This is your opportunity to object to these license renewal requests as authorized by RCW 69.50.331 (7) . 1 ) Objection to License Renewal To object to a marijuana license rnewal: This letter must: fax or mail a letter to the Washington State Liquor and Cannabis Board (WS-LCB) Licensing Division. o Detail the reason(s) for your objection, including a statement of all the facts upon which your objection or objections are based. o You may include attachments and supporting documents which contain or confirm the facts upon which your objections are based. o Please note that whether a hearing will be granted or not is within the Board's discretion per RCW 69.50.331 (7) (c) . Your letter of objection must be received by the Board's Licensing Division at least 30 days prior to the _license expiration date (WAC 314-55-165) . If you need additional time you must request that in writing. Please be aware, however, that it is within the Board's discretion to grant or deny any requests for extension of time to submiti objections. Your request for extension will be granted or denied in writing. If the objection is received within thirty days of the expiration date or the licensee has already renewed the license, the objection will be considered as a complaint and possible license revocation may be pursued by the enforcement division. A copy of your objection and any attachments and supporting materials will be made available to the licensee, therefore, it is the Local Authority's responsibility to redact any confidential or non-disclosable information (see RCW 42.56) prior to submission to the WSLCB. 2) Status of License While Objection Pending During the time an objection to a renewal is pending, the permanent marijuana license is placed on hold. 3) Procedure Following Licensing Division Receipt of Objection After we receive your objection, our licensing staff will prepare a report for review by the Licensing Director. The report will include your letter of objection, as well as any attachments and supporting documents you send. The Licensing Director will then decide to renew the marijuana license, or to proceed with non-renewal. 4) Procedure if Board Does Not Renew License (WAG 314-55-165 (2) (b) ) If the Board decides not to renew a license, we will notify the licensee in writing, stating the reason for this decision. The licensee also has the right to request a hearing to contest non-renewal of their marijuana license. If the licensee makes timely request for a hearing, we will notify you. The Board's Licensing Division will be required to present evidence at the at the hearing before an administrative law judge to support the non-renewal recommendation. You may present evidence in support of your objection or objections. The Board's Licensing Division will present evidence in support of license renewal. The Licensee may also participate and present evidence if the licensee desires. We are in receipt of correspondence from Jovan Cruz,Claims Analyst,Washington Counties Risk Pool. In essence, they have provided a preliminary settlement concept to pay for mitigation costs for cleanup and repair only. Rather than respond directly to the Risk Pool, I feel it is prudent to respond directly to the decision makers. Since the fall of 2017,there have been two major incidents of sewage overflows onto these Mission properties from the County's inadequate and antiquated system serving the surrounding area. The properties are identified as Mason County tax parcels 12220-50-72001, -72004, and -80009. The properties support eleven residential RV tenants and spaces for three commercial tenants. As some of you know,on January 13,2021,these properties were inundated with water and sewage springing up from the backflow device. The sewage flooded A Class Act Hair Salon and the office of Ayers Automotive. The sewage sprawled out and around two residential RV's. A very similar sewage flooding event happened on November 23, 2017. Mission's dollar loss is substantial. For years, its vacancy rate was zero. But after the January sewage flooding, the hair salon had to cease its operations and has vacated the premises, leaving about 1,536 square feet of rentable space unoccupied. Ayer's Automotive occupies an office that is about 200 square feet. Average commercial leases with triple net for this property had been about$1.00 per square foot per month. Mission is now losing a revenue stream of approximately $20,832 annualized. This is not just a temporary loss. The properties are now stigmatized as the area that gets overrun by raw sewage from time to time. My property manager, talking with someone he had hoped would rent space, was met with the response, "You mean that place that gets flooded with sewage?"It is difficult to calculate the loss in market value,but it has to be staggering. WSU Extension—Dan Teuteberg Commissioners Neatherlin,Shutty and Trask attended via Zoom. • Request to amend the current MOU to bring Kathy Fuller's position to full time was approved. 9:25 A.M. Superior Court—Judge Goodell Commissioners Neatherlin, Shutty and Trask attended via Zoom. • A re-organization to eliminate Superior Court Administrator and to create,post,and fill a Chief Superior Court Administrator and Finance Manager was brought forward. Salary Range would be 43. Phase 1,2,and 3 were also presented. Commissioners would like to have further discussion regarding budget and the re-organization. Approval to move forward with Phase 1. • The Juvenile Detention Center has safety and staffing concerns. There are two detention officers each working a 12-hour shift—one in the booth and one on the floor. Average daily population is three with a high of six or seven. Two additional detention officers were requested for a noon to midnight shift. Commissioners asked to wait until the Legislative Session is finished to see what changes may happen before deciding. Commissioners asked that the requests for re-organization and additional deputies be prioritized due to potential budget issues. Judge Goodell will discuss with the other two judges and Jim Madsen and brief next Monday. 10:00 A.M. Board of Mason County Commissioners' Briefing Meeting Minutes March 22,2021 • Chief Beau Bakken with North Mason Regional Fire Authority reported on the 20-year bond for$10 million that was voter approved in 2019 for a new emergency management campus. This centrally located facility will hopefully be completed by December of 2021. There is a non-binding letter with the County for location of County services at the old fire station. • Extending the contract with Mendoza Texas Style Food vendor for MCRA to March 2023 was approved to move forward. • Board of Equalization applicants will be interviewed for the alternate position. • Dawn reported she will bring forward a revised Telework Policy to add to the Personnel Policy. • Jenn presented a comparison of ER&R and Motor Pool. Estimated cost savings are over $1 million over a 10-year period for the Sheriff PPV Fleet Planning Analysis and$1.3 million for the Non-ERV Fleet Planning Analysis. Budget impact is an estimated cost savings of about$230k a year. A$267k over payment from ER&R to Current Expense was noted. • The 2021/2022 Vehicle Lease Order Request and 2022 Draft Motor Pool Rates was presented and approved to move forward. 16 Leased vehicles are being requested to bring the total leased fleet to 79. • Diane presented the request to delete the following obsolete chapters from the County Code:Chapter 3.04 Admissions Tax;Chapter 3.152 Chaplains Fund;Chapter 3.178 Volunteer Fund;Chapter 5.04 Merchant Patrolmen;Chapter 5.08 Junk Dealers, Secondhand Dealers and Pawnbrokers;Chapter 5.12 Carnivals and Circuses and Chapter 9.40 Alarm Systems. Planning—Describe the transportation planning activities performed this reporting period. The Engineering Division is responsible for putting together both short-and long-range engineering and construction plans for transportation services to Mason County citizens. The division coordinates with other government agencies at the federal, state and local levels, with junior taxing districts, private groups and the public to organize and advance comprehensive plans to meet Mason County's transportation needs.The department offers and makes staff available for technical assistance to regional transportation groups and serves on technical committees with the Regional Planning Organization. Liaisons for Title VI Coordinator, traffic, utilities,construction, survey and design meet regularly to discuss projects, schedules, and funding. At these meetings,Title VI requirements are discussed and integrated into the upcoming projects. Title VI is contained in all advertisement for consultants and construction contracts. Public outreach includes Title VI Public Involvement and Title VI notice to the Public. As reported in last year's report,the county was working on the development of a Project Summary form. The Engineering &Construction team has started using the form with the Environmental Justice EJSCREEN ACS Summary Reports for the project site areas during the development of a project to assess what kinds of impacts the project will have on the community and what types of public outreach will need to be done or planned before and during the project.The Project Summary forms and EJSCREEN ACS Summary Reports for the projects during this report period are attached in this report. No community meetings were held during this report period due to COVID. However,the two (2) projects completed during this period had impacts to a number of residents. These projects required the County to close the roads a couple of weeks to complete the project. Below describe the activities performed by Public Works to ensure community outreach. PROJECT NAME PUBLIC OUTREACH 1.Public zoom meeting with Commissions to approve a road closure for each of these projects.The resolution was published in local newspaper for two consecutive weeks. 2.Project flyers for each project were mailed out to property owners in the vicinity that would be impacted by each of these projects,notifying them of CRP 2014 the upcoming project and expected road closures.These flyers were in both Deegan Road West English and Spanish(Exhibits 3&4). Culvert Replacement Project 3.Flyers were posted on the County Facebook page. 4.Reader board signs were placed on each road to notify the traveling public of the upcoming closure with contract information. 5.Emails were sent to approximately 75 business,citizens,schools, emergency services,local newspapers,local radio stations on our Public Works Road Closure email list. CRP 2015 6.Closure information was added to the County Channel 3 TV station. Shelton Valley Road 7.Closure was on the County Road Closure/Restriction hotline and on the Culvert Replacement Project Public Works webpage under Road Closures/Restrictions. The Transportation Improvement Program—Citizen Advisory Panel (TIP-CAP) has been limited to public outreach due to the COVID pandemic.The committee has been working on a PowerPoint presentation that will provide information on public works and transportation projects needs/unfunded needs and hope to move forward sometime in the near future. 6. Also, on this project we purchased a .036-acre Temporary Construction easement from John & Elizabeth Winkowski, Caucasian, property owner, husband and wife, she is from Canada and he is from the Northeastern US, around New Hampshire. The third purchase on this project was from Dale & Sharon Tahja, husband and wife, purchased both right of way and temporary construction easement from them. The total right of way was .01 acres and the total temporary construction easement was .006 acres. Mr. and Mrs. Tahja are Caucasian and are of American origin. CRP 2015 Shelton Valley Road culvert replacement project: Right of Way and temporary construction easements were purchased from two property owners on this project.The first property owner is Laura Caldwell. She is the owner of project parcel number 201505-93-00002. Mason County purchased 0.09 acres of right of way from Ms. Caldwell and 0.05 acres of temporary construction easement. Ms. Caldwell is female, Caucasian and American in origin. From the second property owner, Edward and Pamela Murphy,the County purchased two temporary construction easements. One of the temporary construction easements was for the actual downstream construction area and the other was a water bypass temporary construction area. The Murphy's property is identified, as project parcel number is 2015-05930-0001, on the project plan sheet. The water bypass temporary construction easement was approximately .08 acres and the temporary construction easement for the downstream construction area was approximately 0.03 acres. Mason County Public Work's Engineering and Construction Division encourages all consulting firms registered in Washington State to conduct business and possess the necessary professional licenses when presenting their qualifications for roadway design projects. The County's process for construction contracts are procured following state and federal competitive bidding statues and requirements. For the two (2) projects completed during this report period (Deegan Road and Shelton Valley Road), the County was able to utilize county forces to complete the projects. With these projects both over the $10k to construct, per statues,the county was required to publish a description and estimated cost of the project in the county official newspaper and after the project was completed a notice of completion with actual project cost was also published. (Exhibit 8). The County either advertises construction or consultant contract through the County MRSC Consultant or Small Works Rosters or advertises a Notice to Bidders/Request for Proposals/Qualifications in the local paper and Daily Journal of Commerce, on the County website and with Builders Exchange. The Title VI Coordinator reviews all contracts for consulting and construction to ensure compliance with the Title VI plan. It is the policy of Mason County to comply with 49 Code of Federal Regulations, Part 26,to ensure that Disadvantaged Businesses, including minority and women, have an equal opportunity to receive and participate in federally assisted contracts. The funding request is based on a county-wide systematic safety analysis presented in a safety plan. Applications are due April 30t' and funding awards are announced fall 2021. A request of N $ 1.4M is proposed with a local match of 10% from the Road Fund. The estimated award to Mason County is $ 600,000 - $700,000. If the construction phase is authorized by April 30, 2023 that phase is eligible for 100% funding (no local match required). A local road safety plan must be prepared to apply for funding. The safety plan: 1. Identifies the type of crash that represents the greatest number of severe crashes and risk factors. 2. Screens and prioritizes system-wide locations. 3. Selects countermeasures that will reduce severe crashes. 4. Prioritizes system-wide safety improvement projects. WSDOT reviewed the draft and commented on April 13, 2021. TIP-CAP was briefed on this grant application on April 14, 2021. RECOMMENDED ACTION: Recommend the Board of County Commissioners authorize the County Engineer to submit the HSIP grant to WSDOT by April 30, 2021 for safety improvements throughout Mason County, as well as approval to authorize the Chair to sign all pertinent documents for the grant. Other organizations may work with a county to propose/develop a project. • Preliminary engineering/design, right-of-way, and construction phases of projects are eligible for funding. • Data collection projects should be consistent with local road safety plan needs. Infrastructure-related improvement projects are eligible for these funds. (Maintenance, enforcement, and education activities are not eligible.) • When upgrading an intersection's control type from traffic signs, the county must evaluate a roundabout and provide justification if a roundabout is not selected. • Counties must submit a local road safety plan that addresses fatal and serious injury crashes in the county to be eligible to apply. Using specific information about the risk factors present at specific crash locations, the county must identify locations where those risk factors are present. They then must identify and prioritize improvements/countermeasures/projects to address the highest priority locations. This prioritized list of projects must be presented in the local road safety plan, which must be submitted with the application. A local road safety plan is a risk-based way to prioritize locations for engineering improvements to reduce fatal and serious injury crashes based on data. The local road safety plan must document how and why the priorities were selected. Crash Data Summary Local Programs is providing each county with a crash data summary.The summary shows information about the fatal,serious injury,and total crashes in the county. It also shows how the county compares with other counties in the state.The summary does not include detailed crash data. If the construction phase is authorized by April 30, 2023, then the construction phase is eligible for 100%funding (no local match required). Federal funds cannot be used as match for any phase. • Projects must be fully funded between this funding and other funding sources, as applicable. • Only one application per county may be submitted. All prioritized projects should be shown on the application. • There is no maximum funding level for the application. • Projects must comply with all necessary federal and state requirements as detailed in the Local Agency Guidelines Manual. • Once a project has been awarded funds, the county shall complete the project as selected. • Project recipients must report quarterly on the status and expenditures of each project. • Project recipients are required to submit monthly progress billings to ensure timely reimbursement of eligible federal expenditures. • Project costs incurred prior to federal fund obligation are not eligible for reimbursement. • Agencies that do not actively pursue the awarded project are at risk of the project being cancelled and the funds reprogrammed. Selection Process • All properly submitted applications will be reviewed to ensure they are complete and eligible for funding. • All projects will be prioritized based on how effective the proposed work is anticipated to be in reducing fatal and serious injury crashes. • WSDOT may conduct site visits with the applicant, as needed. • WSDOT's Local Programs Director will select the final County Safety projects by October 2021.
