SOLUTION R
On November 5 , 1965 , the Plat of Edge Wood Beach, Division 1 , located in Sections 9
and 16 , Township 23 North, Range 3 West, W . M. , was recorded in Volume 6 , page 31
records of Mason County, Washington ,
WHEREAS , The Dedication included in Edge Wood Beach, Division 1 , is as follows :
Know all men by these presents that the undersigned, Lawrence C . Stacel and Cecele L .
Stacel , owners, in fee simple of the land hereby platted and Fred E . Topp and Jennie M.
Topp, mortgagees thereof hereby declare this plat and dedicate to the use of the public
forever all streets, avenues, places and sewer easements or whatever public property there
is shown on the plat and the use thereof for any and all public purposes not inconsistent
with the use thereof for public highway purposes .
Also , the right to make all necessary slopes for cuts and fills upon lots, blocks, tracts, etc ,
shown on this plat in the reasonable original grading of all the streets, avenues, places,
etc . shown hereon . Also , the right to drain all streets over and across any lot or lots
where water might take a natural course after the street or streets are originally graded .
REAS , The final plat contains EASEMENT PROVISIONS , which state :
An easement is hereby reserved for and granted to any serving utility over, under, across,
and upon the exterior 5 feet of front and rear boundary lines and the 2 . 5 feet of side
boundary lines on all lots for the purpose of installing, operating and maintaining serving
utilities of any kind in between; also hereby granted is the right to use the streets for the
same purposes .
WHEREAS , RCW 58 . 17 . 215 — Alteration of subdivision — Procedure, provides a method
by which a person interested in the alteration of any subdivision or the altering of any
portion thereof may proceed;
WHEREAS , Vernon and Mary Chalberg, owners of Lots 5 , 6 , and 7 in the plat of Edge
Wood Beach Division 1 , have made application with the Mason County Board of County
Commissioners requesting an alteration to the easements running approximately
northeast to southwest 86 . 32 feet, approximately east to west 110 . 00 feet, and
approximately northwest to southeast 98 . 74 feet between these said lots, for the purpose
of combining lots through a Declaration of Parcel Combination ;
WHEREAS , the application contains the signatures of the majority of those persons
having an ownership interest of lots, tracts, parcels, sites, or divisions in the subject
subdivisions or portion thereof;
WHEREAS , Hood Canal Communications, PUD # 1 , and Qwest Communications have
relinquished their interests in the easements and there is no active homeowners '
association, and Mason County Department of Public Works releases interest in the
easements with the understanding that future proposals must sufficiently address storm
water runoff issues ;
WHEREAS , the Mason County Board of County Commissioners did notify the affected
landowners as required by RCW 58 , 17 . 215 ;
WHEREAS , a public hearing was held on July 3 , 2001 , at 9 : 15 am, in the Commissioners
Chambers ;
WHEREAS , after due consideration it appears to be in the best public interest to approve
the request made by Vernon and Mary Chalberg ;
NOW THEREFORE BE IT RESOLVED that the Board authorizes the alteration of the
previously described 2 . 5 foot easements between Lots 5 , 6, and 7 in the Plat of Edge
Wood Beach Division 1 , with the understanding that future proposals must sufficiently
address storm water runoff issues and that the easement is being removed for the purpose
of performing a Declaration of Parcel Combination .
PASSED IN REGULAR SESSION this 3rd day of July, 2001 ,
