Dear Commissioner Neatherlin:
This is in response to an e-mail dated October 26, 2017, and a follow up e-mail dated December 18,
2017, from L.B. Kregenow, Mason County property owner, appealing the proposed Base Flood
Elevation(BFE) and Special Flood Hazard Area(SFHA)boundaries, as shown for her property on
the Preliminary Flood Insurance Rate Map (FIRM) and Flood Insurance Study(FIS)report for
Mason County,Washington and Incorporated Areas, dated August 30, 2016. Ms. Kregenow
submitted survey data and other documentation in support of a reevaluation, and observed that areas
not in the proposed flood zone are lower than many that are in the proposed flood zone.
Our earlier determination that the data submitted constituted an appeal was based only on a cursory
review of the data. Further review showed that the data submitted did not meet the threshold to be
defined as an appeal since sufficient technical information was not submitted. Please note that only
those submittals that relate to the addition or modification of the proposed flood hazard information
(i.e., Base Flood Elevations,base flood depths, Special Flood Hazard Area boundaries, zone
designations,or regulatory floodways) shown on the FIRM and in the FIS report that satisfy the data
requirements defined in Title 44, Chapter I,Part 67 of the Code of Federal Regulations are
considered appeals. Because your submittal did not meet these criteria, FEMA has processed it as a
`comment.'
We have determined that the Preliminary FIRM and FIS report dated August 30, 2016 should not be
revised based on the submitted data. Unfortunately, without supporting technical data,the
information provided is insufficient to support an appeal or reanalysis of that area/stream.

Responses for a detailed explanation of this resolution.

The requester has the option to provide technical data that would update the study in the future through
the Letter of Map Revision (LOMR) process, provided the technical data meets FEMA's guidelines
and specifications. For all LOMR applications submitted, FEMA is required to provide the requestor
and community with LOMR or other written comment within 90 days of receipt of all data. Also, a
LOMR can be submitted such that it becomes effective the day after the new maps go effective. Upon
your request,we will be happy to go through this process with you in more detail.
We appreciate your community's comments and commitment to having the most accurate flood
hazard information available reflected on the FIRM and in the FIS report.

Summary of Mason County Requester Comments and FEMA Responses
We would like to thank the requester for the submitted comments and for the commitment to having
the most accurate flood hazard information available reflected on the FIRM and in the FIS report for
Mason County. We have reviewed carefully all the submitted data and we have addressed each
concern in detail and provided an explanation on each of our decisions.
1. Concerns about the proposed floodplain boundary. Concern 1.1;the requester's concern is
whether the areas that are not in the proposed flood zone are lower than many that are in the
proposed flood plain based on the survey map created by James Turnbow(Figure 1). Concern
1.2;the requester's concern is why an area marked as outside the flood zone is at 70.7 feet while
areas in their LOMA boundary area are as high as 77.6 feet based on the survey map (Figure 1).

Response:
General: For the floodplain analysis,topographic data(a 6-ft Bare Earth DEM) collected
between 2000 and 2005 was used(Hydrologic Analyses Report Mason County, Washington
Unincorporated Areas, CID 530115). The requester provided a survey map created by James
Turnbow for the LOMA application for the adjacent parcel (Figure 1). Sufficient technical
information supporting the LOMA map such as spatially referenced topo data(GIS or CADD)
was not submitted to further evaluate the topographic differences mentioned. The requester has
an option to provide the needed technical data that would update the study in the future through
the Letter of Map Revision(LOMR)process as described in the main letter.
Concern 1.1: The ground elevation ranges between 75 and 76 feet based on the topographic data
used for the floodplain analysis(Figure 3). The base flood elevation at the location is 74.98 feet
and therefore the area is not included in the floodplain delineation.
Concern 1.2: The topographic source used for the floodplain analysis shows the elevation at the
location as 76.2 feet,while the water surface elevation is 77.45 (Figure 3). Therefore, the area is
inside the floodplain.

2. Concern about the topographic data used for the floodplain analysis. Concern 2.1; the requester's
concern is whether the proposed floodplain limit around the"farming"area is reasonable when
compared to the LiDAR data.
Response:
General: For the floodplain analysis,topographic data(a 6-ft Bare Earth DEM)collected
between 2000 and 2005 was used(Hydrologic Analyses Report Mason County, Washington
Unincorporated Areas, CID 530115). The floodplain analysis was performed using best available
topographic data at the time of the study. The requester provided a paper map created with the
LiDAR collected by the Mason Conservation District. Sufficient technical information, such as
digital CADD/GIS data which are needed to check the discrepancies,was not submitted.
The requester has an option to provide the needed technical data that would update the study in
the future through the LOMR process as described in the main letter.
Concern 2.1: Figure 4 shows the topographic data collected between 2000 and 2005 with 1
percent flood elevation(purple lines). Figure 5 shows the topographic data provided by the
requester. Black lines show approximate locations of the cross sections with flood elevations
used to delineate a floodplain(purple lines in the figure 4). The proposed floodplain limit near
the"farming area"was assessed based on visual observation of the topography and the estimated
1-percent flood elevation. It appears that a floodplain limit in the"farming"area may not be
significantly different with the topography provided by the requester. Based on the visual
observation, the floodplain in the"farming area"would be similar even with the topography
provided by the requester.

3. Concern about the topographic data used for the floodplain analysis. Concern 3.1; the requester's
concern is whether the topographic data used for the floodplain analysis agrees with the
requester's visual observation.
Response:
Concern 3.1: The requester provided general information about lower channel elevations, split
flow locations and water surface elevations based on the visual observation. The current mapping
shown on the preliminary floodplain is from an approximate analysis using the best available
data at the time of analysis. LiDAR data collected between 2000 and 2005 was used to obtain
cross section geometry for the floodplain analysis. If digital version of the latest topographic data
is provided, we could compare the difference in topography as described by the requester. Also,
the floodplain analysis could be updated if the digital data is submitted. The requester has an
option to provide the needed technical data that would update the study in the future through the
LOMR process as described in the main letter.

4. Concern about the peak flow used for the floodplain analysis. Concern 4.1; the requester's
concern is whether the floodplain analysis took account of the actual flow rates recorded at the
USGS Gage located near the requester's parcel; Concern 4.2; the requester's concern is whether
the floodplain analysis took account of the restrictions on flow from Cushman Dam.
Response:
Concern 4.1: The hydrologic study used for the floodplain analysis was completed in November
2013. All the USGS gage data available in 2013 were used for the flood frequency analysis to
estimate 1 percent discharges. The gage analysis using USGS Peak FQ computer program was
performed to estimate discharges at the USGS gage site on North Fork Skokomish River near
Potlatch, WA(Hydrologic Unit 12059500, yellow circle in Figure 7,
https://nwis.waterdata.usgs.gov/nwis/peak?site no=12059500&agency cd=USGS&format=html
). To estimate discharges at ungaged sites along the river, equation listed in"USGS Water
Resources Investigations Report 97-4277"was used. The calculated discharges around the parcel
are shown in Figure 7.
The frequency analysis has been performed again including all the flow data up to 2017. The
estimated flow for the 1 percent AEP is 8,063 cfs from the frequency analysis using a station
skew. In addition,peak flow was calculated using the regression equation for Mason County.
The peak flow estimated based on the frequency analysis is very close to the flow from the
regression equation. It appears that the flow estimated with the frequency analysis is reasonable
based on the comparison with the regression analysis result.
Concern 4.2: The requester provided the letter from Mason Conservation District dated on July
14, 2015. According to the letter from Mason Conservation District dated on July 14, 2015, the
flow at the USGS gage 12059500(near the requester's parcel)was supplemented by a release
from Cushman Dam No.2 to restore flood reserve capacity. The District engineer also believes
the third highest peak occurred on Dec 3,2007 (5,680 cfs with a gage height of 8.71 ft.)had no
impact from the release and the storm occurred on Dec 3, 2007 represents a maximum recorded
event. The 2007 peak flow is a little lower than the estimated flow(5,710cfs) for the 20year
flood event from the frequency analysis.
According to the USGS website

html), all the recorded discharges including the storm occurred on Dec 3, 2007 were affected by
regulation or diversion.
We believe that the discharge data we used for the analysis (shown in Figure 7) are reasonable. If
sufficient technical information is submitted(i.e.,dam operation or flow release)to consider the
impacts of Cushman Dam No.2,we could update the analysis. The requester has option to
provide the needed technical data that would update the study in the future through the LOMR
process as described in the main letter.

5. Concern about potential impacts of anew bridge. Concern 5.1;the requester's concern is
whether the floodplain analysis took account of the new bridge.
Response:
Concern 5.1: The requester provided general information about the bridge constructed on the
North Fork of the Skokomish in 2015. The current mapping shown on the preliminary floodplain
is from an approximate analysis that doesn't include such structures in the hydraulic model.
Sufficient technical information was not submitted about the bridge(survey or as-built plan)
supporting modeling information to show that the structure contains 1-percent-annual-chance
flow. However,please note that 1-percent-annual-chance flood elevation could increase if the
new bridge is included in the model. The requester has option to provide the needed technical
data that would update the study in the future through the LOMR process as described in the
main letter.

5.1 Tammy Donavan, chief admin for fire dist. 13 spoke about growth within the department and the
issues faced with the current warrant process to pay bills for the department. She requested
weekly warrant runs be reinstated.
5.2 Lisa Brengan from fire dist. 4 also spoke about the warrant process and challenges faced with
bills for the department.
5.3 Katie Patty NW regional fire authority discussed how the warrant process impacts relationships
with vendors. She praised financial services and voiced support in reinstating a part time position.

8. Approval of Action Agenda:
8.1 Approval to designate the Support Services Director as the Approving Authority for all Mason
County credit card requests.
8.2 Approval of a resolution selecting the Shelton Mason County Journal as the official county
newspaper for publishing certain legal publications. (Ex.A—Res. 35-18)
8.3 Approval to authorize the Chair to execute the Adopt-A-Road agreement with the Olsen family.
8.4 Approval to authorize Public Works to rebuild the old pump from the Tacoma Lift Station to use
as a spare for the Tacoma or Allyn lift station.
8.5 Approval to authorize the Chair to sign the Second Amendment to Government Entity Tower

8.8 Cmmr. Drexler/Neatherlin moved and seconded to not terminate the contract
with Housing Opportunities for Students in Transition (HOST)
Cmmr. Drexler spoke to the importance of the reporting requirements. She emphasized that
these funds are from taxpayers and need to be accounted for. Cmmr. Drexler did explain that
the reporting will need to be done in order to receive payment. She thanked the volunteers
and praised the mission of the program.
Cmmr. Neatherlin noted that the contract was close to being terminated, and explained that
the reporting must be done because it is required by the State Auditor.

9. Other Business (Department Heads and Elected Officials)
Frank Pinter introduced Jenifer Beierle as the new budget manager for Mason County. Cmmr.
Neatherlin asked her to speak about her background and time working for Mason County in the
Public Works Department.

10.1 Public Hearing to approve the amendments to Title 17.34, Signs in the Belfair UGA.
Staff: Dave Windom
Dave explained this is one of two updates. He discussed the issues with the current sign
code and introduced Marissa Watson to go over the proposed amendments.
Marissa said these updates were recommended by the Planning Advisory Commission, then
proceeded to brief some of the changes.
No public comment was received.

10.2 Public Hearing to take public comment on surplussing parcel 42002-10-00020.

Frank Pinter noted this property is going to be divided into six equal parcels, noting that a
rezone request has been submitted.

meeting from Herb Gerhardt against surplussing this property.

Background: The approval of this Release and Hold Harmless Agreement is a
compromise of any and all existing and/or future claims, damages and causes of
action of any kind and that the payment made is not to be construed as an admission
of liability on the part of the party or parties hereby released, and that the said
Releasees deny liability therefor, and further that such shall not be a basis for claims
for indemnity, contribution or breach of any Federal, state, local law.

RELEASE AND HOLD HARMLESS AGREEMENT
FOR AND IN CONSIDERATION of the sum of Eleven Thousand Seven Hundred Forty Two Dollars and Sixty
Cents ($11,742.60),this Release and Hold Harmless Agreement is made and entered this 23rd day of
August, 2018 by and between Mason County and Weston Sharer and Denise Sharer, individually and
their marital or domestic community with and their successors in interest do hereby release and forever
discharge Mason County and its officers, agents,employees,agencies and departments from any and all
existing and future claims, damages and causes of action of any nature whatsoever arising out of
Weston's employment resignation and public records request.
Recitals:
Whereas Weston Sharer served Mason County in the position of Combined Sewer & Water Operator I
from the year April 18, 2017 until August 23rd of 2018.
Whereas Mason County wishes to sever its relationship with Weston Sharer for reasons not amounting
to employee misconduct but for reasons related to not being the right fit for the position for which the
County would rather utilize at this time.
Whereas both Mason County and Weston Sharer mutually recognize that their relationship should not
end with harsh feelings and the turmoil of potential litigation and that it is in the best interest of all, too
simply reach agreeable terms to end the employment relationship. Mason County and Weston Sharer
wish to resolve their differences and fully settle and resolve any and all known and unknown, foreseen
and unforeseen claims or potential claims.
Accordingly, it is hereby agreed as follows:
a) Weston Sharer shall provide the County with a letter of resignation indicating that his/her last
day of employment shall be August 23,2018. The resignation shall state that it is a resignation
in lieu of termination and the County shall accept that resignation in lieu of termination.
b) Mason County agrees that Weston Sharer may represent to the Department of Employment
Security that he resigned in lieu of termination and for reasons neither related to misconduct
or for any other reason that would, from the position of the County, work to deny his claim
for unemployment compensation benefits.
c) Weston Sharer's full medical and dental coverage shall continue through the end of August
2018 and Weston shall be provided proper COBRA notification so that he may elect further
and continuing coverage if that is his desire.
d) Weston Sharer shall be provided a letter of reference in substantial form to the attached
exhibit A.
e) Mason County agrees that unless required by law that the only information that it will provide
to prospective employers shall be the content of the attached exhibit coupled with highest
rate of pay while employed.
f) Mason County agrees that all inquiries regarding Weston Sharer or his employment with
Mason County shall be directed exclusively to the Human Resources Manager. Human
Resources agree to limit all oral representations to only that information contained in the
attached exhibit A, except Human Resources may also reference additional positive material
in positive light about Weston.
g) Mason County agrees that if Weston Sharer furnishes prospective employers a release
authorizing provision of her employee file and information pertaining to her employment that
Mason County will include a copy of the Attached Exhibit A as the first document that will be
provided along with the other materials contained in the employee file that were authorized.
h) Mason County agrees that no documents contained in the supervisory desk files on Weston
Sharer shall ever be made part of his/her employment but shall be maintained as exempt
from public record request.
Release:
In exchange for entering this agreement, Weston Sharer forever releases and discharges
Mason County, its past, present and future Commissioners, elected officials, officers,
employees, agents, affiliates, assigns and successors from any and all claims, related to his
employment with Mason County, his separation therefrom, public records requests, or for
any issues arising before the date of this agreement. This release shall include any claims
arising under Federal,state,or local law prohibiting discrimination, harassment, retaliation in
employment, public records, claims or wrongful discharge, claims of constructive discharge,
breach of contract,defamation,constitutional violations,unpaid wages,salary,or other sums,
emotional distress, personal injury,attorneys'fees,or other statutory or common law claims.
Weston Sharer agrees not to pursue any legal action against Mason County as the result of
the signed Settlement Agreement. Specifically, in addition to general releases and waivers,
and agrees not to institute a law suit under Title VII of the Civil Rights Act of 1964,as amended,
(Title VII),the Public Records Act,or any other unmentioned Federal,state, or local law.
Weston Sharer knowingly and voluntarily waives all rights under the Federal law, which
provides that the appellant(Weston Sharer)may have 21 days from receipt of the agreement
to review and consider this agreement before signing it. The employee further understands
that he may use as much of this 21-day period as he/she wishes prior to signing and delivering
this agreement. Federal law further provides that Weston may revoke this agreement within
seven (7)days of the signing and delivering it to the County.
Federal law also requires Mason County to advise Weston Sharer to consult with an attorney
before signing this agreement. Having been informed of these rights, and after consultation
with his counsel, he voluntarily waives these rights.
The parties agree that the content of this agreement are contractual and not mere recitals,
Mason County understands that this release does not work to bar claims of breach of this
agreement nor does it work to bar claims related to actions taken by Mason County or its
officers,agents,or employees in the future which would contradict in any way the settlement
reached herein.

This agreement is to be construed under the laws of the state of Washington. The parties
further agree that in the event of a dispute as to the content of this agreement that the proper
jurisdiction and venue shall be Mason County Superior Court, Mason County,Washington.

ITEM: Title VI Non-Discrimination Agreement (NDA):
Annual Update and Accomplishment Report
Background: Washington State Department of Transportation requires Public
Works to submit a Title VI NDA Annual Accomplishment and Update report
yearly.
Title VI of the Civil Rights Act of 1964 is the main legal authority for the
department's Office of Equal Opportunity, External Civil Rights nondiscrimination
programs. Title VI prohibits discrimination on the basis of race, color, sex or
national origin in programs or activities receiving federal financial assistance.
Once an agency accepts federal funds, all of its programs and activities are
covered, regardless of their funding source. Related statutes and Presidential
Executive Orders under the umbrella of Title VI address Environmental Justice
(E]) in minority and low-income populations, and services to those individuals
with Limited English Proficiency (LEP), women and the disabled.
WSDOT's Title VI Program is responsible for providing leadership, direction and
policy to ensure compliance with Title VI and Environmental Justice and Limited
English Proficiency principles and to ensure that social impacts to communities
and people are recognized and considered throughout the transportation
planning and decision-making process.
Recommended Action: Recommend the Board authorize the Chair to sign the
Title VI Non-Discrimination Agreement - Annual Update and Accomplishment
Report for the reporting period from May 1, 2016 to April 30, 2017.

Mason County uses MRSC to advertise for our Consultant, small works, and vendor
rosters, inviting minorities, women, and disadvantaged firms to apply. We also
advertise for projects on Builders Exchange, Shelton Journal, and Seattle Daily
Journal of Commerce, again inviting minorities, women, and disadvantaged firms to
participate.
5. Summarize any transportation projects that identify potential impacts to minority and/or low-
income Environmental Justice (EJ) populations (i.e., impacts such as displacements, increased
noise, bisecting neighborhoods, et al). Note the following:
• How impacts were minimized/mitigated.
The projects completed in the reporting period did not have impacts such as
displacement, increased noise, and/or bisecting neighborhoods; all projects have been
improvements, repairs, or replacement of existing transportation infrastructures.
• Also include a statement, if applicable, on projects that specifically benefit community
cohesion such as: adding sidewalks, improving access to properties that improve access for
EJ populations.
CRP 1997 was the Clifton Lane Sidewalk project that connected two sections of
existing sidewalk. The location had a heavily used walking path, connecting a bus
station to a grocery store. Pedestrian use is routinely considered in design and
adequate roadway shoulders are included for pedestrian use if needed.

SEALED BIDS will be received for the improvement of Clifton Ln in Mason County, Belfair Sidewalk
- Clifton Lane, CRP 1997 (Range Under $100,000), at the office of the County Commissioners,
located in Building 1, 411 North 5th Street, Shelton, Washington, 98584, until 9:00 a.m., Wednesday,
November 30, 2016. Submitted bids will be publicly opened and read in the Commissioner
Chambers, Building I, immediately thereafter. Sealed Bids received after the specified opening time
will not be accepted.
MAJOR BID ITEMS will include Mobilization, LS; Clearing & Grubbing, LS; CSBC, Ton; ESC Lead;
Seeding & Fertilizing by Hand, SY, Project Temporary Traffic Control, LS; Cement Conc. Sidewalk, SF;
SPCC Plan; and other items in conformance with the 2016 WSDOT Standard Specifications, and the Special
Provisions for this project.

Contract awarded from Cascade Pacific Action Alliance (CPAA) for the Medicaid
Transformation Project Year 1 for $60,130 to set up an Opioid Mobile Outreach Pilot
program.
BACKGROUND:
Mason County Board of Health recommended moving forward on an Opioid mobile
outreach project including harm reduction syringe exchange strategies presented in
the January and March Board of Health meetings. Public Health was going to research
funding opportunities and applied for the CPAA RFP in July and was notified on August
15th of the award and on August 311 of the dollar amount awarded.
BUDGET IMPACTS:
None for current year. Will need to review for 2019.
RECOMMENDED ACTION:
Approval of the Cascade Pacific Action Alliance (CPAA) contract.
