HomeMy WebLinkAbout116-94 - Ord. Combining & Superseeding Ord. 1238 and 111-84 ORDINANCE NO. ! G� AN ORDINANCE COMBINING AND SUPERSEDING MASON COUNTY ORDINANCE NO. 1238 AND 111-84. AN ORDINANCE CLASSIFYING ROADS AND FIXING COMPENSATION REQUIRED BEFORE VACATION THEREOF. BE IT ORDAINED BY THE BOARD OF MASON COUNTY COMMISSIONERS: Section 1: For the purpose of vacating county roads, all roads shall be classified as follows: Class A - All roads or parts thereof for which any public expenditure was made in the acquisition, improvement or maintenance thereof (RCW 36.87.100); Class B - All roads or parts thereof for which no public expenditures have been made in the acquisition, improvement or maintenance of the same (RCW 36.87.110). Section 2: The County shall require, as a condition precedent to the vacation of roads or portions thereof within the classifications set forth in Section 1, that persons benefiting from the vacation thereof compensate Mason County in an amount equal to the percentage of the appraised value of the vacated road as of the effective date of the vacation, as set forth in the following schedule: Class A Roads 100 percent of the appraised value Class B Roads 100 percent of the appraised value Section 3: Such compensation must be paid to Mason County by all adjacent property owners within six (6) months of the date the vacation was approved by the Mason County Commissioners or the vacation shall be null and void. Section 4: If the vacation procedure is initiated at the request of one or more adjacent property owners, then compensation is required as above provided and; the adjacent property owners will be required to furnish a bond in the penal sum of Two Hundred Dollars ($200.00), payable to the County, to guarantee payment of all costs and expenses incurred in the examination, report and all proceedings pertaining to such vacation. Section 5: Costs of County appraisals of roads pursuant to this ordinance shall be deemed expenses incurred in the vacation proceedings and shall be paid in the manner provided by RCW 36.87.070. Section 6: The "Appraised Value" of the vacated road shall be the true and fair market value of the parcel of land vacated, which generally shall be determined by the true and fair market value of the property upon which said vacated road abutts as determined by the County Assessor at the time of vacation. Section 7: Appraisals shall be made by the Mason County Assessor. Section 8: This Ordinance shall become effective the ZS day of CL Cv-1994. PASSED AND APPROVED this 2-5 day of C)c+vb.?✓, 1994.
