description of their property, and
shall have printed thereon the direction that all ballots must be
signed to be valid and must be returned to the Clerk of the Board
of County Commissioners not later than five o'clock p,0. Of a day
which Shall be one week after the date of the public hearing.
6.4 The notice Of adoption Of the resolution of intention shall also
contain the above directions, and in addition thereto, shall state
the rules by which the election shall be governed'
