RESOLUTION 103 - 02
On January 20 , 1969 , the Plat of Alderbrook Golf & Yacht Club , Division 11 , located in
m Section 4 , Township 21 North, Range 3 West, W . M . , was recorded in Volume 7 Pages
109 through 113 records of Mason County, Washington .

t4 N WHEREAS , The Dedication included in Alderbrook Golf & Yacht Club , Division 11 is

Know all men by these presents : That we, the undersigned, Wesley M . Johnson and
�N Frances Rea Johnson, his wife, and Alderbrook Development Inc, a Washington
® Corporation, as owners in fee simple of the land hereby platted, do hereby declare this
�N plat and dedicate to the use of the lease holders such portions of all streets, avenues,
places, courts, lanes, easements , or whatever property as shown on this plat and the use
thereof as private for any and all purposes non inconsistent with the use thereof, also the
�W right to make all necessary slopes for cuts and fills upon lots, blocks, tracts, etc . , shown
on this plat in the reasonable original grading of all streets, avenues, etc . , shown thereon .
Covenants and restrictions as recorded under auditors file number 180025 records of
Mason County, Washington are hereby imposed upon the entire tract of land hereby
platted .

WHEREAS , The final plat contains a Special Provision :

A five foot utility and drainage easement is reserved on each side of all interior lot lines,
together with five foot on all rear lot lines, the right is reserved to enter upon said
easement for purposes of constructing and maintaining said utilities and drainage .
WHEREAS , RCW 58 , 17 , 215 - Alteration of subdivision - Procedure, provides a method
by which a person interested in the alteration of any subdivision or the altering of any
portion thereof may proceed ,
WHEREAS , Jack Scruggs owner of Lots 94 & 95 of Alderbrook Golf & Yacht Club ,
Division 11 has made application with the Mason County Board of County
Commissioners requesting the elimination of the easement running between these two
properties, for the purpose of combining the lots through a declaration of parcel
combination ;
WHEREAS , the application contains the signatures of the majority of those persons
having an ownership interest of lots, tracts, parcels, sites , or divisions in the subject
subdivision or portion thereof,
WHEREAS , The Alderbrook Golf & Yacht Club , PUD # 1 , and Hood Canal
Communications have relinquished their interest in said easement ;
WHEREAS , the Mason County Board of County Commissioners did notify the effected
landowners as required by R. C . W . 58 . 17 . 215 ;

Cr WHEREAS , a public hearing was held on August 6 2002 at 9 . 45 AM, in the

WHEREAS , after due consideration it appears to be in the best public interest to approve
the request made on behalf of Jack Srcuggs, as these easements serve no public use or
�0 interest ,

NOW THEREFORE BE IT RESOLVED that the Board authorizes the elimination of the
previously described ten ( 10) foot easements between Lots 94 & 95 of Alderbrook Golf
& Yacht Club , Division 11 with the understanding that the purpose is to allow the
ez combining of the two lots through a declaration of parcel combination .
